The purposes of this chapter are:
A. To identify and provide an opportunity to preserve historic resources
which are important to the education, culture, traditions and economic
values of the citizens of Folcroft Borough.
B. To maintain or improve property values in Folcroft Borough.
C. To foster civic pride in the historical, architectural, cultural
and educational accomplishments of Folcroft Borough.
D. To promote the use of historic resources for the education, pleasure
and welfare of all citizens of Folcroft Borough.
E. To encourage public participation in identifying and preserving historical,
architectural and cultural resources through educational programs
and general awareness campaigns.
As used in this chapter, the following terms shall have the
meanings indicated:
DEMOLITION
The removal or destruction of all or significant part of
a designated historic resource, such that the historic or structural
integrity and/or significance of the historic resource is threatened,
reduced or lost. Examples of demolition include, but are not limited
to:
A.
Moving the designated historic resource to another location.
B.
Removal of any portion of any structural element such as a roof
or exterior wall, or of any significant building elements such as
cornices, doors, windows, doorways, porches, or chimneys.
C.
Modifying or otherwise altering the character or appearance
of an historical setting or landscape.
DESIGNATED HISTORIC RESOURCE
Any building, structure, resource, object or site on the
National Register of Historic Places or the Folcroft Borough Historical
Site List, approved by the Folcroft Borough Historical Commission.
This chapter shall not be construed to prevent the ordinary
maintenance or repair of any building or structure, where such work
does not require a permit by law, and where the purpose and effect
of such work is to correct any deterioration or decay of, or damage
to, a building or structure and to restore the same to its condition
prior to the occurrence of such deterioration decay or damage.
Any person aggrieved by a decision of the Council or Commission,
may, within 30 days after receiving notice of the decision, seek judicial
review of that decision in any court of competent jurisdiction. Each
applicant shall offer interested citizens the opportunity to obtain
photographs, drawings, or other materials they feel would be relevant.
The Folcroft Borough Historical Commission shall adopt a list
of historical resources and may add resources to that list that meet
one or any combination of the following criteria:
A. Has significant character, interest, or value as an example of the
development, heritage or cultural characteristic of the Borough, the
county, the commonwealth or the United States.
B. Is the site of a significant historic event.
C. Exemplifies the cultural, political, economic, social or historical
heritage of the community.
D. Is a landmark; that is, an established and familiar visual feature
which assists in defining the character of the neighborhood, community
or Borough due to its unique location or singular physical characteristic.
E. May yield or is likely to yield information of importance to the
Borough's County's Commonwealth's or nation's
history.
F. Is connected with and played a significant role in the life of an
individual whose contribution to the history of the region, the county,
the state and/or the nation was of great significance.
