In all parks, playgrounds, pools and other City recreational facilities, no person shall:
A. 
Make or kindle an open fire except in picnic stoves provided for that purpose;
B. 
Discharge firearms which is hereby prohibited under authority of RSA 644:13 II(b) or throw stones or other harmful missiles;
C. 
Sell, or offer to solicit for sale, any goods or merchandise without a special permit;
D. 
Use, consume, carry or bring any alcoholic beverage, except that in connection with the leasing of Holman Stadium for purposes of the Holman Stadium Concert Series and instances of use of the stadium by a professional or semiprofessional sports team, allowance by written license revocable at the City's option may be made for the lessee to sell beer and/or wine to be consumed on the premises in accordance with polices established for the use of Holman Stadium from time to time, the laws of the state, the terms of said license, and in a controlled setting that has been approved in advance by the Nashua Police Department. There shall be a fee for said license to be comprised of a minimum flat amount, plus a percentage of the gross receipts from the sale of said alcoholic beverages, both as may be established in said license;
E. 
Play baseball except at diamonds expressly set aside for this activity;
F. 
Hold, conduct or address any public assemblage, meeting or gathering, or take part in any public debate or discussion, without first having obtained a written permit;
G. 
Give any entertainment or exhibition except under the direction, or by permission, of the Superintendent;
H. 
Operate any motorized vehicle, including but not limited to, cars, trucks, snowmobiles, minibikes or other powered bikes except in those areas so designated and only during the times so designated by the Superintendent;
I. 
Throw, leave or discard any trash, rubbish or garbage except in containers provided therefor;
J. 
Bring or allow any pet to be in any park or playground areas designated and marked by the Superintendent prohibiting pets;

K. 
Play golf in any park or playground except in areas designated and marked by the Superintendent for the playing of golf;
L. 
Remove or deface any tree, shrub or flower located in any park or playground;
M. 
Possess or use any metal detection device in any park or playground without the written authority of the Superintendent.
N. 
Bring a pet into the following fenced-in tot lots, except for a service animal as defined under the Americans with Disabilities Act:

(1) 
Shattuck Street;
(2) 
Belvedere (Bridge Street);
(3) 
Erion Field (Robinson Road);
(4) 
Jeff Morin Playground at Roby Park; and
(5) 
Any other tot lot that becomes fenced-in.

Except under the direction of or by permission of the Park Superintendent, no person may enter, remain, stay or loiter in or on the Deschenes Oval, Sandy Pond Park, Bicentennial Park or Monument Park between the hours of 9:00 p.m. and 6:00 a.m.; no person may enter, remain, stay or loiter in Sunset Heights Park, Salem Street Park, Salem Street Tot Lot, Field’s Grove Park, Shattuck Street Park or Belvedere Park between the hours of dusk and 6 a.m.; and no person may enter, remain, stay or loiter in any other city park between the hours of 10 p.m. and 6:00 a.m.

All existing external amplification devices to be used are not expected to change in status, condition, or place as affixed to the bandshell in its current configuration and allows for effects and audio monitor. No portable amplification devices and speakers are permitted until such time as the unfinished bandshell is completed.

A. 
The following parks and recreation fees shall apply:
(1) 
Greeley Park, gazebo: $25.
(2) 
Greeley Park, public garden plot: $30 per year.
(3) 
Greeley Park, bandstand (non-Summerfun events): $375.
(4) 
Holman Stadium, day game: $300.
(5) 
Holman Stadium, night game: $400.
(6) 
Rectangular, baseball or softball field:
(a) 
No lights, non-Parks and Recreation-affiliated youth league: $40 for two hours.
(b) 
Lights, non-Parks and Recreation-affiliated youth league: $75 for two hours.
(c) 
No lights, nonresident: $50 for two hours.
(d) 
Lights, nonresident: $100 for two hours.
(e) 
No lights, adult league: $300 per team season.
(f) 
Lights, adult league: $500 per team season.
B. 
For purposes of this section, a "resident" is defined as one or more of the following:
(1) 
A voter registered in the City;
(2) 
A person who is domiciled in the City;
(3) 
A person who pays real estate taxes to the City; or
(4) 
A spouse or dependent of any of the above.
C. 
Fees shall not be charged for Parks and Recreation Department-affiliated uses, or use by the Nashua School District or other elementary and secondary schools located in Nashua.
D. 
The Board of Public Works may waive a parks and recreation fee upon a showing of hardship.
Any person violating the provisions of this article shall be subject to punishment as provided in § 1-12 of the City Code. Any snowmobile, minibike or other powered bike operated in lands and other recreational facilities under the jurisdiction of the City without permission may be impounded for a period of 30 days. All expenses, i.e., towing or transportation and storage, shall be paid by the owner of the vehicle prior to redemption, charges to be arrived at by the Chief of Police or his authorized agent.
