The former procedure for establishing and amending a Village
schedule of fees through enactment of local laws is both time-consuming
and lacking in economic feasibility. To more effectively serve its
residents, the Village of Dobbs Ferry creates a master Fee Schedule
to be maintained by the Village Clerk and establishes a procedure
to allow for the most efficient, orderly, cost-effective and prompt
establishment and adjustment of Village fees by resolution of the
Board of Trustees. It is the intent of this chapter that any reference
elsewhere in this Code to fees previously established and set forth
in this chapter shall hereafter refer to the Fee Schedule as set forth
herein.
As used in this chapter, the following terms shall have the
meanings indicated:
FEE
Any lawful charge authorized by law, regulation or local
legislation in the Code of the Village of Dobbs Ferry. These charges
shall include, but not be limited to, fees for Village services, such
as the submission and processing of applications for the issuance
of licenses, permits, certificates and land use, zoning and development
approvals, safety inspections and other actions associated with code
enforcement, Village programming such as recreation programs, admission
charges, the use of public resources such as parking, recreation and
park facilities and the copying of certain documents and records.
The fees may also include any other charge or disbursement required
by a municipal officer, department or duly constituted board, commission
or official committee of the Village of Dobbs Ferry acting in an official
capacity.
FEE SCHEDULE
A master list of fees to be maintained and adjusted in accordance
with this Chapter.
A Fee Schedule shall be established by the Board of Trustees
which shall set forth the fees to be duly assessed and collected by
the Village of Dobbs Ferry. Notwithstanding the language relating
to fees appearing in any provision of this Code, local law or resolution,
such fees shall be fixed and imposed by a resolution duly enacted
by the Board of Trustees.
All fees fixed and imposed pursuant to this chapter may, from
time to time, be adjusted to reflect either increase or decrease upon
a resolution duly enacted by the Board of Trustees.
The initial Fee Schedule shall consist of the list of fees heretofore
set forth in this chapter. Notwithstanding any language relating to
fees and charges appearing in any provision of this Code, local law
or resolution, such fees and charges henceforth shall be set forth
in the Fee Schedule. It shall be the responsibility of the Village
Clerk to maintain the Fee Schedule as the official record of all Village
fees. Upon enactment or adjustment of a fee by the Board of Trustees
pursuant to this chapter, said resolution shall be filed with and
the Fee Schedule adjusted by the Village Clerk accordingly with notation
made with reference to the date of such resolution. The Fee Schedule
should be evaluated annually and placed on the agenda for readoption
for the next calendar year during the Village's reorganization
meeting. Prior to the meeting, the Board of Trustees may seek input
from municipal officers, departments and duly constituted boards,
commissions and committees of the Village as to the fees relevant
to their official duties.
