Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police of the Borough of Bound Brook, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated hereunder shall be punishable by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

No person shall operate a motor vehicle between the hours specified on any day upon any of the streets or parts of streets described herein below:

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safety and proper regulation of traffic, and any peace office may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage, which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for term not exceeding 15 days or both.

If any part of parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Bound Brook are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

A certain document, three copies of which are on file in the Office of the Clerk of the Borough of Bound Brook, being marked and designated as the "Manual on Uniform Traffic Control Devices for Streets and Highways, 2003 Edition, Including Revision 1 dated November 2004," published by the United States Department of Transportation, Federal Highway Administration (hereinafter "M.U.T.C.D."), be and is hereby adopted in its entirety for the uses and purposes set forth therein as if fully set out herein, except as may be modified by the provisions of this section.

Prior to commencement of any construction, maintenance, or other work on, above, or below any public street, highway, roadway or avenue of public travel within the Borough of Bound Brook (hereinafter referred to as "work"), the person or other entity, including any public utility as required by N.J.A.C. 16:25-1 et seq., and other applicable law, the person, other entity, or public utility shall notify the Police Department and arrange a preconstruction meeting at which time plans acceptable to the Police Department for the safe movement of traffic during such periods or work must be submitted.

Prior to commencement of any such work, the person, other entity or utility shall provide at least two emergency contact telephone numbers to be called in case of problems at the work site. In the event the emergency contact person does not respond to a call from the Police Department and/or fails to correct any existing hazardous condition(s), the Borough of Bound Brook may respond to correct the hazardous condition(s). The reasonable cost for such corrective action by the Borough of Bound Brook shall be charged to the person, other entity, or utility responsible for the condition(s).

There shall be no such work performed except between the hours of 9:00 a.m. and after 4:00 p.m. unless the Police Department relaxes the time limitation upon a determination that work operations during other hours would not substantially delay traffic or cause a safety or health hazard; provided, however, that work may be authorized by the Police Department during nighttime hours, 7:00 p.m. and 6:00 a.m., only if a further determination is made that the particular nature of the work involved warrants such work operations to be undertaken during nighttime hours, there will be substantially reduced traffic hazard, and there will not be an unreasonable disturbance to the public.

No materials, vehicles or equipment are to be placed in any roadway or sidewalk until all signs, light devices and pavement markings are installed.

Road closing and/or traffic detours shall not be permitted unless authorized by the Police Department.

No person, entity or utility shall perform any such work, on, above, or below any public street, highway, roadway or avenue of public travel which is designated as a County roadway, State roadway, or Borough of Bound Brook Snow Emergency Route as defined in § 7-10 unless traffic control services have been approved by the Police Department and the approved services are provided. Traffic directors shall be posted at all work sites when it is determined by the Police Department, that they are necessary to provide for the safe and expeditious movement of traffic and pedestrians. Traffic directors will be authorized if such directors are certified through the New Jersey Department of Transportation as outlined through the M.U.T.C.D. and the Police Department determines that conditions at the work site are such that uniformed police officers are not required. If such traffic directors are not provided, traffic direction will be performed by uniformed police officers.

The Police Department is hereby authorized to stop work and/or to remove equipment vehicles, and materials within any street right-of-way, back fillings, open excavations or other work areas, in order to abate any nuisance and/or safety hazard.

Upon conviction for violation of any provisions of this section the maximum penalty shall be one or more of the following: a fine not to exceed $1,250, imprisonment in the County jail for a period not to exceed 90 days, and/or a period of community service not to exceed 90 days. Each and every day upon which a violation of any provision of this section exists shall constitute a separate violation.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary "EMERGENCY NO PARKING" signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of "EMERGENCY NO PARKING" signs when weather conditions, accidents, road construction, fires or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that "EMERGENCY NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle, which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on any streets or highways or portions thereof.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal before regaining possession of the vehicle.
c. 
Any unoccupied vehicle parked or standing, on any municipal, County or State roadway within the Borough, which remains for more than 24 hours after a snowfall, shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal before regaining possession of the vehicle.
d. 
The above parking prohibitions shall remain in effect until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic. Any violations of this subsection will be subject to a fine of no less than $50 or more than $100.

b. 
Exceptions. The following vehicles shall be exempt from this parking permit section:
1. 
Visitors. A vehicle displaying current visitor parking permit may park on any of the controlled streets described above, provided that the operator of the vehicle is a bona fide guest of the residence within the permit parking area. The visitor's permit shall be displayed on the dashboard of the vehicle in such a manner as to be clearly visible by an officer enforcing parking regulations.
2. 
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
3. 
Emergency vehicles. Emergency vehicles and public service, telephone and other public utility vehicles may park within the permit parking area during the time they are rendering service or repairs within that area.
c. 
Administration. Application for parking permits under this section shall be made in writing on forms provided by the Borough Clerk-Administrator or his designee. Permits shall be granted by the Clerk-Administrator under the following terms and conditions:
1. 
To persons who are residents on said street or portion thereof upon which parking is restricted by this subsection, a permanent permit, valid for one year, shall be issued for every vehicle owned or principally operated by such person. There shall be no limit on the number of permits which may be issued to any one household.
2. 
Two visitor permits shall be issued to each residential unit on any street or portion thereof upon which parking is restricted by this section for use only by visitors to that residential unit.
d. 
Violations. It shall be unlawful and a violation of the provisions of this section for any person to:
1. 
Cause, allow, permit or suffer any vehicle registered in his name or operated by such person to be parked in any of the areas designated in paragraph a above as established as a decal parking zone as herein described unless said vehicle displays a proper and current decal in accordance with this section.
2. 
Willfully defraud, misuse or improperly obtain any decal so as the decal is used for a vehicle or person not entitled to use that decal as described under the provision of this section.
e. 
Penalty.
1. 
Any person who shall violate or fail to comply with any of the provisions of paragraph d1 as set forth therein shall be deemed guilty of an offense and shall be punished by a fine of $100.
2. 
Any person who shall violate or fail to comply with the provisions of paragraph d2 as set forth therein or who aids or abets any such violation or failure to comply with that paragraph shall be deemed guilty of an offense and shall be punished by a fine not to exceed $500 or by imprisonment not to exceed 30 days, either or both of those penalties to be imposed at the discretion of the court.

Certain spaces designated for specific uses.
1. 
Pay station permit parking. All parking spaces in municipal parking lots are paid for at the pay station and enforced Monday through Saturday, except holidays. A commuter parking permit may be issued for a period of one month, a consecutive 30 days, for $50. Extended parking shall be $105 for a period of one month, a consecutive 30 days. All parking permits shall be paid at the pay station. It shall be unlawful for any person to cause, allow, permit or suffer any motor vehicle registered in the name of or operated by such person to be parked in the permit parking areas without payment.
c. 
Prohibited parking. It shall also be unlawful for any person to cause, allow, permit or suffer any motor vehicle registered in the name of or operated by such person to be parked in any municipal parking lot anywhere other than a designated parking space. Municipal lots shall not be used as a means of storage for vehicles.
d. 
Penalty. Any person violating any provision of this section shall, upon conviction, be subject to a fine not to exceed $100.
e. 
Penalty for overtime commuter parking. Commuter vehicles parked in the same space for more than 48 hours, are subject to a summons for overtime parking.

In accordance with the provisions of N.J.S.A. 40:48-2.46, on the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

The owners of the premises referred to in this subsection shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the current "Manual on Uniform Traffic Control Devices for Streets and Highways" (MUTCD). The cost of signs and installations shall be the responsibility of the owner of said property. a.
Vehicle operation and parking are only permitted on paved and stone covered areas
b.
No person shall park a vehicle on any playground, ball field, public recreational area or any unpaved area used for recreation purposes at any time, except vehicles used specifically for maintenance of said ball fields or play areas. In the event the parking of any vehicle in such area shall impede or otherwise prevent the usage of such playground, ball field or other recreation area the vehicle shall be deemed a nuisance and any police officer may provide for the removal of the vehicle. The owner shall pay the reasonable costs of any towing and storage which is necessary before regaining possession of the vehicle. This shall be in addition to any and all other summonses or fines which may be issued and imposed by virtue of this section.
c.
Parking is permitted only while and for those person(s) who are visiting the Municipal Park Property or using the playgrounds, ball fields and other recreational areas.
d.
In accordance with paragraph c above, overnight parking of any vehicle is prohibited.
e.
No person shall park any truck or vehicle over four tons gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer on any municipal park property at any time, unless the school bus is being used to transport a visiting team, school, or other sanctioned event
f.
No person shall park a vehicle in a lane of travel that is for access to and egress from a parking area
In accordance with 40 U.S.C. 318B and a written request from the Postmaster, the following Various Traffic Regulations are hereby made applicable to the properties listed below as follows. No person shall operate or park a vehicle in violation of the regulations listed below.

The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Bound Brook. a. 
Definitions. As used in this section, the following terms shall have the following meanings:
CHARGING STATION
A location that is fitted with electric charging station equipment.
CHARGING STATION EQUIPMENT
The conductions, including undergrounded and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging status or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicle.
CHARGING STATION SPACE
A dedicated, marked and signed parking space that is fitted with charging station equipment and exclusively used for the charging of electric vehicles.
ELECTRIC SCOOTER and/or ELECTRIC MOTORCYCLE
A two-wheel or three-wheel electric vehicle that operates exclusively on electrical energy stored in the vehicle's batteries.
ELECTRIC VEHICLE
A vehicle that operates, either partially or exclusively, on electrical energy from the charging station or other electrical energy source that is stored in the vehicle's battery for propulsion purposes. "Electric vehicle" includes: a battery electric vehicle; a plug-in hybrid electrical vehicle; a neighborhood electric vehicle; and electric scooters or electric motorcycles.
NEIGHBORHOOD ELECTRIC VEHICLE
An electric vehicle that is a low-speed vehicle, built to have a top speed of 25 miles per hour and to have a maximum loaded weight of 3,000 pounds.
NONELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE or PHEV
An electric vehicle that contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor; charges its battery primarily by connecting to a charging station or other electrical source not on board the vehicle; may additionally be able to sustain a battery charge using an on-board internal-combustion-driven generator; and has the ability to be propelled through the use of electricity.
SITTING
An electric vehicle remaining in a charging station space after charging is complete.
b. 
Designation of spaces.
1. 
Parking spaces at the following location(s) shall be designated exclusively for use as electric vehicle charging stations:
(a) 
7 spaces in Municipal Parking Lot No. 6 located on East Main Street.
2. 
Notice of reserved parking for recharging of electric vehicles shall be posted on a sign not less than 12 inches by 18 inches in size that clearly and conspicuously states the electric vehicle charging station space is for electric vehicles only and all others are subject to a violation and towing.
c. 
Fees. The following fees shall apply to each designated electric vehicle charging station:

d. 
Use of designated electric vehicle charging station spaces.
1. 
Electric vehicles are authorized to park in spaces designated as electric vehicle charging station spaces only during the time when the vehicles are connected for electric charging purposes or up to four hours, whichever is less. Owners/operators shall be required to remove the vehicle from the charging station space within 15 minutes past the time the vehicle is no longer charging. Vehicles sitting in a charging station space past the fifteen-minute grace period shall be subject to a sitting fee, a violation, and further subject to towing at the owner's expense in accordance with Section 7-3 of this chapter.
2. 
It shall be unlawful for any person to park or leave standing a vehicle in a stall or space designated for the recharging of electric vehicles unless the vehicle is connected for electric charging purposes. Any vehicle violating this requirement is subject to parking fees, a violation and towing at the owner's expense in accordance with Section 7-3 of this chapter.
3. 
It shall be unlawful for any person to obstruct, block or otherwise bar access to a designated electric vehicle charging station.
e. 
Violations.
1. 
Any person in violation of Subsection 7-40.1 shall be liable for additional parking fees and a penalty not to exceed $100.

As used in this section, the following words shall have the following meanings:
PARKING METER
Any mechanical device installed or used for the regulation of parking in accordance with the provisions of this chapter. Each parking meter installed shall indicate by proper legend the legal parking time established by the Borough and when in operation shall indicate the balance of legal parking time, and at the expiration date of the legal parking shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a parking meter zone adjacent to a parking meter and which is designated for the parking of a single vehicle by lines marked on the curb or on the surface of the street adjacent to the parking meter.
PARKING METER ZONE
Any municipal lot, street or part of a street on which parking meters are installed and in operation.

a. 
Designation of parking spaces. Parking meter spaces shall be designated by lines marked on the curbing or surface of the street.
b. 
Installation of parking meters. In parking meter zones, parking meters shall be installed upon the curb or sidewalk immediately adjacent to the parking spaces. The meters shall be placed not more than two feet from the curb nor more than four feet from the front or rear line of the parking space. Each parking meter or device shall display a signal showing legal parking upon the deposit of the appropriate coin for the period of time prescribed by this section. Each parking meter shall be so programmed that, upon the expiration of the lawful time limit, it will indicate that the lawful parking time period has expired. No parking meter shall be installed in any of the areas where parking is prohibited pursuant to N.J.S.A. 39:4-138.
c. 
Operation of parking meters. Except in a period of emergency or in compliance with the directions of a police officer or traffic control sign, when any vehicle is parked in any parking meter space the operator of such vehicle shall, upon entering the parking meter space, immediately deposit in the meter the proper coin required to operate the parking meter as indicated on the meter; and when required by the directions on the meter the person depositing the coin shall also set in operation the timing mechanism on the meter. Upon the deposit of such coin (and setting of the timing mechanism in operation when so required), the parking space may be lawfully occupied by the vehicle during the period of time which has been prescribed for the part of the street on which the parking space is located. Any person parking a vehicle in a parking meter space adjacent to a meter which indicates that unused time has been left in the meter by the previous occupant of the space shall not be required to deposit a coin so long as his occupancy of the space does not exceed the indicated unused parking time.
d. 
Fees. Parking a vehicle in a parking meter space shall be lawful for such periods of time upon deposit of such coins or combinations of coins as set forth in paragraphs d1 through 5 below:
1. 
One-hour zones. Upon payment of $0.50, 30 minutes; upon payment of $1.00,60 minutes.
2. 
Two-hour zones on street. Upon payment of $1 an hour minimum.
3. 
Parking meter bags. The provisions of Subsection 7-41.4 notwithstanding, parking meter bags may be rented from the Police Department to permit extended parking. The fee for a parking meter bag shall be $100 per day.
e. 
Hours of meter operation. Parking meters on streets shall operate every day between the hours of 8:00 a.m. and 6:00 p.m., except Sundays and public holidays. Parking meters in municipal parking lots shall operate every day between the hours of 8:00 a.m. and 12:00 midnight, except Sundays and public holidays.

a. 
Overtime parking. It shall be a violation of this section for any person to permit any vehicle registered in his name or operated by him to be parked beyond the period of legal parking time established for any parking meter zone.
b. 
Feeding the meter. It shall be a violation of this section for any person to deposit in any parking meter or pay station for the purpose of parking beyond the maximum legal parking time for that particular parking meter zone.
c. 
Continued parking after time expires. It shall be a violation of this section for any person to permit any vehicle to remain in any parking meter space while the meter indicates that the vehicle occupying the parking space has already been parked beyond the period prescribed for that parking space.
d. 
Parking area lines. It shall be a violation of this section for any person to park any vehicle across any line or marking of a parking meter space or in a position so that the vehicle is not entirely within the area designated by the lines or markings.
e. 
Damaging meters. It shall be a violation of this section for any person to deface, injure, tamper with, open, destroy or impair the usefulness of any parking meter.
f. 
Use of slugs. It shall be a violation of this section for any person to deposit or cause to be deposited in any parking meter any slug, device, metal substance or other thing except coins of the United States.
g. 
Inoperable meters. It shall be a violation of this section for any person to park a vehicle in a parking meter space adjacent to a meter which fails to accept an appropriate coin, fails to register additional time upon insertion of an appropriate coin, or is otherwise inoperable.

It shall be the duty of the Police Department to enforce the provisions of this section.

It shall be the duty of the Borough Administrator to designate some employees to make regular collections of the coins deposited in parking meters. It shall be the duty of the person designated to remove from the parking meters the coins deposited therein and to deliver the coins to the Treasurer of the Borough, who shall count them or cause them to be counted and make appropriate entries in his/her records or account books and deposit the coins to the credit of the Borough in a bank or trust company approved by the Council as a depository for Borough funds.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

a. 
The Borough hereby determines to install and utilize a traffic control signal monitoring system [System] at various intersections within the Borough as approved by the Commissioner of Transportation pursuant to the Act.
b. 
The System to be installed shall be approved by the Governing Body by resolution.
c. 
The Borough shall have the authority to enter into a contract, following a lawful procurement process, for the installation of the System. Any contract that shall contain provisions contrary to the Act shall not be deemed invalid but rather reformed to conform to the Act.
d. 
The signs notifying drivers that a System is being utilized shall be approved by the Municipal Engineer, and shall be placed on each street converging into the affected intersection as required by the Act.
e. 
The Municipal Engineer shall inspect and certify the System at least once every six months from the date of its installation.

The Police Department of the Borough shall review the recorded images produced by the System, to determine whether sufficient evidence exists demonstrating that traffic control signal violation has occurred and shall issue a Summons when appropriate in accordance with the rules of the Court.

a. 
Except as otherwise provided in this section, the recorded images produced by the System shall be available for the exclusive use of the Police Department for the purpose of discharging his or her duties under P.L. 2007, Ch. 348.
b. 
Any recorded image or information produced in connection with the System shall not be deemed a public record in N.J.S.A. 47:1A-1 et, seq., or common law. The recorded images shall not be: (i) discoverable as a public record by any person, entity, or governmental agency, except upon a subpoena issued by a grand jury or a court order in a criminal matter, or (ii) offered as evidence in any civil or administrative proceeding not directly related to a traffic control signal violation.
c. 
Any recorded image or information collected in connection with a traffic control signal violation shall not be retained after 60 days following the collection of any fine or penalty.
d. 
If a summons is not issued within 40 business days following the traffic control signal violation, all recorded images and any information collected with respect to the traffic control signal violation shall be removed by the Police Department within two business days.
e. 
The Borough shall certify compliance of this section by filing a report with the Commissioner of Transportation in accordance with the Act.

The liability of the owner and operator of a motor vehicle for a traffic control signal violation summons pursuant to the System shall be joint subject to provisions of the Act.
