A Shade Tree Commission in and for the Borough of Folcroft is hereby created.
A. 
The Shade Tree Commission shall be composed of three residents of the Borough of Folcroft, who shall be appointed by the Council of the Borough of Folcroft. One Commissioner so appointed shall serve for a term of three years, one Commissioner for a term of four years, and one Commissioner for a term of five years.
B. 
On the expiration of the term of any Commissioner, a successor shall be appointed by the Council of the Borough of Folcroft to serve for a term of five years.
C. 
Vacancies in the office of Commissioner shall be filled by the Council of the Borough of Folcroft for the unexpired term thereof.
D. 
Members of the Shade Tree Commission shall serve without compensation.
The Shade Tree Commission shall perform all duties and may exercise all the powers conferred by the Borough Code, as supplemented and amended, and should recommend to the Council of the Borough of Folcroft such legislation as is required to enforce regulations for the care and protection of the shade trees of the Borough of Folcroft.
No rule or regulation adopted by said Shade Tree Commission shall be in full force and effect until said regulations has been approved by the Council of the Borough of Folcroft and has been advertised as required by law.
Said Shade Tree Commission shall annually report in full to the Council of the Borough of Folcroft in February of each year, of its transactions and expenses for the last fiscal year of the Borough of Folcroft.
The Shade Tree Commission is hereby authorized to assess penalties of not more than $50 for each and every violation of any regulation of said Commission or of any of the provisions of Article XXVII of the Borough Code, 53 P.S. § 47701 et seq., as supplemented and amended,[1] as far as it relates to shade trees. Any penalties so assessed by said Shade Tree Commission shall be a lien upon the real estate of any offender convicted of violating the regulations of the Commission or of any of the applicable provisions of the Borough Code, as supplemented and amended.

In addition to the imposition of the said penalty, as hereinabove provided, any person who shall violate any provision of this article or any provision of any rule or regulation duly adopted as provided by this article, upon conviction thereof, shall be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
