This chapter shall be known as the "Library Ordinance" of the Borough of Folcroft.
Council shall make appropriations out of current revenues, or out of moneys raised by the special levy of taxes to establish, purchase, acquire or lease and maintain a local library.
Council shall have authority to cooperate with federal, state and local authorities, agencies and municipalities in establishing and maintaining a local library, and in obtaining financial or other aid.
Council shall, on behalf of the Borough of Folcroft, receive, take over and accept the present assets and liabilities of the existing Folcroft Library Association, located at Folcroft, Delaware County, Pennsylvania, said assets consisting of stock of books, magazines and periodicals, and the liabilities consisting of rentals due or to be due; the Folcroft Library Association will dissolve and discontinue operations and existence.
Council hereby establishes a local library, to be known as the "Borough of Folcroft Public Library," and may purchase, acquire or lease lands, buildings and other facilities for such purpose, and may establish such library at such location or locations as it deems best.
The Borough of Folcroft Public Library shall be a free, public, nonsectarian library to serve the informational, educational and recreational needs of the residents of the Borough of Folcroft by providing free access to an organized and currently useful collection of printed items and other materials.
The affairs of the Borough of Folcroft Public Library shall be under the exclusive control of a Board of Library Directors, to be composed of not less than five nor more than seven members. Borough Council shall appoint the members and fill all vacancies. The first appointees shall be appointed as nearly as may be 1/3 for two years and 1/3 for three years. All appointments to fill the places of those whose terms expire shall be for a term of three years. Vacancies shall be filled for the unexpired terms. All members shall serve until their successors have been appointed. No member of the Board shall receive any salary for his service as such.
The Board of Library Directors shall organize as soon as may be after appointment by electing a President, Secretary and Treasurer from its membership, and shall elect, appoint or hire such other officers, agents or employees as the Board may deem necessary. The Treasurer shall give bond to the Borough of Folcroft with satisfactory surety in such amount as Borough Council may determine; the cost of such bond shall be paid by the Borough.

All moneys appropriated for the establishment and/or maintenance of the library and all moneys, if any, received from other sources for its use, shall be under the exclusive control and shall be disbursed under the direction of the Board of Library Directors.

The Board of Library Directors shall make a report annually to the Council of the Borough, of all moneys received by such library and the dispositions made thereof, and the accounts of the Treasurer shall be audited as in the case of other municipal expenditures.
The annual report shall contain an itemized statement of all receipts from whatever source, and expenditures, and shall show the condition of the library and any branches thereof, the number of volume, maps, pamphlets and other materials, the number added by purchase, gift or otherwise, the number lost or withdrawn, the number of registered borrowers and readers and a statement of the circulation of material, with such other information and suggestions as may seem desirable. A copy of each report made to the municipal officers shall be sent to the state library in Harrisburg.
The Borough of Folcroft Public Library shall be free to the use of all residents and taxpayers of the Borough, subject to such reasonable rules and regulations as the Board of Library Directors may adopt, and the Board may exclude from the use of the library any person who willfully violates such rules. The Board may extend the privileges of such library to persons residing outside the limits of such municipality upon such terms and conditions as the Board may prescribe.
The Borough of Folcroft shall hold the real and personal property of the Borough of Folcroft Public Library for library purposes; any person desiring to make donations of books, money, personal property or real estate for the benefit of the library may vest title thereto in the Borough of Folcroft, to be held and controlled by the Borough of Folcroft according to the terms of the deed, gift, device or bequest; in the absence of restrictions by the terms of such donation, deed, gift devise or bequest, said property shall be controlled and administered by the Board of Library Directors.

Whoever retains any book, pamphlet, magazine, newspaper, manuscript, map or other property belonging in or to or on deposit with the Borough of Folcroft Public Library for a period of 30 days after the library has given written notice to return the same, shall be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense.
