All unlicensed motor vehicles, nonmotorized vehicles and tangible
personal property parked or stored within the right-of-way of a Town
road in the Town of Whitewater, Walworth County, Wisconsin, shall
be removed within 48 hours after a "Notice to Remove" signed by a
member of the Town Board has been posted on the vehicle or the item
of personal property or delivered to an occupant of the adjacent real
estate by the noncertified law enforcement officer of the Town.
When any person parking or storing an unlicensed motor vehicle,
nonmotorized vehicle or other tangible personal property within the
right-of-way of a Town road fails within 48 hours after a "Notice
to Remove" is posted on the vehicle or the item of tangible personal
property, the noncertified law enforcement officer of the Town has
the power to have the vehicle or item towed away; and the cost of
the tow and storage fees plus any collection costs, including reasonable
attorneys' fees, must be paid by the owner or owners of the item.
