A. 
The appropriations in the city budget for 1976 are hereby transferred to the departments or offices to which the functions, powers and duties are transferred by § 4-82 herein, and the unencumbered balances thereof shall continue to be available for the objects and purposes for which they were adopted.
B. 
As soon as possible after July 1, the Council shall, by resolution pursuant to N.J.S.A. 40:48-5, request the Director of Local Government Services to correct the titles, text or amount of appropriations in the adopted budget to conform them to the organization set forth in § 4-82 herein, provided that no appropriation for debt service, contingent expenses, deferred charges, statutory expenditures, judgments or reserve shall be reduced or limited thereby.
A. 
Classified service.
(1) 
All positions in the noncompetitive and the classified civil service and all incumbents thereof are continued, pursuant to Section 207 of the Charter, without prejudice or adverse effect on their tenure, seniority or promotional rights, provided that:
(a) 
No position occupied by a provisional employee shall be continued for more than sixty (60) days after the effective date of this chapter without evaluation thereof by the appointing director and certification of need to the Mayor in writing;
(b) 
Pending adoption of a personnel code pursuant to Article XVII herein, no vacant position shall be filled without evaluation thereof by the appointing director and certification of need to the Mayor in writing; and
(c) 
No position terminated pursuant to Subsection A(1)(a) above shall be reestablished without Council approval.
B. 
Unclassified service.
(1) 
All positions in the unclassified civil service and all incumbents thereof are continued up to sixty (60) days after the effective date of this chapter, pending evaluation of each position by the appointing director and certification of need to the Mayor in writing, provided that any incumbent may be terminated at any time sooner than sixty (60) days if his/her position is declared excess, and no incumbent shall remain after sixty (60) days unless his/her position is declared necessary.
(2) 
Provisional and unclassified employees terminated pursuant to the above shall receive notice of two (2) weeks or pay in lieu thereof.
Pension fund membership and rights of officers and employees shall not be adversely affected by any transfer pursuant to this chapter. The Mayor shall provide by regulation, if necessary, for such records, contribution controls and other means as will further protect such pension fund membership and rights.
All ordinances and resolutions adopted before the effective date of this chapter shall remain in effect until repealed or amended, provided that any found at any time to be inconsistent with the Charter or this chapter shall be considered repealed to the extent of the inconsistency
