A violation of this chapter is hereby declared to be an offense,
punishable by a fine not exceeding $350, or imprisonment for a period
not to exceed six months, or both, for conviction of a first offense;
for conviction of a second offense, both of which were committed within
a period of five years, punishable by a fine of not less than $350,
nor more than $700, or imprisonment for a period not to exceed six
months, or both; and upon conviction for a third or subsequent offense,
all of which were committed within a period of five years, punishable
by a fine of not less than $700, not more than $1,000, or imprisonment
for a period not to exceed six months, or both. Each week's continued
violation shall constitute a separate additional violation.
Any permit or approval granted under this chapter based upon
or granted in reliance upon any material misrepresentation, or failure
to make a material fact or circumstance known, by or on behalf of
an applicant, shall be void. This section shall not be construed to
affect all the other remedies available to the Town under this chapter.
Whenever a violation of this chapter is alleged to have occurred,
any person may file a written complaint in regard thereto. All such
complaints shall be filed with the Planning Department. The Planning
Department shall investigate such complaints and report the results
of the investigation and any prosecution of violations to the Town
Board.
