The City hereby establishes a Government Energy Aggregation
Program in accordance with the provisions of the Government Energy
Aggregation Act, N.J.S.A. 48:3-93.1 et seq.
The City will utilize Concord Engineering's dba Concord
Energy Services, who is an approved online purchasing agent with the
Department of Community Affairs Local Unit Electronic Procurement
Act, P.L. 2018, c. 156, for both online receipt of bids and online reverse auctions.
Concord's Online Bidding Platform complies with the new rules
at N.J.A.C. 5:34-5.1 through 5:34-5.15 which establish the regulatory
framework for electronic procurement. The online bidding platform
reverse energy auction will seek bids from licensed and appropriate
third-party suppliers. If such winning bid is selected and agreement
executed, individual residential consumers would retain the option
not to participate and to choose any alternatives they desire.
The Mayor or his designee is authorized to execute any documents
that are necessary to carry out the purpose of this chapter, which
includes the execution of a Local Distribution Aggregation Agreement
with PSE&G.
The City shall act as lead agency of the Hoboken Renewable Energy
Program and will solicit proposals for energy aggregation services
on behalf of City's residents and businesses and authorizes the
Mayor or his designee to take the steps required to enter into a contract
for said services, provided that the lowest responsive bid is below
the prevailing price for utility provided basic generation ion service.
The Mayor or his designee is authorized to take the steps required
to execute a master performance agreement with the participants in
the Hoboken Renewable Energy Program to purchase electricity and/or
natural gas at terms and conditions stated therein with a third-party
supplier who has been awarded a contract by the lead agency on behalf
of participating members of the Hoboken Renewable Energy Program,
and provided that such contract shall be at prices reasonably forecast
and estimated by the City to provide savings to participants relative
to the price charged for basic generation service by PSE&G.
