There is hereby adopted by the City of Buckner for the purpose of prescribing regulations governing construction of building, that certain codes known as the International Building Code, 2003 Edition, as published by the International Code Council, copies of which are filed in the office of the City Building Inspector for the City of Buckner, Missouri, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which the ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Buckner, Missouri.

A. 
The following Sections of the 2003 International Building Code and related Codes are modified or amended in the following respects:
1. 
Permits Required. Except as specified in Subsection (2) of this Section, no building or structure regulated by this Chapter shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained from the Building Department under the supervision of the Building Official.
2. 
Work Exempt From Permit. A building permit shall not be required for the following:
a. 
One-story detached accessory buildings used as tool and storage sheds, playhouses and similar uses, provided the projected roof area does not exceed four hundred (400) square feet.
b. 
Movable cases, counters and partitions not over five (5) feet nine (9) inches high.
c. 
Painting, papering and similar finish work.
d. 
Temporary motion picture, television and theater stage sets and scenery.
e. 
Window awnings supported by an exterior wall of Group R, Division 3 and Group U Occupancies when projecting not more than fifty-four (54) inches.

The International Building Code, 2003 Edition, shall be enforced by the Building Department under the supervision of a Building Official who shall be appointed by the Board of Aldermen on the basis of examination to determine his/her qualifications.

A. 
Building permit fees for the Building Code adopted by the City of Buckner shall be determined using Tables 1 and 2 as defined in Section 500.040(C) following.
B. 
The determination of square footage under any of the provisions of this code shall be made by the Building Official.
C. 
Building permits shall be required for all decks, reroofing and siding. Fees for inspection and other services are as follows:

Definition.
ALTERATION
The reconfiguration of any space, the addition or elimination of any door or window, the reconfiguration or extension of any system, or the installation of any additional equipment.
E. 
Occupancy load shall be determined according to the International Building Code. Cubic foot is determined by volume under roof.
F. 
Component or modular buildings inspections are to be treated no differently than other buildings.
G. 
None of the above requirements shall negate the requirements for electrical, mechanical or other specialized certification, as needed. None of the above negates the requirements for building inspection(s).
H. 
Where any professional seal is required for a building permit, every page of the construction plan must bear a professional seal, with original signature and date, certifying professional responsibility for every aspect of the project. Referenced serial drawings do not require a seal. The professional seal must be provided by a architectural engineer registered in the State of Missouri. The professional seal on a document certifies that the architect/engineer has exercised his/her direction, guidance and judgment on all issues pertaining to health, safety and general welfare of the public and accepts legal responsibility for all matters embodies in the document.
I. 
Utility Fees.

Utility fees to be paid at time of issuance of building permit. The entire water and sewer tap fee to be forwarded to the City of Buckner.

The Public Works Department will perform water and sewer tap inspections.

A. 
Any person who shall violate any of the provisions of this code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Board of Aldermen of the City of Buckner or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and non-compliance, respectively, be guilty of an ordinance violation, punishable by a fine of not more than five hundred dollars ($500.00), or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment. The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense.
B. 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.

A. 
The City Clerk is hereby designated the Codes Administrator for the City of Buckner, Missouri. The City Clerk shall also serve as the Building Official of the City, and in addition to having oversight of all building activity, he/she shall verify that site development plans and building permit applications meet the zoning requirements of the City for the Planning and Zoning Commission, as per Chapter 402.
B. 
The City Clerk and the organization or person(s) designated by the Board of Aldermen to make inspection shall have the duty and authority to enforce the Building Code of the City, as well as other duties given administratively or by ordinance.

The Building Official or the organization or person(s) designated by the Board of Aldermen to make inspection must be well informed on the International Building Code, 2003 Edition; International Fire Code, 2003 Edition; International Residential Code, 2003 Edition; Life Safety Code, 2003 Edition; National Electrical Code, 2005 Edition; Uniform Plumbing Code, 2003 Edition; Uniform Mechanical Code, 2003 Edition; American Public Works Association (APWA), latest edition; Standard Specifications and Design Criteria, as adopted by the City of Buckner, and have an intelligent and constructive knowledge of the intent and literal interpretation of the provisions thereof.
