No plants or shrubbery of any kind may be planted in the cemeteries within the City unless prior written approval is obtained from the superintendent of the cemeteries. The superintendent of the cemeteries is hereby given the right to remove any plants or shrubbery now located in the cemeteries which he/she feels will detract from the beauty of the cemeteries.

All temporary grave markers which are placed at grave sites in the cemeteries shall be removed by the City within one (1) year.

The City shall have the right to remove any flower arrangement or wreath after they have become weather worn and no longer add to the beauty of the cemeteries.

All monuments and stones erected within any cemetery within the City must be set in concrete. The top of the base of each monument must be level with the ground and the top of the base must be at least four (4) inches larger than the bottom of the monument. All monuments which are erected in said cemeteries must be in line with other monuments in the cemetery and must comply with the setback lines located on the plat of the cemetery. Before any monuments can be erected in the cemeteries, the superintendent must give his/her approval as to the type and location thereof.

The cemeteries within the City shall be used to bury humans only and no dog or cat or other animals shall be buried therein.

The City shall not be responsible for any vandalism or destruction of any monuments or graves located in any cemetery within the City.

It shall be unlawful for any person to loiter about any portion of the cemeteries of the City during that part of any day from one-half (1/2) hour after sunset to one-half (1/2) hour before sunrise.

It shall be unlawful for any person to park any vehicle on any portion of the cemeteries of the City during that part of any day from one-half (1/2) hour after sunset until one-half (1/2) hour before sunrise.

Wooden vaults will be prohibited in any cemetery in the City of Malden, Missouri.

The cost of four hundred dollars ($400.00) per plot will be set for all cemetery plots, except those in Section 245.120, owned by the City of Malden, Missouri.

The cost for opening and closing of graves will be set at three hundred twenty-five dollars ($325.00) on weekdays and four hundred twenty-five dollars ($425.00) on weekends and all holidays observed by the City of Malden, Missouri.

A block of plots will be set aside for mausoleums, the location to be determined by Malden Properties Commissioner.

A. 
A block of plots will be set aside for infant burial whereby one-half (1/2) a grave may be used to bury an infant. The cost of the infant plot will be two hundred dollars ($200.00).
B. 
A block of plots for said purpose will be set aside in Macedonia and Rosewood First Addition Cemeteries.

A. 
No fence or structure of any kind shall be erected or maintained on or around any grave or plot within the cemeteries in the City of Malden.
B. 
Should a fence or structure be erected following the passage of this Section, it shall be removed by City personnel.
C. 
If a fence or structure is in place at the time of passage of this Section, it shall be up to the family of the deceased to arrange for maintenance of the grave or plot. If this is not done, the fence, rocks or structure will be removed so City personnel can maintain the grave or plot.

A. 
There is hereby created the Perpetual Care Cemetery Fund.
B. 
Generally.
1. 
All monies currently in the Cemetery Fund, including certificates of deposit or other investments, shall be credited to the Perpetual Care Cemetery Fund.
2. 
All monies derived from all future sales of cemetery plots in all City-owned cemeteries shall be credited and deposited to said fund.
C. 
Investments. The funds in the Perpetual Care Cemetery Fund shall be invested in local financial institutions so as to earn the highest return possible and all interest earned shall be credited to said fund and reinvested with all other funds.
D. 
Withdrawals.
1. 
No withdrawal of any funds from the Perpetual Care Cemetery Fund shall occur until the balance of said fund reaches four hundred thousand dollars ($400,000.00).
2. 
When the balance of the Perpetual Care Cemetery Fund reaches four hundred thousand dollars ($400,000.00), up to seventy-five percent (75%) of the interest earned annually may be withdrawn and used for the maintenance and upkeep of all City-owned cemeteries.
E. 
In October of each year all money in the Perpetual Care Cemetery Fund, with the exception of five dollars ($5.00) shall be placed in the Perpetual Care Cemetery Fund Certificate of Deposit.
