The purpose of this article is to protect the residents of the
Town of Galena from unnecessary dangers to life or property from fire
or explosions by establishing rules and regulations governing conditions
deemed by the Mayor and Council to be fire hazards within the limits
of the Town.
As used in this article, the following terms shall have the
meanings indicated:
AUTOMOTIVE SERVICE STATION
That portion of a property where flammable liquids used as
motor fuels are stored and dispensed from fixed equipment into the
fuel tanks of motor vehicles.
BULK PLANT
That portion of a property where flammable liquids are received
by tank vessel, pipe line, tank car, or tank vehicle and are stored
or blended in bulk for the purpose of distributing such liquids by
tank vessel, pipe line, tank car, tank vehicles, or container.
On or after the effective date of this article, no new bulk
plant or addition to existing bulk plant shall be constructed within
the corporate limits of the Town of Galena.
Nothing in this article shall be construed to prohibit the erection
of automotive service within the Town.

The following burning regulations shall be followed by any and
all persons within the Town of Galena:
A. An adult, age 21 or over, shall be in attendance, in the immediate
area of the fire during the entire duration of the fire.
B. The area of the fire shall be at least 25 feet from any building
or other structure and not at a distance of less than 15 feet from
any fence. An area not less than 10 feet must be cleared around the
perimeter of the fire area.
C. All of the following rules shall govern when burning is allowed:
(1) Burning may only occur between 4:00 p.m. and sunset.
(2) Burning may only occur when winds are below 10 m.p.h.
(3) Under no circumstances may a structure be burned without obtaining
permission for controlled burning and prior to inspection by the Fire
Chief of the Galena Volunteer Fire Company or such other person designated
by the Mayor and Council of Galena, and provided that ample members
of the Galena Volunteer Fire Company or other such designated persons
are in attendance to control the burning.
D. There shall be no open burning in the Town of Galena except adherent
to the regulations set forth in this article. Absolutely no garbage
may be burned at any time, and open burning fires must be extinguished
by sunset.
E. If the burning of the fire or smoke becomes offensive or dangerous
to the surrounding property owners, the officials of Galena or their
designees shall have the authority to have the fire extinguished without
interference. Intentional restart of the fire shall be considered
a violation of this article.
F. These regulations are intended to be in addition to, and not in lieu
of, any applicable state or county regulations for open burning, including,
but not limited to, permitting requirements of the Maryland Department
of Health, which are incorporated herein by reference.
A violation of any of the provisions of this article shall be
deemed a municipal infraction and shall be punishable by a fine of
$250 for a first offense and a fine of $500 for any subsequent offense.
Each day's violation shall constitute a separate offense.
