All appointments in the police, including the Chief of Police
or equivalent official, prior to the creation of a Commission, shall
continue to hold their positions and shall not be required to take
any examination under the provisions of this chapter, except that
which may be required for promotion, provided that this section shall
not be construed to apply to persons employed temporarily in emergency
cases.
Any member of the Borough Council who, by vote, causes to be
appointed any person to the police force contrary to the provisions
of this chapter, or any member of the Borough Council or member of
the Commission who willfully refuses to comply with, or conform to,
the provisions of this chapter, shall be deemed guilty of a summary
offense, and upon conviction, shall be sentenced to pay a fine not
exceeding $100, or suffer imprisonment not exceeding 90 days, or both.
"Police force" shall mean a police force organized and operating
as prescribed by law, the members of which devote their normal working
hours to police duty or duty in connection with the bureau, agencies
and services connected with police protection work, and who are paid
a stated salary or compensation for such work by the Borough. "Police
force," as used in this chapter, shall not include:
A. Any special police appointed by the Mayor to act in emergencies;
B. Any person appointed solely for parking meter enforcement duties;
C. Any special school police;
D. Any extra police serving from time to time or on an hourly or daily
basis; or
E. Any auxiliary policeman appointed under the Act of January 14, 1952
(P.L. 2016) who is paid a stated salary or compensation for such work
done by the Borough.
