A. The City shall have the right to plant,
prune, remove and maintain trees, plants, shrubs and vegetation within
the right-of-way or bounds of all streets, alleys, lanes, squares
and public grounds as may be necessary to insure public safety or
to preserve or enhance the symmetry and beauty of public grounds.
B. The City may remove or order to be removed
within the City right-of-way or bounds of all streets, alleys, lanes,
squares and public grounds any tree, plant, shrub or vegetation or
part thereof which is in an unsafe condition, which obstructs the
view of traffic or which is injurious to sewers, sidewalks, electric
power lines, gas lines, water lines or other public improvements or
is infected with any injurious insect, pest or disease.
C. On any tree overhanging any street or right-of-way
within the City, the City shall have the right to prune the branches
so that such tree will not obstruct the view of any street intersection
or obstruct traffic in any way or interfere with persons utilizing
the sidewalk or street.
D. Abutting property owners shall have the
responsibility to perform normal tree care on all street trees.
