As used in this article, the following terms shall have the meanings
indicated, unless a different meaning clearly appears from the context:
AGENCY
Any association, group, society, union or otherwise like
organization managing or coordinating more than one busker, group
performers and/or performer.
BOROUGH
The Borough of Millvale, Allegheny County, Pennsylvania.
BOROUGH COUNCIL
The Borough Council of the Borough of Millvale, Allegheny
County, Pennsylvania.
BOROUGH MANAGER
The Borough Manager of the Borough of Millvale, Allegheny
County, Pennsylvania, or his or her designee.
BUSINESS OWNER
Individual, including an employee or agent of a group of
individuals, partnership, or corporation who is a tenant in or who
owns property abutting public grounds.
BUSKER
A person or group of persons who plays music or performs
entertainment usually while soliciting for voluntary money donations
during a street performance and has obtained a permit pursuant to
this article. Definitions of "busker" and "performer" are the same
and shall be interchangeable specific to this article.
BUSKING
The act or actions of a busker and performer while soliciting
for voluntary money donations during a street performance.
DISTANCE
All measured distances and distance requirements addressed
in this regulation shall be distances measured in a straight line
from nearest edge to nearest edge of the building, object or public
ground from which the performance is to be distant.
GROUP PERFORMERS
More than one busker and/or performer, performing together
as a group.
OBSTRUCT and/or OBSTRUCTION
To so occupy the public grounds so that the free use and
enjoyment thereof by pedestrians is in any way interrupted or interfered
with, or such that the free ingress and egress to or from any building
fronting on any public ground is impaired.
PEDESTRIAN
Person who is walking or otherwise traveling in/on the public
grounds.
PERFORM and/or PERFORMANCE
Audible or visual entertainment such as, but not limited
to, the following activities: acting, singing, playing musical instruments,
miming pantomime, juggling, magic, dancing, reading, puppetry, sidewalk
art (working with nonpermanent, water-soluble media, i.e., chalk,
pastels, or watercolors directly on the pavement), reciting or performing
a theatrical or literary work. Performer and/or performance shall
not include the production of or the offer of items for sale at the
location of the performance.
PERFORMER
A person or group of persons who plays music or performs
entertainment usually while soliciting for voluntary money donations
during a street performance and has obtained a permit pursuant to
this article. Definitions of "busker" and "performer" are the same
and shall be interchangeable specific to this article.
PERMIT/GROUP PERMIT
The form issued by the issuing authority evidencing that
the busker, group performers and/or performer are allowed to perform
on/in the public grounds.
PUBLIC GROUNDS
Public sidewalks, parks, playgrounds, trails, paths, recreational
areas, publicly owned or operated scenic and historic sites and other
pedestrian areas within the Borough of Millvale. Public grounds also
include sites for schools, sewage treatment, refuse disposal and other
publicly owned or operated facilities. For the purpose of this article
only, schools, sewage treatment, refuse disposal facilities, other
publicly owned and operated facilities (recognized by Borough of Millvale
Council) will not be recognized as public grounds for performances.
Default definition of public grounds and public rights-of-way are
delineated through the Pennsylvania Municipalities Planning Code.
RESIDENT
Person who resides in the Borough of Millvale and pays property
or EIT tax. A resident can also rent property in the Borough but must
show proof of utility payment at a Borough of Millvale address.
SIGN or SANDWICH BOARD
Any portable sign used to convey information of a commercial nature. Size of sign shall not exceed 24 inches by 24 inches. Additional sign definitions can be found in the Borough of Millvale Code, Part II: General Legislation, Chapter

SPECIAL EVENT
Any occasion officially recognized by the Borough of Millvale
Council, including, but not limited to, fairs, shows, exhibitions,
Borough-wide celebrations, festivals and other similar events, within
a specifically defined area of the Borough for a specified period
of time.
