1. 
For the purposes of the residential permit parking sections of this Part, the words and terms listed in this section shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
CONTRACTOR
A person or entity who does not reside within the designated residential parking permit area, but is performing work on behalf of a property owner on a structure, dwelling or the exterior property of such structure or dwelling which is located within the designated residential parking permit area that does not have available off-street parking.
ELIGIBLE EMPLOYEE
A person who does not reside within a designated residential permit parking area, but is an employee or employed by a proprietor, as defined herein, located within the designated residential parking permit area. For the purpose of this section, an eligible employee shall be required to provide proof of employment at the time of making application for a parking permit and shall only be eligible for one parking permit during his or her period of employment; no more than two employee parking permits per business shall be issued at any one time.
PARKING COMMITTEE
A three-member committee appointed by the Borough Council, which shall be responsible for reviewing and approving all residential parking permit applications within the Borough subject to the provisions of this Part. The Committee shall also have the authority to revoke permits and grant exemptions for the number of residential parking permits to be issued under this Part upon a showing of need for the issuance of additional permits such as, but not limited to, children or additional family members of driving age living with a resident.
PROPRIETOR
A person who owns or leases real estate within the designated residential permit parking area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained in the designated residential permit parking area. For the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within the designated residential permit parking area and who maintains either a voting residence or bona fide occupancy, or both, at that address.
RESIDENTIAL PARKING PERMIT
A permit issued by the Borough allowing the parking of a vehicle or vehicles within the designated residential permit parking area. Residential parking permits shall be issued for the address of the applicant and may be used in any vehicle registered to that address. Residential parking permits shall be designed to hang from the rear view mirror of the vehicle and shall be of such dimensions and colors as determined from time to time by resolution of Borough Council.
VISITOR
A person who does not reside within a designated residential permit parking area, but is visiting or residing with a resident on a temporary basis.

1. 
Parking in a designated residential permit parking area shall be in accordance with the following:
A. 
Vehicles with a residential parking permit may park at any time in the designated residential permit parking area.
B. 
Vehicles with a visitor parking permit may park at any time in the designated residential permit parking area for the period designated on the permit.
C. 
Vehicles with an employee parking permit may park at any time in the designated residential permit parking area for the period designated on the permit, but only between the hours of 9:00 a.m. and 5:00 p.m., prevailing time, on the days designated in this section.
D. 
Vehicles with a contractor parking permit may park at any time in the designated residential permit parking area for the period designated on the permit, but only between the hours of 9:00 a.m. and 5:00 p.m., prevailing time, on the days designated in this section.
E. 
Vehicles without a parking permit may park for up to two hours in any designated residential permit parking area between the hours of 9:00 a.m. and 5:00 p.m., prevailing time.
F. 
Signs shall be erected along the streets in each designated residential permit parking area, indicating whether the Area is designated A, B or C and the locations and conditions under which parking shall be by permit only.
G. 
Vehicles with a valid parking lot permit may park on Coach Street between Second Street and Western Terrace; Western Terrace between Coach Street and Locust Street; and North Fourth Street between Lincoln Avenue and Chase Street, at any time in the designated residential permit parking areas.

1. 
The person desiring a permit shall submit an application to the Borough Manager or his/her designee. This person must be an owner of or authorized by the owner of a motor vehicle as the driver and must reside in or be a proprietor of property located within the designated residential parking permit area, or be an eligible employee. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established by resolution of the Borough Council, to be applied to the cost of administering the residential permit parking program. Each application must contain the following information:
A. 
The name of the owner or the driver, as the case may be, of the motor vehicle;
B. 
The address of the resident, the proprietor or eligible employee, as the case may be;
C. 
The make, model and registration number of the motor vehicle;
D. 
The driver number as taken from the applicant's current driver's license;
E. 
A certification that the applicant does not have a driveway, garage or other off-street parking available, or if such parking is available, a certification of the number of vehicles that could park in such driveway, garage or off-street parking area if it were otherwise completely vacant;
F. 
If the applicant is seeking issuance of more than the number of permits allowed for a single residence, the applicant shall supply a certified statement as to why additional permits are necessary, such as, but not limited to, children or additional family members of driving age living with a resident.
2. 
Eligible employees shall also provide proof of employment within the designated residential permit parking area at the time of application. At the discretion of the Borough Manager or his/her designee, the applicant shall be required, at the time of making application, to present his/her driver's license and the vehicle registration card.

Upon receipt of the application and the permit fee, the Borough Manager or his/her designee shall forward such application to the Parking Committee and upon its determination that the information upon the application shows that the applicant is entitled to a residential parking permit or permits, the Borough Manager or his/her designee shall issue to the applicant a residential parking permit or permits, which shall be valid for the remainder of the calendar year. Except as otherwise provided herein, no more than two residential parking permits shall be issued for any eligible residential dwelling unit, and no more than one residential parking permit shall be issued to a proprietor or eligible employee of any business, professional office or nonresidential property address with the maximum number of permits limited to two per business. The permit shall display the address for which it was issued and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a designated residential permit parking area at any time when those permits are to be displayed. Notwithstanding any other provision of this Part to the contrary, the Parking Committee may limit or deny the issuance of residential, contractor and temporary parking permits where an applicant has a driveway, garage or other off-street parking available.

1. 
Temporary parking permits may be issued by the Borough Manager or his/her designee, upon payment of a fee in an amount as established by resolution of the Borough Council, to contractors and bona fide visitors of residents of a designated residential permit parking area as follows:
A. 
Temporary Permit Applications.
(1) 
Application for a contractor parking permit shall be made to the Borough Manager or his/her designee by the person residing on or who is a proprietor of property located within the designated residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established by resolution of the Borough Council, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the contractor's current driver's license. At the discretion of the Borough Manager or his/her designee, the contractor shall be required, at the time of making application, to present a vehicle registration card.
(2) 
Application for a visitor parking permit shall be made to the Borough Manager or his/her designee by a person residing on a property located within the designated residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established by resolution of the Borough Council, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information:
(a) 
The name of the owner or the driver, as the case may be, of the motor vehicle;
(b) 
The address of the resident;
(c) 
The make, model and registration number of the motor vehicle; and
(d) 
The driver number as taken from the visitor's current driver's license.
(3) 
At the discretion of the Borough Manager or his/her designee, the visitor shall be required, at the time of making application, to present a vehicle registration card.
B. 
Temporary Permit Issuance.
(1) 
Upon receipt of a contractor application and the permit fee, and determination by the Borough that the information upon the application shows that the applicant is entitled to a contractor parking permit, the Borough Manager or his/her designee shall issue to the applicant a contractor parking permit, which shall be valid for up to 30 days. Contractor parking permits shall be designed to hang from the rear view mirror of the vehicle and shall be of such dimensions and colors as determined from time to time by resolution of Borough Council. No more than two contractor parking permits shall be issued for any eligible property which is located within the designated residential parking permit area. The permit shall display the license plate numbers of the motor vehicle and the expiration date. The permit shall be renewable on or before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any contractor to display other than a current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
(2) 
Upon receipt of a visitor application and the permit fee, and determination by the Borough that the information upon the application shows that the applicant is entitled to a visitor parking permit, the Borough Manager or his/her designee shall issue to the applicant a visitor parking permit, which shall be valid for up to 14 days. Visitor parking permits shall be designed to hang from the rear view mirror of the vehicle and shall be of such dimensions and colors as determined from time to time by resolution of Borough Council. No more than two visitor parking permits shall be issued for any eligible residence which is located within the designated residential parking permit area. The permit shall display the license plate numbers of the motor vehicle and the expiration date. The permit shall be renewable once on or before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any visitor to display other than a current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
C. 
Exemption. Parking permits may be issued to visitors with a physical disability without payment of a fee.

1. 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
2. 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
3. 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
4. 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Borough Manager or his/her designee in order to obtain a residential parking permit.

The Parking Committee shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this Part. Upon written notification to the permit holder of the revocation, the permit holder shall surrender the permit to the Borough Manager or his/her designee. Failure to do so, when so requested, shall constitute a violation of this Part, provided that any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Borough Council for a hearing on the revocation, and the decision of the Borough Council shall be final.

Parking lot permits shall be designed to hang from the rear view mirror of the vehicle and shall be of such dimensions and colors as determined from time to time by resolution of Borough Council.
PROPRIETOR
A person who owns or leases real estate located at an eligible street address and who owns or manages a business enterprise or professional office maintained at that address. For the purpose of this Part, a proprietor shall be entitled to one parking permit.
RESIDENT
A person who owns or leases real property located at an eligible street address and who maintains either a voting residence or bona fide occupancy, or both, at that address. For the purpose of this section, where a resident does not have the number of on-lot parking spaces required for his/her dwelling unit under the Borough's Zoning Ordinance,[1] he/she shall be entitled to the number of parking permits equal to the difference between the number of existing on-lot parking spaces and the number of spaces required by the Zoning Ordinance for his/her dwelling unit.

The Borough Manager or his/her designee shall accept applications for the issuance of parking lot permits for parking lots owned by the Borough and for which a charge is otherwise made for the parking of motor vehicles. The applications for parking lot permits shall be obtained at the Borough business office. Proprietors, residents and employees, as defined in this Part, shall be eligible for parking lot permits.

The Parking Committee shall determine if an applicant is eligible for a parking lot permit. If the Parking Committee determines that an applicant is eligible for a parking lot permit, the same shall be issued to any such eligible applicant for use with any vehicle, upon payment to the Borough in a monthly amount, which amount shall be determined by resolution of the Borough Council. The number of parking permits issued may be limited by the Parking Committee based on the total number of parking spaces in Borough parking lots.

The parking lot permits provided herein shall be valid for one to three calendar months, and the entire parking lot permit fee provided by resolution of the Borough Council shall be payable upon issuance of the parking lot permit, irrespective of the date of the month of the issuance of the permit. The recipient of a parking lot permit issued as provided herein shall prominently display the permit on the recipient's motor vehicle whereupon the recipient shall have the privilege of parking, without paying any additional parking fee, in any Borough parking lot so designated for such parking and for which a charge for parking is otherwise made.
2. 
Upon approval by the Parking Committee, the Borough Manager or his/her designee shall, on payment of the parking permit fee, issue parking lot permits to eligible applicants on a month-to-month basis or issue a series of permits valid for consecutive months, as the Parking Committee deems appropriate and convenient.

It shall be a violation to create and intentionally display on any motor vehicle a facsimile of a parking lot permit issued as provided herein or any other device for the purposes of obtaining the privileges accruing to those persons who obtain a parking lot permit as provided herein.

Upon application to and approval by the Parking Committee, any person living in a dwelling unit abutting an eligible street address shall be entitled to procure a parking lot permit if the person demonstrates to the Parking Committee that the person has no on-site parking available, whether or not that parking is fee-based.

Any person violating any provision of this Part shall, for each and every such violation and upon conviction thereof, be sentenced to pay a fine of $20 plus costs and in default of payment of said fines and costs, to undergo imprisonment for not more than five days.
