The Council of the City of Lancaster finds and declares that the provisions of this article are enacted for the following reasons:
A. 
To reduce hazardous traffic conditions resulting from the use of streets within residential districts for vehicles parked by persons not residing within the residential districts.
B. 
To protect the residents of these residential districts from unreasonable burdens in gaining access to their residences.
C. 
To preserve the character of these districts as residential districts.
D. 
To promote the peace, comfort, convenience and welfare of all inhabitants of the City.
This article shall also be known and may be cited as the “Lancaster Residential Parking Permit Ordinance.”
As used in this article, the following terms shall have the meanings given herein:
ADMINISTRATOR
The Parking Permit Administrator referenced in § 285-41 below.
CURBSIDE PARKING SPACE
Twenty-two linear feet of curb, exclusive of those portions of the curb where parking, apart from the provisions of this article, is not presently permitted.
DAYTIME PARKING PERMIT AREA
A public street or streets within a residential district where curbside parking is restricted as set forth in this article on weekdays during daytime hours fixed by the Traffic Commission to not more than two consecutive hours unless the vehicle properly displays a parking permit authorized by this article.
DWELLING UNIT
A single unit providing independent living facilities for one or more persons, including provisions for living, sleeping, eating, cooking and sanitation. For purposes of this article, a dwelling unit includes, amongst other dwelling units, a single apartment or efficiency, a single-family house, a dwelling unit within a multifamily house, and dwelling units within other types of facilities.
NIGHTTIME PARKING PERMIT AREA
A neighborhood district where curbside parking on public highways is restricted as set forth in this article on weekdays during hours fixed by the Traffic Commission, unless the vehicle properly displays a parking permit authorized by this article.
RESIDENT
A person who occupies real estate within a residential district as his/her principal or secondary residence.
RESIDENTIAL DISTRICT
A contiguous or nearly contiguous area containing public highways or parts thereof primarily abutted by residential property or residential and nonbusiness property, determined to be a residential district by the Traffic Commission.
RESIDENTIAL PARKING PERMITS
All permits issued by the Administrator for parking in residential districts.
RULES AND REGULATIONS
The regulations promulgated and adopted in accordance with § 285-55 of this Code.
TRAFFIC COMMISSION
The Traffic Commission organized and existing under the provisions of Chapter 22, Article VII.
The powers and duties as contained and set forth in this article shall be performed by a Parking Permit Administrator, or "Administrator," who shall be a municipal employee assigned the responsibility of providing administrative support to the Traffic Commission. The Administrator or his or her designee(s) shall be responsible for the orderly operation and administration of all aspects of the parking permit system, and the daytime parking permit and nighttime parking permit process, including but not limited to the issuance of permits in accordance with the terms of this article and the policies and procedures implemented in accordance with this Code.
A. 
The Traffic Commission is hereby empowered to determine, in its discretion, and in accordance with the standards and procedures set forth herein and/or in regulations adopted pursuant to § 285-55 of this Code, whether a residential district, or portion thereof (provided such portion is a segment of a public street which lies between two public streets which intersects with the street which is the subject of the application to establish a residential parking permit area), may be designated or may continue to be designated a daytime parking permit area and whether a residential district, or portion thereof, as described above, may be designated or may continue to be designated as a nighttime parking permit area. The decision of the Commission shall become effective as is set forth in § 22-17C for the implementation of Commission regulations.
B. 
Attached hereto and incorporated herein is a map detailing the areas of the City of Lancaster currently designated as daytime parking permit areas and nighttime parking permit areas by the Traffic Commission as of March 20, 2012. From time to time, in accordance with the terms of this Code, the Administrator shall modify this map and provide copies thereof to the City Clerk with such modifications to reflect the then-current daytime parking permit areas and nighttime parking permit areas as approved and promulgated by the Commission.
A. 
Within a designated daytime parking permit area which has not been designated a parking meter zone, curbside parking on public highways by non-parking-permit holders shall be limited to not more than two hours between such hours on weekdays, excepting those holidays set forth in this chapter, as the Traffic Commission shall establish at the time of designation of a residential district as a daytime parking permit area, provided that such period of hours when curbside parking by non-parking-permit holders shall be restricted shall not exceed the period of from 7:00 a.m. to 6:00 p.m. but may be such lesser time as the Commission determines to be warranted by the circumstances of the residential curbside parking needs of the particular residential district involved.
B. 
Within a designated daytime parking permit area which has been designated a parking meter zone, curbside parking on public highways by non-parking-permit holders shall be limited to the legal parking time established by the Traffic Commission for the parking meter zone as set forth in Article IV of Chapter 285 of the Code of the City of Lancaster.
C. 
After designation of a residential district as a daytime parking permit area, the hours of the weekday during which the restriction on curbside parking by non-parking-permit holders shall be in effect and the legal parking time established for a parking meter zone designated within a daytime parking permit area shall be subject to change from time to time by the Commission in the same manner as provided in Chapter 22, Article VII, and in Article IV of this chapter for the regulation of street use and the regulation of parking meters by the Commission.
D. 
Within a designated daytime parking permit area which has been designated a parking meter zone, holders of parking permits for that residential parking permit area may park without complying with § 285-30, Deposit of coins, tokens or payment; § 285-32, Overtime parking; and § 285-33, Extending legal parking time, of Article IV of Chapter 285 of the Code of the City of Lancaster.
E. 
Within a designated nighttime parking permit area (whether or not designated as a parking meter zone), curbside parking on public highways by non-parking-permit holders shall be prohibited during the hours of 6:00 p.m. to 6:00 a.m. on weekdays, excepting those holidays set forth in this chapter, or such lesser time frame as the Traffic Commission shall establish at the time of designation of the portion of a residential district area as a nighttime parking permit area, as the Commission determines to be warranted by the circumstances of the residential curbside parking needs of the particular neighborhood district involved.
A. 
Upon the Traffic Commission's affirmative vote to designate a daytime parking permit area and/or a nighttime parking permit area pursuant to § 285-42 becoming effective, parking signs shall be erected in the designated area.
B. 
The parking signs shall be of such character as to readily inform an ordinarily observant person that curbside parking on public highways in the designated areas is restricted as set forth in this article and/or the decision of the Commission unless the vehicle properly displays thereon the appropriate parking permit authorized by this article.
C. 
Following erection of the parking signs, it shall be a violation of this article for any person to park in any designated daytime parking permit area in violation of the posted time limit set forth on the parking signs erected in the parking permit area in accordance with this section, unless the vehicle properly displays thereon a parking permit authorized by this article.
D. 
Following erection of the parking signs, it shall be a violation of this article for any person to park in any designated nighttime parking permit area in violation of the parking signs erected in the parking permit area in accordance with this section, unless the vehicle properly displays thereon a parking permit authorized by this article.

A permit shall be required for the placement of any dumpster or other container in any right-of-way of the City of Lancaster. The Director of Public Works is hereby authorized to promulgate certain rules and regulations regarding the size, location, placement and duration of occupancy of any dumpster or other container within the City rights-of-way. No such permit may issue except upon payment of a fee as fixed from time to time by resolution of the City Council of the City of Lancaster.
The Administrator shall issue a daytime parking permit to individuals the Administrator determines meet the standards for issuance of a permit as set forth in the rules and regulations after the applicant has submitted the items required by the rules and regulations and an annual fee of $20. An additional fee of $10 shall be imposed on permits issued to an applicant whose residence is also located within a nighttime parking permit area, as designated by the Commission. An annual fee of $20 for each motor vehicle for which a residential parking permit is issued shall be charged by the Administrator. If a permit is issued on or after July 1 of any year, the fee shall be reduced by 50%. The permit shall expire on December 31 of each year.

A. 
After the holder’s payment of a residential parking permit renewal fee of $20 for a vehicle to be parked in a daytime parking permit area or a nighttime parking permit area, submission of any and all documents required to be submitted to the Administrator in accordance with the rules and regulations, and the Administrator’s determination that such a permit is justified, the holder shall receive a new residential parking permit or the holder’s existing permit shall remain in effect, depending upon the then-existing policies of the Commission and Administrator. An additional fee of $10 shall be imposed on the renewal of permits issued to an applicant whose residence is located both in a daytime parking permit area and in a nighttime parking permit area as designated by the Traffic Commission.
B. 
The expiration date on the permit as renewed shall be December 31 of each year.

A. 
Additional permits other than a daytime parking permit and nighttime parking permit may be issued by the Administrator in accordance with the terms of the rules and regulations adopted pursuant to this Code.
B. 
Upon application of any resident of a daytime parking permit area or any person doing business with this resident and payment of the required contractor parking permit fee, as noted herein, the Administrator or the Administrator’s designee shall issue a contractor parking permit to the resident or to the person doing business with the resident, to be limited to the resident’s particular parking permit area, for a period not exceeding six months. The minimum fee for a contractor parking permit, which permit shall be limited to one vehicle, shall be $20 for the first month and $10 per month or portion thereof, not to exceed six months. No more than three contractor parking permits shall be issued for a single property at any one time. No contractor parking permit shall be issued for a vehicle operated by an occupant of the dwelling unit under which the application is made. Contractors parking vehicles on metered streets within a daytime parking permit area shall, in addition to the contractor parking permit, secure meter hoods from the Lancaster Parking Authority or pay parking fees to park at meters.
C. 
Any and all fees required to be paid for the issuance of permits, renewal of permits, or transfer of permits as set forth in this Code or the rules and regulations promulgated hereunder may be changed from time to time by resolution of the City Council.
D. 
Contractors who regularly work in the City of Lancaster may obtain an annual contractor parking permit, permitting them to park at a work site in any daytime parking permit area, subject to the completion of an annual application and the payment of an annual parking permit fee of $140 per contractor vehicle. Contractors parking vehicles on metered streets within a daytime parking permit area shall, in addition to the contractor parking permit, secure meter hoods from the Lancaster Parking Authority or pay parking fees to park at meters.
E. 
The parking restrictions imposed by this article shall not apply to any delivery vehicle when used to make deliveries to residences within a daytime parking permit area, provided that the parking of the service or delivery vehicle within the daytime parking permit area does not exceed four hours in duration on any given day. The parking of any such vehicle within the daytime parking permit area for more than four hours on any given day will require an application for a contractor parking permit.

A. 
The Traffic Commission be and hereby is authorized to establish market area parking permits for market stand holders, residents and commercial property users for periodic and temporary parking on the following streets:
(1) 
North Market Street from West King Street to West Grant Street, provided, however, that no permits shall be issued for parking on those streets during hours of operation of the Central Market (which hours, as designated from time to time by the Traffic Commission, may include time before and after the Market opens for purposes of loading, unloading and other associated operational issues, and all such hours of parking prohibition shall be posted with appropriate signage);
(2) 
West Grant Street;
(3) 
William Henry Place; and
(4) 
Penn Way, provided that no such permits shall be issued to allow parking on Penn Way during hours of operation of the Central Market (which hours, as designated from time to time by the Traffic Commission, may include time before and after the Market opens for purposes of loading, unloading and other associated operational issues, and all such hours of parking prohibition shall be posted with appropriate signage).
B. 
The provisions of §§ 285-41, 285-46 and 285-55 through 285-56.1 are incorporated herein and applied to the issuance of market area parking permits.
C. 
Any vehicle which is illegally parked in the areas covered by this section regulating market area parking permits may be removed from that area by towing and may be reclaimed by the vehicle owner upon payment of the towing costs.
A. 
If metered parking is in effect when a residential district is designated as a daytime parking permit area, or if after a residential district has been designated a daytime parking permit area, all or a portion of such residential district is designated a parking meter zone, then the provisions of Article IV of Chapter 285 of the Code of the City of Lancaster shall apply to the parking meter zone, except that the holders of parking permits for that daytime parking permit area are exempt from complying with § 285-30, Deposit of coins, tokens or payment; § 285-32, Overtime parking, and § 285-33, Extending legal parking time, of Article IV of Chapter 285 of the Code of the City of Lancaster.
B. 
The daytime permit parking requirements and nighttime permit parking requirements set forth in this Chapter 285 shall not apply to owners or operators of motorcycles or scooters. Notwithstanding the foregoing, motorcycles and scooters parking in metered spots within a daytime or nighttime parking area must pay the meter fees associated with parking in such metered spots unless they have obtained and are displaying a residential parking permit.
The Mayor is authorized to establish and promulgate rules and regulations necessary to implement and enforce the provisions of this article, which shall become effective upon posting of the same by the Mayor with the City Clerk. Prior to promulgating any such rules and regulations, the Mayor shall solicit input on the same from the Traffic Commission. Once promulgated by the Mayor, the rules and regulations shall be adopted by the Traffic Commission and provided to the City Council. The City Council need not read such rules and regulations at the official meeting at which they are delivered.
A. 
Any person violating any provision of this article or the rules and regulations promulgated hereunder shall, upon conviction thereof in a summary proceeding, be fined not less than $25 nor more than $50 for each violation and, in default of any fine so imposed, shall be imprisoned for a period not to exceed 10 days for each violation. Any person submitting false information to the Administrator or the City for any purpose under this article shall, upon conviction thereof in a summary proceeding, be fined not less than $200 nor more than $1,000 for each violation and, in default of any fine so imposed, shall be imprisoned for a period not to exceed 10 days for each violation.
B. 
In addition to violation of any of the provisions of this article or the rules and regulations promulgated hereunder, the following constitute violations of this article. The following are specifically deemed to be violations of this article and subject to the penalties and fines set forth above:
(1) 
The duplication or attempt to duplicate or alter or attempt to alter, by any means, by any person or entity, a residential parking permit authorized by this article.
(2) 
Any person or entity displaying on any vehicle such a duplicate parking permit or an altered parking permit.
Should any person feel aggrieved by an action of the Administrator, he or she may file an appeal to the Traffic Commission in writing. The Traffic Commission shall hear any and all such appeals at a meeting to be held within 90 days of the filing of the appeal. All appeals to the Commission from the decisions, orders or actions of the Administrator shall be filed with the Administrator within 10 days of the date of the decision, order or action complained of. The appeal shall be in writing, shall specify the grounds therefor and the relief requested and shall be accompanied by an appeal fee of $10.[1] Written notice of the date the Commission will hold a hearing on the appeal shall be provided to the appellant at least 15 days prior to the date of such hearing. In all cases, the Commission shall have the authority to change, modify or rescind any decision, order or action of the Administrator or to extend the time for compliance.
