[HISTORY: Adopted by the Borough Council of the Borough of Wyalusing 12-19-2005 as Ch. 16 of the 2005 Code. Amendments noted where applicable.]
The Borough Council, being the municipal authorities of the Borough of Wyalusing hereby signify their intention and desire to organize an authority under the provisions of the Municipal Authorities Act of 1945, as amended.[1]

The President of the Borough Council, Mayor and Secretary of the Borough are hereby authorized and directed to execute on behalf of the Borough of Wyalusing Articles of Incorporation for said authority, providing, among other things:
A. 
The name of the authority shall be "Wyalusing Municipal Authority."
B. 
The authority is founded under the Act of May 2, 1945, P.L. 382, as amended, known as the Municipal Authorities Act of 1945.[1]

C. 
No other authority has been organized under said Act of June 28, 1935, P.L. 463, and is in existence in or for the incorporating municipality.
D. 
The name of the incorporating municipality is the Borough of Wyalusing; and the names and addresses of the municipal officers constituting the municipal authorities of said municipality are: [here followed the names and address of the municipal officers constituting the municipal authorities of the said municipality]. At the time of the passage of this chapter, the Office of Burgess was vacant but he would be included in this matter and as soon as someone is active in the office.
E. 
The names and addresses and the terms of office of the first members of the Board of [the] Authorities are as follows: [Here followed the names and addresses and terms of office of the first members of the Board of Authorities].
F. 
The terms of existence of said Wyalusing Municipal Authority shall be for a period ending December 31, 2033.
The said [here followed the names of the first members appointed to the Board of Authority], are hereby appointed by the Borough of Wyalusing for terms of office expiring one year, two years, three years, four years, and five years, respectively, from January 1, 1952.
The proper officers of the Borough are hereby directed, as required by the Municipal Authorities Act of 1945,[1] to publish notice of this chapter and of the day upon which said Articles of Incorporation will be filed with the Secretary of the Commonwealth of Pennsylvania; to file said Articles of Incorporation, together with a certified copy of this chapter authorizing the incorporation of the Authority and the necessary proofs of publication, with the Secretary of the Commonwealth; and to do all other things necessary or appropriate to effect the incorporation of the Wyalusing Municipal Authority.

The project which shall first be undertaken by the authority shall be to acquire the sewer system currently in operation in the Borough of Wyalusing, whether it may belong to the said Borough or to said private sewer company; and to install the necessary interceptor lines, sewage treatment works and other facilities that will enable the sewage from the Borough of Wyalusing to meet the requirements set up by the Commonwealth of Pennsylvania for the dumping of the same in the streams of said commonwealth; and to lease said sewage disposal system and the treatment plant to the Borough of Wyalusing for operation for the benefit of the inhabitants thereof and of the area now served to be served.
