It shall be unlawful for any person and/or vendor to solicit
and make sales from a stand without first having procured a license
from the Board of Health.
A person, corporation or organization shall apply for said license with the Secretary of the Board of Health upon forms approved and provided by the Board of Health. The fee for said license shall be as set forth in §
479-3, which fees are set on an annual basis.
Application for and issuance of the permits and licenses referred to in §
483-25 shall be made in conformity with the provisions of N.J.A.C. 8:24-1 et seq., as adopted or amended by the Board of Health of the Borough of Edgewater. Such permits and licenses are not transferable.
The license issued by the Secretary of the Board of Health shall
be permanently and prominently exhibited.
Licenses issued under authority of this article may be suspended,
revoked or reinstated by the Board of Health of the Borough of Edgewater
pursuant to the provisions of N.J.A.C. 8:24-1 et seq., as adopted
or amended by the Board of Health.
Any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be punished as set forth in Chapter
450, Article
II, General Penalty.
If any provision or portion of this article is held to be unconstitutional,
preempted by federal or state law, or otherwise invalid by any court
of competent jurisdiction, the remaining provisions of the article
shall not be invalidated and shall remain in full force and effect.
This article shall take effect immediately upon final passage
and publication as provided by law.
All ordinances or parts of ordinances which are inconsistent
with the provisions of this article are hereby repealed to the extent
of such inconsistency.
