A. 
Victory Park in the Borough of Royersford shall be operated and maintained under the supervision of the Borough Council of the Borough of Royersford. The Borough Council shall, from time to time, designate a park superintendent or an acting park superintendent to be directly responsible for operation and maintenance of Victory Park.
B. 
No amusement for gain or for which a charge is made can be conducted in the park, except as authorized by Borough Council for a nonprofit or community organization.
C. 
No person or persons shall engage in, participate in, aid, form, or organize, any assembly or group of people or make any speeches or conduct any musical program or festivals in the park unless a permit has been obtained from the Borough Manager.
Applications for a park permit shall be filed with the Borough Manager not less than 14 days before the date on which it is proposed to conduct the activity. The application shall state:
A. 
Name of person or organization wishing to conduct the activity.
B. 
Name, address and telephone number of the organization and of the authorized and responsible head of the organization.
C. 
Name, address and telephone number of the person who is chairman of the activity and who will be responsible for its conduct.
D. 
Date when the activity is to be conducted.
E. 
The park or portion thereof for which such permit is desired.
F. 
Estimate of anticipated attendance.
G. 
Hour when the activity will start and terminate.
The Borough Manager shall grant and issue the permit if the proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park and if the proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation, and if the facilities have not been reserved for other use at the date and hour requested and that the conduct of the activity will not substantially interrupt the safety and orderly movement of traffic and that the conduct of the activity will not require the diversion of so great a number of police officers of the Borough to properly police such activity as to prevent normal police protection in the Borough and that the conduct of the activity will not cause injury to persons or property, incite violence, crime or disorderly conduct, and that such activity is not held for the sole purpose of advertising any product, goods, or is not designed to be held purely for private profit.
It shall be unlawful for any person, firm or corporation using the park to either perform or permit to be performed any of the following acts:
A. 
Willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, tables, benches, fireplaces, railings, paving, paving material, or other public utilities or parts thereof, signs, notices or placards or other structures or equipment or facilities of the park.
B. 
Throw, discharge any object or item or otherwise litter the park premises. All refuse and trash shall be placed in proper receptacles where provided; otherwise, all rubbish and trash shall be carried away from the park by the person responsible for its presence.
C. 
Disturb the peace, use any profane, obscene or blasphemous language.
D. 
Endanger the safety of any person by any conduct or act.
E. 
Permit any loitering, vandalism, or commit any assault, battery or engage in any fighting.
F. 
Carry, possess or drink any alcoholic beverages in the park.
G. 
Prevent any person from using the park or any of its facilities or interfere with such use.
H. 
No animals either leashed or unleashed shall be permitted in the park.
I. 
No unauthorized motor vehicles are permitted in the park except in parking lots specifically designated for motor vehicles.
J. 
Bicycles are not permitted on pedestrian walking trails.
K. 
Persons are not permitted to use the park after sunset except by permit duly issued in accordance with these regulations.
L. 
On the little league field, the park activities are restricted to persons 12 years of age or under except with permission of the Park Superintendent, Activities Director or Commissioner of Little League.
M. 
There shall be no climbing over fences.
N. 
No person shall picnic or lunch in a place other than that designated for that purpose.
O. 
It is unlawful to engage in special activities, such as golf practice, ice skating, games and picnics, except at locations specifically designated for such activities by the person in charge of the park.
P. 
It shall be unlawful for any person to sell or peddle any commodity or article within the park, except as authorized by the Royersford Borough Council.
Q. 
No smoking around play areas.
R. 
Grill fires must be extinguished before person responsible for starting fire leaves park.
S. 
Bikes must be placed in racks.

Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Montgomery County.
