For the purpose of this Chapter, the following words and phrases
shall have the meanings respectively ascribed to them by this Section:
EMPLOYEE
Any person, other than a massage therapist, who renders any
service in connection with the operation of a massage business and
receives compensation from the operator of the business or patrons.
LICENSEE
The person to whom a license has been issued to own or operate
a massage business as defined herein.
MASSAGE THERAPIST
A health care practitioner who provides or offers to provide
massage therapy, as provided in Sections 324.240 to 324.275, RSMo.,
to any person at no cost or for a fee, monetary or otherwise, implying
that the massage therapist is trained, experienced and licensed in
massage therapy, and who holds a current, valid license to practice
massage therapy.
MASSAGE THERAPY
A health care profession which involves the treatment of
the body's tonus system through the scientific or skillful touching,
rubbing, pressing or other movements of the soft tissues of the body
with the hands, forearms, elbows, or feet, or with the aid of mechanical
apparatus, for relaxation, therapeutic, remedial or health maintenance
purposes to enhance the mental and physical well-being of the client,
but does not include the prescription of medication, spinal or joint
manipulation, the diagnosis of illness or disease, or any service
or procedure for which a license to practice medicine, chiropractic,
physical therapy, or podiatry is required by law, or to those occupations
defined in Chapter 329, RSMo.
OUTCALL MASSAGE SERVICE
Any business, the function of which is to engage in or carry
on massage therapy at a location designated by the customer or patron
rather than at a massage business.
PATRON
Any person who receives massage therapy under such circumstances
that it is reasonably expected that he or she will pay money or give
any other consideration therefor.
PERMITTEE
The person to whom a permit has been issued to act in the
capacity of a massage therapist.
RECOGNIZED SCHOOL
Any school or educational institution licensed to do business
as a school or educational institution in the state in which it is
located, or any school recognized by or approved by or affiliated
with the American Massage and Therapy Association, Inc., and which
has for its purpose the teaching of the theory, method, profession
or work of massage therapy, which school requires a resident course
of study not less than seventy (70) hours before the student shall
be furnished with a diploma or certificate or graduation from such
school or institution of learning following the successful completion
of such course of study or learning.
SEXUAL OR GENITAL AREA
Genitals, pubic area, buttocks, anus or perineum of any person,
or the vulva or breasts of a female.

A. This Chapter shall not apply to the following individuals
while engaged in the personal performance of the duties of their respective
professions:
1.
Physicians, surgeons, chiropractors, osteopaths
or physical therapists who are duly licensed to practice their respective
professions in the State;
2.
Nurses who are registered under the laws of the
State;
3.
Barbers and beauticians who are duly licensed
under the laws of this State, except that this exemption shall apply
solely to the massaging of the neck, face, scalp and hair of the customer
or client for cosmetic or beautifying purposes.

Massage therapists licensed under Section 324.240
et seq., RSMo.

The massage business premises shall be located in a zoning district
now or hereafter designated as "C," or a higher zoning district permitting
the same or greater land use in zone "C."

No massage business shall be kept open for any purpose between
the hours of 10:00 P.M. and 10:00 A.M.

No person shall employ as a massage therapist any person unless
the employee has obtained and has in effect a permit issued pursuant
to this Chapter.

No massage business granted a license under the provisions of
this Chapter shall place, publish or distribute, or cause to be placed,
published or distributed, any advertisement, picture or statement
which is known or through the exercise of reasonable care should be
known to be false, deceptive or misleading in order to induce any
person to purchase or utilize any professional massage therapy services.

Price rates for all services in a massage business shall be
prominently posted in the reception area in a location available to
all prospective customers.

Every portion of the massage business, including appliances
and apparatus, shall be kept clean and operated in a sanitary condition.
