The Office of Borough Manager is hereby created by the Borough Council of the Borough of Chalfont, Bucks County, Pennsylvania, subject to the right of the Borough Council, by ordinance, at any time to abolish such office.
The Manager shall be appointed for an indefinite term by a majority of all members of the Council. The Manager shall serve at the pleasure of the Council and may be removed at any time by a majority vote of all its members. At least 30 days before such removal is to become effective, Council shall furnish the Manager with notice of its intention to remove him or her.
The Manager shall be chosen solely on the basis of executive and administrative abilities. The Manager need not be a resident of the Borough of Chalfont at the time of appointment, but during the tenure of office the Manager may reside outside the Borough of Chalfont only with the approval of Council.
Before commencing the duties of the office, the Manager shall give bond in the sum of $100,000 to the Borough of Chalfont with a bonding company as surety, conditioned upon the faithful performance of his or her duties. The premium for said bond to be paid by the Borough of Chalfont.
The salary of the Borough of Chalfont Manager shall be fixed, from time to time, by Council.
The Manager shall be the Chief Administrative Officer of the Borough of Chalfont and shall be responsible to Council for the proper and efficient administration of the affairs of the Borough of Chalfont. The powers and duties of administration of all Borough of Chalfont business shall be vested in the Manager, unless expressly imposed or conferred by statute or ordinance upon other Borough of Chalfont officers. Borough Council may further delegate, subject to recall, any of its nonlegislative powers and duties to the Manager. The powers and duties of the Manager shall include the following:
A. 
Exercise administrative supervision over all municipal departments except the departments that the supervision of which has not been delegated to the Manager by Borough Council.

B. 
Hire, suspend or discharge any employee under his or her supervision, provided that Council must confirm at its next meeting any action taken by authority of this subsection.
C. 
Fix wages and salaries of all personnel under his or her supervision, within a range previously determined by Council.
D. 
Assist in the preparation of a budget for the next fiscal year and an explanatory budget message prior to a date determined by Borough Council. In preparing the budget, the Manager or an officer designated by the Manager shall obtain from the head of each department, agency, board or officer an estimate of revenues and expenditures and other supporting date as he or she deems necessary and requests. The Manager shall assist in reviewing such estimates and may revise them before submitting the budget to Borough Council.
E. 
Be responsible for the administration of the budget after its adoption by Borough Council.
F. 
Hold such other Borough of Chalfont offices and head such Borough of Chalfont departments as Council may, from time to time, direct.
G. 
Attend all meeting of Borough Council and may attend committee meetings with the right to take part in the discussions and shall receive notice of all special meetings of Borough Council and of its committees.
H. 
Prepare the agenda for each meeting of Borough Council and provide the agenda and pertinent facts thereto to each member of Borough Council in advance of each meeting.
I. 
Keep Borough Council informed as to the conduct of Borough affairs, submit periodic reports on the condition of the Borough finances and such other reports as the Borough Council may, from time to time, request, and shall make such recommendations to the Council as deemed necessary.
J. 
Submit to the Borough Council as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
K. 
See that the provisions of all franchises, leases, permits and privileges granted by the Borough are observed.
L. 
Employ, after securing the approval of Borough Council, experts and consultants to perform work and to advise in connection with any of the activities and/or functions of the Borough.
M. 
Attend to the letting of contracts as approved by the Borough Council in due form of law and shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Borough officer by statute.
N. 
See that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all of the Borough's claims.
O. 
Be the purchasing officer of the Borough and shall purchase, in accordance with the provisions of the Borough of Chalfont Home Rule Code, all supplies and equipment for the various agencies, boards, departments and other offices of the Borough. The Manager shall keep an account of all purchases and shall, from time to time, or when directed by Council make a full written report thereof.
P. 
Cooperate with the Borough Council at all times and in all matters in order that the best interests of the Borough and of the general public may be maintained.
Q. 
All complaints regarding services or personnel of the Borough, except relating to police, shall be referred to the office of the Manager. The Manager, or an officer designated by the Manager, shall investigate and dispose of such complaints, and the Manager shall report thereon to Borough Council.
In case of illness or the absence of the Manager from the Borough, the Borough Council may delegate one qualified member of the Borough staff who shall perform the duties of the Manager during his or her absence or disability.
The Manager may furnish and use his or her own private motor vehicle or use a Borough motor vehicle in connection with his or her duties as Manager. The Manager shall be reimbursed for the use of his or her own private motor vehicle at the prevailing rate established by the Internal Revenue Service as acceptable. The Manager shall furnish, at his or her own expense, property damage and public liability insurance covering himself and the Borough of Chalfont when he or she uses his own private motor vehicle for Borough business. The public liability insurance shall be in such amounts as shall be determined by the Borough Council.
The office of Borough Manager shall not be deemed incompatible with the office of Borough Secretary, Borough Treasurer or any other Borough office or employment, except that of Councilperson.

The Council, its members and its committees shall not dictate or influence, or attempt to dictate or influence, the hiring of any person or his discharge from municipal employment by the Manager or in any manner take part in his hiring, suspending or discharging of employees in the Administrative Department of the Borough except as required by the civil service provisions of the Borough of Chalfont Home Rule Code (Charter) or the provisions of the Local Agency Law, 2 Pa.C.S.A. § 551 et seq. and 2 Pa.C.S.A. § 751 et seq., or the provisions of § 50-6B of this chapter. Other than for the purposes of inquiry, Council or any of its members or any of the Borough of Chalfont committees or its members shall deal with the Administrative Department solely through the Manager, and Council shall not give orders publicly or privately to any subordinate of the Manager.
