Where uncertainty exists with respect to the boundaries of any
zoning district, as shown on the Zoning Map, the following rules shall
apply:
A. Where district boundaries are indicated as approximately following
the center lines of streets, highway, streams or railroads, such center
lines shall be construed to be such boundaries.
B. Where district boundary lines are indicated as following or approximately
following plotted lot lines or other property lines as shown on the
Town of Walton Tax Map, such lot lines shall be construed boundaries.
C. Where district boundary lines are shown separated from and parallel or approximately parallel to any of the features listed in Subsections
A and
B above, such boundary lines shall be construed to be parallel to such features and at such distance therefrom as shown on the map. If no distance is given, such dimension shall be determined by the use of the scale shown on the Zoning Map.
D. Where a district boundary line divides a lot of record at the effective
date of this chapter or any subsequent amendments thereto, the regulations
for the less restricted part shall extend not more than 50 feet into
the more restricted part, provided the lot has frontage on a street
in the less restricted district.
In case of uncertainty as to the true location of a zoning district
boundary line in a particular instance, the Code Enforcement Officer
shall request the Zoning Board of Appeals to render a determination.
