When the County issues a permit requiring mitigation under §§
316-39,
316-45 and
316-47, the property owner must submit a complete permit application that is reviewed and approved by the County. The application shall include the following:
A. A site plan that describes the proposed mitigation measures.
(1) The site plan shall be designed and implemented to restore natural
functions lost through development and human activities.
(2) The mitigation measures shall be proportional in scope to the impacts
on water quality, near-shore aquatic habitat, upland wildlife habitat
and natural scenic beauty.
B. An implementation schedule and enforceable obligation on the property
owner to establish and maintain the mitigation measures.
(1) The enforceable obligations shall be evidenced by an instrument recorded
in the office of the Register of Deeds.
C. Mitigation options. Applicant shall obtain at least five points from
the following:
(1) Relocating a nonconforming principal structure to a conforming location:
5.0 points.
(2) Bringing an existing private on-site waste treatment system into
compliance with current standards: 5.0 points.
(3) Wetland restoration: must meet NRCS Code 657: 5.0 points.
(4) Establishing or restoring a shoreland buffer at least 35 feet from
the ordinary high-water mark according to NRCS Standards 391 and 393.

(a)
5.0 points for native trees, native shrubs, and grasses.
(b)
4.0 points for warm season grasses and native shrubs.
(c)
3.0 points for cool season grasses and native shrubs.
(d)
2.0 points for warm season grasses only.
(e)
1.0 point for cool season grasses only.
(5) Reducing impervious surface to less than 15% on the lot: 5.0 points.

(6) Increasing or establishing a no-till setback to at least 20 feet
from the ordinary high-water mark: 5.0 points.

(7) Maintaining a compliant shoreland buffer: 3.0 points.
(8) Installation of a stream bank stabilization or stream restoration
practice: 1.0 point per 50 lineal feet (100 feet minimum).
(9) Increasing the shoreland setback: 1.0 point per ten-foot increase.

Installation of a rain garden or other engineered system by
a landscape architect or engineer to improve infiltration from impervious
surfaces on the lot. Rain gardens must meet WDNR Rain Garden Technical
Standard 1009: 1.0 point per every 5% of impervious surface captured.

Removal of existing shore lighting or replacement with downcast
lighting within 75 feet of the ordinary high-water mark: 1.0 point.

Removal of nonconforming accessory structures: 1.0 point per
100 square feet of accessory structure.

Decreasing the viewing corridor: 1.0 point per 5% decrease.
