The provisions of Ch. 125, Wis. Stats., relating to the sale of alcohol beverages, including subsequent revisions and amendments, inclusive of any provisions thereof relating to the penalty to be imposed or the punishment for violation of such statutes, are hereby adopted and made a part of this chapter by reference. A violation of any such provisions shall constitute a violation of this chapter.

Fees for licenses issued pursuant to this chapter are set from time to time by the Village Board by resolution. Current fees are on file with the Village Clerk.

A. 
Operator's license may be granted to individuals by the Village Board for the purpose of complying with §§ 125.32(2) and 125.68(2), Wis. Stats.
B. 
Applicants must obtain an application either from the Village Clerk or from the Village Website.
C. 
Once the application is completed, it will be returned to the Village Clerk. Applications with missing information will not be accepted. If the application is accepted, the applicant will pay $40 fee at this time.
D. 
The application will be forwarded to the Chief of Police for a background check. Once the background check is completed, the application will be returned to the Village Clerk to be acted upon at the next Village Board meeting.
E. 
If the application is approved by the Village Board, the applicant will be notified and issued a license from the Village Clerk.
F. 
If the Village Board does not approve the application, the Village Clerk will notify the applicant of the reason for denial and their options for appeal.
G. 
The appeal process shall begin with a hearing before the Protective Services Committee. The applicant will have the opportunity to present testimony and other evidence as to why the license should be granted.
H. 
The Protective Services Committee shall file its written recommendation to the Village Board with the Village Clerk, who will provide a copy to the applicant. The Village Clerk will place the recommendation on the next Village Board meeting agenda. If the application is denied on appeal, the Village Clerk will notify the applicant in writing of the decision. Any applicant who is denied a license on appeal may apply to the Circuit Court pursuant to § 125.12(2)(d), Wis. Stats., for review. If the applicant is approved on appeal, the Village Clerk shall issue a license to the applicant.

If the applicant is denied after all avenues for appeal have been exhausted, the applicant will be refunded $20 of the original application fee. The applicant will not be allowed to apply for an operator's license within 12 months of the date of the final decision on the application.
J. 
Operator's license shall be valid for up to two years and shall expire on June 30 of the second year of issuance.
K. 
A provisional operator's license may be issued by the Village Clerk in accordance with § 125.17(5), Wis. Stats., only to a person who has applied for an operator's license. A provisional license may not be issued to any person who has been denied a license by the Village Board. A provisional license expires 60 days after its issuance or when a regular operator's license is issued to the holder, whichever is sooner. The fee for a provisional operator's license shall be established as provided in § 128-2.

A. 
Premises. No initial or renewal alcohol beverage license or permit related to alcohol beverages shall be issued for any premises for which taxes, assessments or other claims of the Village are delinquent or unpaid.
B. 
Persons. No initial or renewal alcohol beverage license or permit related to alcohol beverages shall be issued to any person:
(1) 
Delinquent in payment of any taxes, assessments or other claims owed to the Village.
(2) 
Delinquent in payment of a forfeiture resulting from a violation of any ordinance of the Village.
(3) 
Delinquent in payment to the state of any state taxes owed.
A. 
Violation by agent. A violation of this chapter by a duly authorized agent or employee of a licensee shall constitute a violation by the licensee.
B. 
Proceedings. Proceedings for revocation of any license issued hereunder may be instituted in the manner and under the provisions prescribed in § 125.12, Wis. Stats.
C. 
Grant of license after revocation. No license shall be granted to a person who has had his license revoked hereunder for one year from the date of revocation.
No person shall carry any open can, bottle or other container of alcohol beverage or drink from the same upon any public walk, street, park or other public place in the Village except where a special permit is granted by the Village Board.
No person shall have in his possession an open can, bottle or other container of alcohol beverage in a motor vehicle on a public street, alley, walk, park or other public place in the Village.
Any person who shall violate any provision of this chapter shall be subject to a penalty as provided in § 1-4 of this Code.
