As used in this Chapter, the following terms shall have the
meanings indicated:
FENCE
A barrier, railing or other upright structure, typically
of wood or wire, enclosing an area of ground to mark a boundary, control
access or prevent escape.
PRIVATE PROPERTY
A legal designation for the ownership of property by non-governmental
legal entities.
RIGHT-OF-WAY
The legal right, established by usage or grant, to pass along
a specific route through grounds or property belonging to another.

A. Fences
shall be located only on private property built with the consent of
the property owner.
B. Fences
in front yards cannot exceed seventy-two (72) inches in height.
C. Fences
in front yards over forty-eight (48) inches can only be chain link
to not obstruct view.
D. Fences
shall be located five (5) feet from street or public right-of-way.
E. No
fence shall be located within a sight triangle.
F. In
the case of fences constructed over dedicated utility easements, a
gate shall be installed on each end of the width of the easement.
The City shall not be responsible for replacement if the fence is
removed for maintenance purposes.
G. Fences
shall not be located in a platted drainage easement.
H. Fence
height cannot exceed eight (8) feet above grade.
I. Finished
surfaces shall face outward from the property (when fronting public
right-of-way).
J. Fences
shall be maintained in a safe manner at all times.
K. This
Chapter is passed notwithstanding the fact that there are currently
fences in existence at properties which they will be allowed to keep.
L. It
is provided, however, that existing fences shall not be expanded.

A fence permit application shall be approved by the City before
installation begins.

Any person, firm or corporation who violates any provision of
this Chapter shall, upon conviction, be punished by a fine not less
than seventy-five dollars ($75.00) and not more than two hundred twenty-five
dollars ($225.00) for each day in which the violation occurs.
