The public park and playground, extending from Fifth Avenue to Sixth Avenue and from Harry Street to Hallowell Street, given and devised to the Borough of Conshohocken under the will of Mary H. Wood, deceased, shall hereafter be known as the "Mary H. Wood Park."

Said park and playground shall be used for the recreation and enjoyment of the public, in such manner and for such purposes as may from time to time be ordained by the Borough authorities; subject to the rules and regulations herein contained and to such rules and regulations as may be laid down by the Park Commission hereinafter created.

Said park and playground shall be under the following rules and regulations; and such others as the Park Commission may from time to time establish; provided same are approved by ordinance or resolution of the Borough authorities:
A. 
No person shall carry firearms or shoot birds in the park, or throw stones or other missiles therein.
B. 
No one shall cut, break or in anywise injure or deface the trees, shrubs, plants, turf or any of the buildings, fences, structures or statuary or foul any water within the park or its buildings.
C. 
No person shall sell or expose any articles for sale within the park without the permission of the Park Commission.
D. 
No threatening, abusive, insulting or indecent language shall be allowed in the park.
E. 
No gaming shall be allowed therein, nor any obscene or indecent act therein.
F. 
No person shall have any musical, theatrical or other entertainment therein without the permission of the Park Commission.
G. 
No gathering or meeting of any kind, assembled through advertisement, shall be permitted in the park without the previous permission of the Park Commission, nor shall any gathering or meeting for political purposes in the park be permitted under any circumstances.
H. 
No person shall solicit alms or subscriptions in the park.
I. 
No person shall scatter, drop or leave in any part of the park, except in the receptacles provided for the purpose, any piece of paper, rag, garbage, dead flowers or other rubbish.
J. 
No person shall injure, deface or destroy any notices, rules or regulations for the government of the park placed, posted or in any other manner permanently fixed within the limits of the same.
K. 
No placard, advertisement, public notice or personal card, except park notices, rules and regulations, shall be distributed, posted or affixed in any manner in the park.
L. 
No person without the authority of the Park Commission shall light or permit a fire to burn in the park or its buildings.

Any person who shall violate any of the foregoing rules or regulations or any others which shall be established by the Park Commission in the manner herein provided, shall upon conviction thereof, be sentenced to a fine of not to more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation continues shall constitute a separate offense.

All income and other moneys derived from the trust fund created under the will of Mary H. Wood, deceased, or from any other trust fund now or thereafter created for the purposes or uses of said park shall be paid over to the Borough Treasurer, who is hereby designated the proper official to receive and receipt for same. Said moneys shall be kept in a separate fund to be known as the "Mary H. Wood Fund." Payments therefrom shall be made only for the uses and purposes as set forth in Item six of the codicil of the said will of Mary H. Wood, deceased.

A Park Commission is hereby created consisting of seven members, three of whom shall be members of the Borough Council, and four of whom shall be residents of or engaged in business in the Borough of Conshohocken.
2. 
Said Commission shall be selected and serve as follows:
A. 
Of those who are to be members of Borough Council, Council shall elect two members to serve for a term of two years or until the expiration of their terms as Council members if within two years. The third Commissioner shall be the President of Borough Council.
B. 
Of those Commissioners who are to be residents of or engaged in business in Conshohocken as herein provided, three shall be elected by Borough Council to serve for a term of two years. The third shall be selected by the trustee of the trust fund for park purposes under the will of Mary H. Wood, deceased, subject to confirmation by Borough Council, and shall serve a term of two years.
3. 
Commissioners shall be subject to removal by Borough Council.
4. 
Whenever a vacancy for any reason shall occur, it shall be filled in the same manner and by the same body or bodies appointing or electing the original Commissioners; provided, however, in case of the removal of the President of Borough Council as a Commissioner, Borough Council shall elect his successor to serve until such time as a new President of Borough Council is chosen.
5. 
The Park Commissioners shall receive no compensation for their services.

Immediately upon their appointment, said Commissioners shall organize and elect from their own number a President and a Secretary, and such other officers or committees, as they may deem proper.

Thereafter, they shall organize on the first Wednesday in January of each and every year, and at the time thereof, shall submit to Borough Council a report of their proceedings and a statement of their expenditures for the preceding year.

Subject to the limitations and restrictions contained herein, the Park Commission shall have the following powers and duties:
A. 
It shall have possession and custody over, and exercise due care and recommend due control of, the Mary H. Wood Park, its grounds, buildings, structures, equipment, apparatus and property of every description, real or personal, and shall be charged and entrusted with making recommendations to the Borough Council for its maintenance and upkeep.
B. 
It shall supervise and regulate the public use of the park, and shall assure that all controls are in place to permit the proper use of the park by the public.
C. 
The Commission shall make recommendations to Borough Council regarding all plans or expenditures for maintenance to or improvements in the Mary H. Wood Park prior to adoption of any such plan or expenditure by Council.
D. 
The Commission may employ such officers, agents or consultants as may be deemed necessary to fulfill their duties under this section, subject to approval by the Borough, and subject to Borough Council approval of the appropriation of funds for the employment of such persons by the Commission.

The Park Commission may, from time to time, make recommendations to Borough Council concerning the use of the Mary H. Wood Park, its buildings, grounds and equipment to best effectuate and carry out the purposes of the park as set forth in the will of the said Mary H. Wood. It may also suggest such changes, alterations and improvements as in its judgment may be desirable; provided, however, that no such changes, alterations and improvements shall be made, and the park may not be used, other than provided herein, except as Borough Council may from time to time approve.

For the present, and until such time as plans are perfected by said Park Commission and approved by Borough Council for other and more special uses, the Park Commissioners, after they have secured possession of said park, shall open said grounds to public use and enjoyment for park and playground purposes subject to such temporary restrictions and regulations as said Commissioners may establish.[1]
