A. 
A violation of this chapter is an offense, and, except for a violation of § 165-39 (Short-Term Rental Regulations) of this chapter, is punishable as provided in Chapter 1, General Provisions, Article III. However, for the purpose of conferring jurisdiction upon courts and judicial officers generally, violations of this chapter shall be deemed violations, and for such purpose only, all provisions of law relating to violations shall apply to such violations. Each day's continued violation shall constitute a separate additional violation.

B. 
A violation of Section 165-39 (Short-Term Rental Regulations) is an offense and is punishable as follows:

(1) 
For a first violation, by a fine of $500.
(2) 
For a second violation pertaining to the same short-term rental permit that is committed within 60 days of the first violation, by a fine of $1,000.
(3) 
For a third or subsequent violation pertaining to the same short-term rental permit, all of which occur within a period of 60 days of the first violation, by a fine of $1,500 for each of such third or subsequent violations.
(4) 
Each day's continued violation shall constitute a separate, additional violation.

C. 
The Code Enforcement Officer and Deputy Code Enforcement Officer of the Town of Geneva are hereby authorized and empowered to enforce the laws and ordinances of the Town of Geneva and are further hereby authorized to issue appearance tickets pursuant to § 150.20 of the Criminal Procedure Law.
D. 
The Town may maintain an action or proceeding in a court of competent jurisdiction to compel compliance with or to restrain by injunction any violation of this chapter.
