No tree, shrubbery, or other growth shall hereafter be planted, public utility pole erected or relocated within the street line and no step, cellar door, railing, areaway, post, pipe, guard, light, porch, awning, stand, sign, tank, pump, merchandise, or other objects shall be constructed or placed within or permitted to encroach over or into the street limits of any street in Hemlock Township unless the permission of the Board of Supervisors shall have been received. Such permission may be granted upon written application on a form or forms provided by the Township.

All owners of property abutting on the streets of the Township shall, upon receipt of 60 days' notice, in writing, from the Code Enforcement Officer thereof, repair, trim, cut down, and/or remove any or all trees, shrubbery, or other growth, steps, cellar doors, railings, area-ways, posts, pipes, guards, lights, porches, awnings, stands, signs, tanks, pumps, merchandise, or other objects, growing or located within the street line or encroaching over the street lines, and upon failure to do so, the same shall be done by the Township authorities and the costs thereof shall be collected from the property owner or owners by legal action, if necessary, or by the entry of a municipal lien.

The ground between the property lines and sidewalk lines and between the sidewalk lines and curbs in front of or alongside of all properties abutting on the streets of Hemlock Township shall be well-graded and sodded.

Every owner of property in Hemlock Township shall, on 60 days' notice from the Township Supervisors, construct or reconstruct sidewalks or curbs in front of or alongside of such property, which shall conform to all pertinent requirements of this Part and to all pertinent requirements of any ordinance or ordinances providing for the laying out and improving of said streets.

Every owner of property in Hemlock Township, on 60 days' notice from the Township Supervisors, shall repair the sidewalks or curbs, in the manner stipulated in such notice, in front of or alongside such property.

Sidewalks shall be at least four feet in width; shall be constructed of reinforced concrete at least four inches in depth; and shall be laid on at least four inches of compacted gravel or stone. Sidewalks shall be scored in five-foot blocks with expansion joints generally every 20 feet, or as otherwise appropriate. All work shall comply with the Americans with Disabilities Act (ADA). Where driveways cross over sidewalks, sidewalks shall be a minimum of six inches in depth with welded wire fabric reinforcement. Pre-cast concrete sidewalks may also be approved for use by the Township.

All curbs constructed in front of or alongside of any property abutting on the streets in Hemlock Township shall be seven inches in thickness at the top with the street face uniformly battered or beveled so that the curbs shall be nine inches in thickness at a point eight inches below the tops of the curbs. A uniform thickness of nine inches shall be maintained from a point eight inches from the top to the sewer depth of the curb, total depth of the curb to be 18 inches. All curb ramps shall comply with the ADA standards.

All sidewalks and all curbs shall be constructed, reconstructed, and repaired of Class A concrete, PennDOT specifications, unless prior approval of a substitute material is approved by the Board of Supervisors.

In all cases where sidewalks are constructed, reconstructed, or repaired over cellars or other excavations under the sidewalks, such sidewalks shall be supported by steel beams or girders of steel or concrete arches. Before said construction shall be commenced, the plans therefor may be submitted to and approved by the Township Engineer. In no case shall any waste material or other perishable material be used.

All sidewalks and all curbs shall be constructed, reconstructed, and repaired and the grading thereof shall be in accordance with the line or grade fixed by this Part or ordinances laying out the street upon which said construction, reconstruction, or repair is to be performed, and the grade thereof shall be obtained by the property owner from the Township Roadmaster. Upon notice, as provided in §§ 21-304 and 21-305 above, as the case may be, such work of construction or reconstruction or repairs shall be done by the owner or owners of such properly or properties.

The Township Engineer, the Township Roadmaster, and the Code Enforcement Officer may determine and report to the Board of Supervisors in the case of an individual property, whether or not the sidewalk or curb shall be constructed, reconstructed, or repaired and, if so, the specific part or parts thereof to be reconstructed or repaired.

The Township Engineer or the Code Enforcement Officer or the Township Roadmaster may at any time during the construction, reconstruction, or repairing of any sidewalk or curb, visit the site of such work to ascertain whether the same is being done according to requirement. They likewise shall visit such site for such purposes whenever requested by the property owner.

Within 30 days after the completion of the work of construction, reconstruction, or repair of any sidewalk, it shall be the duty of the owner of any property where such work is done, to notify the Zoning Officer of that fact, so that inspection can be made to determine whether the grade thereof has been observed and followed.

Any property owner, upon his/her own initiation and without notice from any Township official, may construct, reconstruct, or repair a sidewalk or curb in front of or alongside his/her property; provided, that such owner shall first make application to the Zoning Officer, which construction, reconstruction, or repair shall conform with the requirements of this Part and this ordinance providing for the opening, laying out, and improvement of the street, as to line and grade and as to material used and he/she shall also notify the Zoning Officer, as required by § 21-312, within 30 days after completion of the work.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

Removal of Snow and Ice from Sidewalks Required. The owner, occupant, or tenant of every property fronting upon or alongside of any of the streets in Hemlock Township is hereby required to remove, or cause to be removed, from all the sidewalks in front of, or alongside of, such property all snow or ice thereon fallen or formed, within 12 hours after the same shall have ceased to fall or to be formed. Provided, that snow or ice that has ceased to fall or to be formed after 6:00 p.m. may be removed at any time before 12:00 p.m. the next day. Snow or ice which is removed may not be deposited in the roadway of any street, alley, or other public sidewalk of the Township. Provided, further, that the owner of a property shall be responsible for conforming to the requirements of this section.

Township May Remove Snow and Ice and Collect Costs and Additional Amount. In any case where the owner, occupant, or tenant, as aforesaid, shall fail, neglect, or refuse to comply with any of the provisions of this section within the time limit prescribed therein, the Township authorities may, but shall not be required to, proceed immediately to dear all snow and/or ice from the sidewalk of such delinquent premises and to collect the expenses thereof, together with an additional amount equal to 25% of such expense, from the owner of the property, which amounts may be in addition to any fine or penalty imposed under Subsection 3 hereof.
3. 
Penalties. Any person, firm, or corporation who shall violate any provision of this section, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and in default of payment of said fine and cost, to a term of imprisonment not to exceed 30 days. Each day that a violation of this section continues or each section of this Part which shall be found to have been violated shall constitute a separate offense. Provided, such fine and costs and/or imprisonment may be in addition to any expenses imposed as provided in Subsection 2.
