A street openings, paving and occupancy, driveways permit application must be completed any time a new residential or commercial driveway is constructed or an existing residential or commercial driveway is paved. Construction of any sidewalk, drainage facility, piping, parking lots, conduits or electric poles upon or in a Township road or right-of-way requires a street openings, paving and occupancy, driveways permit application.

No driveway or street, sidewalk or drainage facility shall hereafter be constructed upon any Township road, nor shall any gas pipe, water pipe, electric conduits or other piping be laid upon or in, nor shall any telephone, telegraph, or electric light or power poles, or any coal tipples or any other obstructions be erected upon or in any portion of a Township road except under such conditions, restrictions and regulations relating to the installation and maintenance thereof as may be prescribed or granted by the Township for such purpose.

Application for a permit shall be on a form prescribed and provided by the Township.[1] The application shall be accompanied by a fee, in accordance with the fee set forth by the Gregg Township Schedule of Fees, for driveway occupancy permits and restoration charges. In addition, the applicant shall submit the permit application showing such revisions as the location of the intended facility, the width of the traveled roadway, right-of-way lines and the dimensions to the nearest intersecting street.

The Township may alter plans filed with an application and specify changes or modifications of any kind which it may deem necessary to make its approval of the granting of any permit subject to any alterations, changes or modifications.

Prior to issuance of the permit, the applicant or designated representative shall meet, at the site of the proposed improvement, with the Gregg Township Roadmaster or designated representative to review details of the plan.

Issuance of a permit to the applicant shall be after all of the aforementioned requirements have been filed.

Building, construction, installation and erection shall be in strict compliance with the plans and specifications on the basis of which the permit is granted.

Upon completion of the work, the applicant shall provide written notice thereof to the Township.

Upon completion of the work authorized by the permit, the Township shall inspect the work and, when necessary, enforce compliance with the conditions, restrictions and regulations prescribed by the permit. Where any settlement or defect in the work occurs, if the applicant shall fail to rectify any such settlement or other defect within 60 days after written notice from the Township to do so, the Township may do the work and shall impose upon the applicant the cost thereof.

Any person, firm, corporation or utility which shall violate any of the provisions of this Part or any of the terms or conditions of the permit issued pursuant thereto, including any regulations applicable thereto, shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and costs of prosecution and, in default of such payment of fine and costs, to imprisonment for not more than 30 days. Each day's continuance of a violation shall constitute a separate offense.

Design standards of occupancy shall be in conformance with Gregg Township Street Standards Ordinance 10-90-1, 10/1/1990, Class B Roads-Private Road, Private Driveway Access Easement (not to be offered for dedication to the Township) [Part 1 of this chapter].
