A.
A fishing permit issued by the Village Clerk shall be required to
fish in the water supply system of the Village of Highland Falls.
B.
Permits shall be available for a one-year term beginning June 1 through
May 31 of each year.
C.
A permit application and fee schedule shall be established by resolution
of the Board of Trustees and modified in the same manner from time
to time, and may include a schedule of fees, fines, duties and responsibilities
of permittees.
D.
Permittees shall be subject to the conditions set forth in this chapter.
Failure to adhere to the conditions shall result in forfeiture of
the permit and fines as set forth herein.

An applicant for a fishing permit:
A.
Permittees will be required to have their permit with
them while fishing in the area designated herein.
B.
Permits will be issued by the Village Clerk.
C.
The permit will not be transferable.
D.
It will be made available for viewing by any member
of the Board of Trustees, Village Police Department, Water Department
and any other person deputized to act for the Village in this connection.
Additionally, permittees shall:
A.
Be responsible for the actions of their guests.
B.
Not deposit human excreta in or around within 130
feet of the water supply system, inclusive of springs and marshes
that contribute to such system.
C.
Not wade, bathe, swim or perform any housekeeping
style of washing in the system.
D.
Not molest fixed property (fences, walls, gates, etc.)
nor disturb surrounding foliage and woodlands.
E.
Not start or maintain fires, except during ice fishing
season.
F.
Keep the area free of debris (this includes any item
carried to the fishing site and/or developed thereon by the permittee).
The area, for this purpose, includes the Village and adjoining properties
and highways.

A.
Only manually operated or electrically operated boats shall be allowed
in the water supply system of the Village of Highland Falls.
B.
The boat owner shall have sole responsibility for the boat and compliance
with these regulations.
C.
The owner shall be jointly responsible for removing the boat from
the water and taking it away from the area at the end of each fishing
day. Failure to remove the boat may be cause for denial of a permit
the following year.
D.
Boats not removed by the owner may be removed by the Village and
impounded at the owner's sole expense.
Failure to comply with the rules and provisions
set forth herein and with any reasonable instructions or requests
made by those mentioned above may be grounds for revocation of the
permit.
This supersedes all previous rules and regulations
pertaining to fishing and use of boats in the water supply system
of the Highland Falls Water Department.

Any person violating any of the provisions of
this chapter shall be guilty of a violation and, upon conviction thereof,
shall be punishable by a maximum fine of $250 or by a term of imprisonment
of not more than 15 days, or both. Each day that a violation of or
failure to comply with any provision of this enactment or any regulation
promulgated hereunder by the Board of Trustees occurs shall constitute
a separate and distinct violation.
