Any person violating any provisions of any rule, regulation
or order regulating the parking of motor vehicles made by anybody
authorized to make the same shall be punished as provided in MGL c.
90, § 20a 1/2 or any acts in amendment thereof, or in addition
thereto, and any person violating any of the rules and regulations
applicable to State Highways made by the Department under authority
of MGL c. 85, § 2, and acts in amendment thereof, and in
addition thereto, shall be subject to the penalty provided in said
rules and regulations.
A. Any person convicted of a violation of any other rule, regulation
or order made hereunder, except as may be otherwise provided here-in
or by Massachusetts General Law, shall be punished by a fine of not
more than $50 for the first offense, $75 for the second offense, and
$150 for the third or subsequent offense.
B. Any person violating any rule, regulation or order made hereunder
regulating the parking of motor vehicles shall be punished pursuant
to the authority granted by Chapter 90, Section 20a 1/2 of the Massachusetts
General Laws.
(1)
Group A: $100.
(b)
Blocking wheelchair ramp.
(2)
Group B: $50.
(a)
Within 10 feet of a hydrant.
(3)
Group C: $25.
(a)
Interfering with snow removal.
(b)
Less than 10 feet unobstructed lane.
(c)
Upon a crosswalk or sidewalk.
(d)
On roadway in a rural district.
(f)
Over 12 inches from curb.
(g)
Across private road or driveway.
(h)
Within 20 feet of intersection.
(n)
Within a loading/unloading zone.
(q)
Within 15 feet of a fire station or directly across the street
if posted.
(r)
Obstructing traffic along side or opposite any street excavation
or obstruction.
(s)
Within 25 feet of the nearest rail of a railroad crossing or
within five feet from the gate.
(t)
On a bridge and the approach thereto.
If any section, subsection, sentence, clause or phrase of these
Rules and Orders is for any reason unconstitutional, such decisions
shall not affect the validity of the remaining portion of these Rules
and Orders. The Board of Selectmen hereby declares that it would have
passed these regulations and each section, subsection, sentence, clause
or phrase thereof irrespective of the fact that any one of more sections,
subsection, sentence, clauses or phrases be declared unconstitutional.
If any vehicle is found upon any street or highway in violation
of any provisions of these rules and regulations and the identity
of the driver cannot be determined, the owner or the person in whose
name such a vehicle is registered shall be held prima facie responsible
for such violations.
