There shall be resident parking decals, which shall be issued only to owners of land improved for residential use in the Permit Zone described in §
173-35 hereinabove, or such owners' lawfully authorized designees, in the manner set forth in §
173-37 hereinbelow.
Resident permit. Upon application to the Pine Grove Police Department
on a form to be provided therefor, the owner of each residential dwelling
unit within the Permit Zone, or such owners' lawfully authorized designee,
shall be issued a maximum of two resident permit parking decals for
the use of the residents of the said dwelling unit of which he is
the owner, or lawfully authorized designee of such owner, and which
residents desire to park their vehicle at curbside within the Permit
Zone, in accordance with the following terms and conditions: The owner
of the dwelling unit, or his lawfully authorized designee, shall present
one valid proof of registration of one motor vehicle belonging to
a resident of the dwelling unit in order to be issued one resident
permit parking decal. The owner of the dwelling unit, or his lawfully
authorized designee, shall permit one valid proof of registration
of a second motor vehicle belonging to a resident of the dwelling
unit in order to be issued a second resident permit parking decal.
Any resident permit parking decals issued hereunder shall be used
only by the residents of a dwelling unit within the Permit Zone who
desire to park their motor vehicle(s) for which a permit parking decal
has been issued at curbside on the streets, alleys, or public ways
within the Permit Zone. In no event shall more than two resident permit
parking decals be issued per dwelling unit in the Permit Zone.
Upon application to the Pine Grove Police Department on a form to be provided therefor, the owner of each residential dwelling unit within the Permit Zone, or his lawfully authorized designee, shall be issued two guest parking decals. No more than two guest parking decals shall be issued per dwelling unit in the Permit Zone. Guest parking decals are intended for the use of guests of residents of the Permit Zone, which guests desire to park their motor vehicles at curbside on the streets, alleys, and public ways within the Permit Zone, for the duration of such guest's stay at residences in the Permit Zone. A motor vehicle properly displaying a parking decal in accordance with the provisions of §
173-39 hereinbelow shall be permitted to be parked in the resident permit parking areas in the Permit Zone, to the same extent as vehicles properly displaying a resident permit parking decal under this article. All guest parking decals shall be valid for the period as specified by the Pine Grove Borough Police, and in accordance with terms and conditions established by the Pine Grove Borough Police, but in no event shall a guest parking decal be valid for a period in excess of one year.
The resident permit parking decals and guest parking decals
issued pursuant to this article shall be affixed to the center (or
as near thereto as possible) of the motor vehicle's front windshield,
at the top thereof, or hung from the back of the motor vehicle's center
inside rear-view mirror, so that the decal so affixed or hung shall
be clearly visible through the front windshield from the outside of
the vehicle.
For the purposes of this article, the word "owner" shall mean any person who owns land improved for residential use within the Permit Zone described in §
173-35 above, whether or not such person resides upon said land.
Any person who violates any of the provisions of this article
shall, for each and every such violation, pay the sum of $15 to the
office of the Pine Grove Police Department within 15 days of the notice
of such violation. If within 15 days the sum of $15 is not paid, a
citation will be filed in the Office of the Magisterial District Judge,
and the violator, upon conviction of violation of this article, shall
be guilty of a summary offense and shall be sentenced to pay a fine
of $25, plus costs of prosecution, and in default thereof, shall undergo
imprisonment for not more than one day for each $10 of the balance
of the unpaid fine and costs.
Any person who falsifies, duplicates, forges, or alters any parking decals issued pursuant to this article, or who obtains a duplicate or replacement resident permit parking decal or guest parking decal pursuant to §
173-40 of this article under false pretenses, shall be subject to arrest and prosecution under applicable provisions of the Crimes Code of Pennsylvania.
