All such words as defined in the Municipal Land Use Law, if
not contained below, are hereby incorporated herein and declared to
be part of this chapter. The following words, terms and phrases used
in this chapter shall have the meanings hereinafter indicated.
ADMINISTRATIVE ACTIVITIES
Any business function in which there is not regular contact
with the general public and where no materials, products, goods or
prepared foods are stored except for office consumption.
AGRICULTURAL OR HORTICULTURAL PURPOSE OR USE
Any product of plants or animals useful to man, including
but not limited to: forages or sod crops, grains and feed crops; dairy
animals and dairy products; poultry and poultry products; livestock,
including the beef cattle, sheep, swine, horses, ponies, mules or
goats, and including the breeding and grazing of any or all of such
animals; bees and dairy products; fur animals; trees and forest products;
fruits of all kinds, including grapes, nuts, and berries; vegetables;
nursery, floral, ornamental and greenhouse products; or any land devoted
to and meeting the requirements and qualifications for payments or
their compensation pursuant to a soil conservation program under an
agency of Federal Government.
ALLEY
A minor way or roadway dedicated or open to public use which
is less than fifty (50) feet in width.
ALTERATIONS
Include, but are not limited to, the following:
A.
All incidental changes or replacements in non-structural parts
of a building or other structure.
B.
Minor changes or replacement in the structural parts of a building
or other structure, limited to the following examples and others of
similar character or extent:
(1)
Alteration of interior partitions to residential dwelling units.
(2)
Alteration of interior partitions in all other types of building
or other structures.
(3)
Making windows or doors in exterior walls.
(4)
Strengthening the load-bearing capacity in not more than ten
percent (10%) of the total floor area to permit the accommodation
of a specialized unit of machinery or equipment.
C.
Any change in the supporting members of a building such as bearing
walls, columns, beams or girders, or in the utility system or mechanical
equipment of a structure which change materially alters its usability
or capacity of function.
APPLICANT
Any individual, firm, association, syndicate, copartnership
or corporation having proprietary interest in the land submitted for
site plan or subdivision review sufficient to commence and maintain
proceedings to develop said land subject to municipal regulations.
APPROVING AUTHORITY
Means the Planning Board of the Municipality unless a different
agency is designated by ordinance when acting pursuant to the authority
of N.J.S.A. 40:55D-1 et seq.
BASEMENT
That portion of a building which is partly or completely
below grade. However, a "basement" shall be considered a story above
grade when the distance from grade to the finished surface of the
floor above the basement is more than six (6) feet for more than fifty
percent (50%) of the total perimeter or more than twelve (12) feet
at any point.
BED AND BREAKFAST
A private, detached single-family dwelling that (i) is occupied
by its owner, as the owner's primary residence, on a year-round basis,
(ii) includes income producing overnight lodging for traveling guests
in dedicated guest rooms that do not include cooking facilities, and
(iii) limits its services to guests to maid service, linen service,
incidental food service such as continental breakfasts and afternoon
tea, and other incidental, non-labor intensive, low-cost services.

BUFFER
A strip of land containing natural woodlands, planted vegetation
or landscape screening material, fencing, or earth mounts which separate
one kind of land use or one property from another.
BUILDING COVERAGE
The area of a lot covered by buildings measured on a horizontal
plane around the periphery of the foundations and including the area
under a roof as measured around the extremities of the roof.

BUILDING HEIGHT
The vertical distance measured from the main elevation of
the finished grade along the front of the building to the highest
point of the roof; to the main height level for flat roofs; between
the eaves and the ridge for gable and hipped roofs; and to the deck
line for mansard roofs.
BULK
The term used to describe the size of buildings or other
structures and their relationships to each other, to open areas such
as yards, and to lot lines including the size, height and floor area
of the building or other structures.
CAMPSITE
Any place, area, lot or tract of land so designed and intended
that persons could sleep, reside or dwell thereon, in or under any
type of shelter other than in a permanent type of structure which
conforms in all respects to the provisions of the Code of the Township
of Winslow.
CANNABIS
All parts of the plant Cannabis sativa and Cannabis indica,
whether growing or not, the seeds thereof, and every compound, manufacture,
salt, derivative, mixture, or preparation of the plant or its seeds,
except those containing resin extracted from the plant, which are
cultivated and, when applicable, manufactured in accordance with P.L.
2021, c. 16 (C. 24: 6I-31 et al.) for use in cannabis products, but
shall not include the weight of any other ingredient combined with
cannabis to prepare topical or oral administrations, food, drink,
or other product.

CANNABIS BUSINESS
Any person or entity that holds any of the six classes of
licenses established under P.L. 2021, c. 16, the " New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization
Act" ( CREAMMA).

CANNABIS CULTIVATOR
Any licensed person or entity that grows, cultivates, or
produces cannabis, and sells, and may transport, this cannabis to
other cannabis cultivators, or usable cannabis to cannabis manufacturers,
cannabis wholesalers, or cannabis retailers, but not to consumers.
This person or entity shall hold a Class 1 cannabis cultivator license.

CANNABIS DELIVERY SERVICE
Any licensed person or entity that provides courier services
for consumer purchases of cannabis items and related supplies fulfilled
by a cannabis retailer in order to make deliveries of the cannabis
items and related supplies to that consumer, and which services include
the ability of a consumer to purchase the cannabis items directly
through the cannabis delivery service, which after presenting the
purchase order to the cannabis retailer for fulfillment, is delivered
to that consumer. This person or entity shall hold a Class 6 cannabis
delivery license.

CANNABIS DISTRIBUTOR
Any licensed person or entity that transports cannabis in
bulk intrastate from one licensed cannabis cultivator to another licensed
cannabis cultivator, or transports cannabis items in bulk intrastate
from any one class of licensed cannabis establishment to another class
of licensed cannabis establishment, and may engage in the temporary
storage of cannabis or cannabis items as necessary to carry out transportation
activities. This person or entity shall hold a Class 4 cannabis distributor
license.

CANNABIS ESTABLISHMENT
A cannabis cultivator, a cannabis manufacturer, a cannabis
wholesaler, or a cannabis retailer.

CANNABIS ESTABLISHMENT LICENSE
An establishment with one ( 1) or many of the licenses to
operate as defined by the CREAMMA Act:

Class 1:

Cannabis cultivator license, for facilities involved in growing
and cultivating cannabis;
|
Class 2:
|
Cannabis manufacturer license, for facilities involved in the
manufacturing, preparation, and packaging of cannabis items;
|
Class 3:
|
Cannabis wholesaler license, for facilities involved in obtaining
and selling cannabis items for later resale by other licensees;
|
Class 4:
|
Cannabis distributor license, for businesses involved in transporting
cannabis plants in bulk from one licensed cultivator to another licensed
cultivator, or cannabis items in bulk from any type of licensed cannabis
business to another;
|
Class 5:
|
Cannabis retailer license for locations at which cannabis items
and related supplies are sold to consumers; and
|
Class 6:
|
Cannabis delivery license, for businesses providing courier
services for consumer purchases that are fulfilled by a licensed cannabis
retailer in order to make deliveries of the purchased items to a consumer,
and which service would include the ability of a consumer to make
a purchase directly through the cannabis delivery service which would
be presented by the delivery service for fulfillment by a retailer
and then delivered to a consumer.

CANNABIS MANUFACTURER
Any licensed person or entity that processes cannabis items
in this state by purchasing or otherwise obtaining usable cannabis,
manufacturing, preparing, and packaging cannabis items, and selling,
and optionally transporting, these items to other cannabis manufacturers,
cannabis wholesalers, or cannabis retailers, but not to consumers.
This person or entity shall hold a Class 2 cannabis manufacturer license.

CANNABIS PRODUCT
A product containing usable cannabis, cannabis extract, or
any other cannabis resin and other ingredients intended for human
consumption or use, including a product intended to be applied to
the skin or hair, edible cannabis products, ointments, and tinctures.
"Cannabis product" does not include: (1) usable cannabis by itself;
or (2) cannabis extract by itself; or (3) any other cannabis resin
by itself.

CANNABIS RETAILER
Any licensed person or entity that purchases or otherwise
obtains usable cannabis from cannabis cultivators and cannabis items
from cannabis manufacturers or cannabis wholesalers, and sells these
to consumers from a retail store, and may use a cannabis delivery
service or a certified cannabis handler for the off-premises delivery
of cannabis items and related supplies to consumers. A cannabis retailer
shall also accept consumer purchases to be fulfilled from its retail
store that are presented by a cannabis delivery service which will
be delivered by the cannabis delivery service to that consumer. This
person or entity shall hold a Class 5 cannabis retailer license.

CANNABIS WHOLESALER
Any licensed person or entity that purchases or otherwise
obtains, stores, sells or otherwise transfers, and may transport,
cannabis items for the purpose of resale or other transfer to either
another cannabis wholesaler or to a cannabis retailer, but not to
consumers. This person or entity shall hold a Class 3 cannabis wholesaler
license.

CEMETERY
Land used or intended to be used for the burial of the deceased,
including columbariums, crematories, mausoleums and mortuaries, when
operated in conjunction with and within the boundaries of the cemetery
itself.
CERTIFICATE OF OCCUPANCY
A certificate issued by the Township Construction Official
upon completion of construction or alteration of any building or structure.
Said certificate shall acknowledge compliance with all requirements
of this chapter, any adjustments to those requirements as granted
by the Zoning Board of Adjustment - and any other applicable requirements.
CHILD CARE CENTER
A facility for the care, development or supervision of six
or more children under six years of age who attend the facility for
less than 24 hours a day. The facility, where permitted, shall be
licensed by the State Department of Human Services, Division of Youth
and Family Services pursuant to. P.L. 1983, c. 492 (N.J.S.A. 30:5B-1
et seq.).

CHURCH
A building used for public worship by a congregation, excluding
buildings used exclusively for residential, educational, burial, recreational
or other uses not normally associated with worship.
CIRCULATION
Means systems, structures and physical improvements for the
movement of people, goods, water, air, sewage or power by such means
as streets, highways, railways, waterways, towers, airways, pipes
and conduits, and the handling of people and goods by such means as
terminals, stations, warehouses, and other storage building or transhipment
points.
CLUSTERED RESIDENTIAL DEVELOPMENT
An area to be developed as a planned development and entity
according to a plan containing residential housing units which have
common or public open space as an appurtenance and which does not
exceed the gross density permitted in the district being developed.
COMMENCEMENT OF CONSTRUCTION
Actual start of construction on a parcel of land in accordance
with a permit issued by the applicable jurisdiction.
COMMON OPEN SPACE
An open space area within or related to a site designated
and extended for the use or enjoyment of residents and owners of the
development. Common open space may contain such complementary structures
and improvements as are necessary and appropriate for the use or enjoyment
of residents and owners of the development.
COMMON PROPERTY
Land or water or a combination, together with improvements,
within or related to a site designated as a development, and designed
and intended for ownership, use and responsibility by the residents
and owners of the development.
CONSTRUCTION OFFICIAL
A qualified person appointed by the Township Committee pursuant
to the act and the regulations to enforce and administer the regulations
within the jurisdiction of the Township Committee.
CONTIGUOUS LANDS
Land which is connected or adjacent to other land so as to
permit the land to be used as a functional unit; provided that separation
by lot line, streams, roads, rights-of-ways, and easements shall not
affect the contiguity of land.
COUNTRY CLUB
A club operated for profits, which may include a golf course
and/or associated recreational facilities.
COUNTY
The County of Camden, State of New Jersey.
CUL-DE-SAC
A street with access closed at one (1) end and with a vehicular
turnaround at the closed end.
DAYS
Means calendar days.
DENSITY
The average number of dwelling units per area of land, expressed
in number of units per acre.
A.
GROSS DENSITY—The total number of dwelling units in a
proposed development divided by the total number of acres of the property
on which the development is proposed.
B.
NET DENSITY—The total number of dwelling units in a proposed
development divided by the total number of acres of the site on which
the development is proposed, exclusive of wetlands, streets, nonresidential
uses, other types of dwelling units, and land to be dedicated as common
open space.
DEVELOPER
The legal or beneficial owner or owners of a lot or of any
land proposed to be included in a development, including the holder
of an option or contract to purchase, or other person having an enforceable
proprietary interest in such land.
DEVELOPMENT
The division of a parcel of land into two (2) or more parcels;
the construction, reconstruction, conversion, structural alteration,
relocation or enlargement of any building or other structure, or of
any mining, excavation or landfill facility; and any use or change
in the use of any building or other structure, or land or extension
of use of land, for which permission may be required pursuant to this
chapter.
DEVELOPMENT REGULATION
Means a zoning ordinance, subdivision ordinance, site plan
ordinance, official map ordinance or other municipal regulation or
amendment thereto, on the use and development of land.
DRAINAGE
The removal of surface water or groundwater from land by
drains, grading, or other means. This includes control of runoff during
and after construction or development to minimize erosion and sedimentation
to assure the adequacy of existing and proposed culverts and bridges,
to induce water recharge into the ground where practical, to lessen
nonpoint pollution, to maintain the integrity of stream channels for
their biological functions as well as for drainage, and the means
necessary for water supply preservation or prevention or alleviation
of flooding.
DRAINAGE RIGHT-OF-WAY
The lands required for the installation and/or maintenance of storm sewers or drainage ditches, or required along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage in accordance with Chapter
1 of Title 58 of the New Jersey Revised Statutes.
DRIVEWAY
The vehicular entrance and exit for land use.
DWELLING UNIT
A room or series of connected rooms containing cooking, sleeping,
sanitary and general living facilities for one (1) housekeeping unit.
DWELLING, DUPLEX
A building containing two (2) dwelling units side by side
or wholly or partly one over the other, on one (1) lot.
DWELLING, SEMI-DETACHED SINGLE FAMILY (TWIN)
A building containing two (2) dwelling units side by side
on adjoining lots and having a common or party wall and having separate
individual sewerage and water facilities and connections.
DWELLING, TOWNHOUSE
A building containing three (3) or more attached dwelling
units erected in a row on adjoining lots, each unit being separate
from the adjoining unit, but attached by a common or party wall and
each unit having separate individual outside access and individual
public water and sewerage facilities and connections.
EASEMENT
An acquired privilege or right of use of privately owned
land for specified purposes.
EMPLOYEES
Whenever the word "employees" or the expression "number of
employees" is herein referred to, it shall mean the greatest number
of persons to be employed in the building in question during any season
of the year and any time of the day or night.
ENLARGEMENT
An addition to the floor area of an existing building, an
increase in size of another structure or an increase in that portion
of a tract of land occupied by an existing use.
ENVIRONMENTALLY SENSITIVE AREAS
Lands located within flood plains or wetlands areas on which
the alteration or development is subject to special regulations and
standards established by the local, State or Federal government.
FAMILY
One (1) or more persons related by blood, marriage, adoption
or guardianship, or any number of persons not so related occupying
a dwelling unit and living as a single housekeeping unit.
FAMILY DAYCARE HOME
A private residence registered pursuant to the Family Day
Care Provider Registration Act [P.L. 1987, c. 27 (N.J.S.A. 30:5B-16
et seq.)] where child-care services are provided for a fee to not
less than three or more than five children at any one time for no
less than 15 hours per week.

FARM BUILDING
Any building for storing agricultural equipment or farm produce,
housing livestock or poultry or processing dairy products. The term
"farm building" shall not include a dwelling.
FENCE
An artificially constructed barrier of wood, masonry, stone,
wire, metal or any other manufactured material or combination of materials
erected for the enclosure of yard areas or other open spaces.
FIRE STATION
That portion of a building used solely for the housing of
fire-fighting auxiliary equipment and related space.
FIRST ORDER STREAM
That portion of a stream, as identifiable on the USGS seven
and one-half (7 1/2) inch quadrangle maps, the point of upstream
origin, downstream to the first point of intersection with another
branch, stream, or tributary.
FLOOD FRINGE
That portion of the flood hazard area not designated as the
floodway.
FLOOD PLAIN
The relatively flat area adjoining the channel of a natural
stream which has been or may be hereafter covered by flood water.
FLOODWAY
The channel of a natural stream and portions of the flood
hazard area adjoining the channel which are reasonably required to
carry and discharge the flood water or flood flow of any natural stream.
FLOOR AREA
The sum of the habitable gross area of the several floors
of a building or buildings.
FLOOR AREA RATIO
A figure which, when multiplied by the lot area, will determine
the amount of permitted floor area. This figure is determined by dividing
the gross floor area of all buildings on a lot by the area of that
lot.
FRESHWATER WETLAND
An area that is inundated or saturated by surface water or
groundwater at a frequency and duration sufficient to support, and
that under normal circumstances does support, a prevalence of vegetation
typically adapted for life in saturated soil conditions, commonly
known as hydrophytic vegetation. However, in designating a wetland,
the Township shall use the three (3) parameter approach (i.e. hydrology,
soils and vegetation) enumerated in the April 1, 1987 interim-final
draft "Wetland Identification and Delineation Manual" developed by
the United States Environmental Protection Agency, and any subsequent
amendments thereto.
GARAGE
An enclosed building used or designed for housing or storing
of self-propelled vehicles or units, or portions thereof, designed
for public highways.
GARAGE, PRIVATE
A garage intended for and used by the motor vehicles of the
family residing within or on the premises.
GARDEN APARTMENTS
A group of multifamily dwellings with some of the units placed
on top of other units, and not to exceed three (3) stories in height,
designed for rental or sale of the individual housekeeping units,
having common open spaces.
GRAVEL
Shall conform to the description of soil aggregate, designation
I-5 as found in Subsection 901.09 of the NJDOT Standard Specifications
for Road and Bridge Construction, dated 1983 and/or any amendments
thereto.
HOME OCCUPATION
An activity for gain customarily carried on in a dwelling or in a building accessory to a dwelling, clearly incidental and secondary to the use of the dwelling for residential purposes, only in accordance with the specific criteria and standards set forth in Section
296-52B.

HOMEOWNERS ASSOCIATION
An organization in a development under recorded agreements through which each lot owner shall be a member and each dwelling unit is subject to a charge for a proportionate share of the expenses for the organization's activities and maintenance including maintenance costs levied against the association by the Township in accordance with §
294-125 of Article
XVI of the Zoning Chapter of Winslow Township.

HOSPITAL
A public institution providing public health services primarily
for inpatient medical or surgical care of the sick or injured and
including related facilities, such as laboratories, out-patient department,
training facilities, central service facilities and staff offices
which are an integral part of the facility.
HOSPITAL, VETERINARY
A structure designed or converted for the care and treatment
of sick or wounded domestic animals.
HOTEL
A building having six (6) or more rental rooms, without individual
cooking facilities, for transient guests.
HOUSEKEEPING UNIT
One (1) or more persons living as a single non-profit household,
as distinguished from individuals or groups occupying a hotel, club,
fraternity or sorority house. The housekeeping unit shall be deemed
to include housekeeping facilities and service.
IMMEDIATE FAMILY
Those persons related by blood or legal relationship in the
following manner: grandparents, grandchildren, parent, son, daughter,
brothers, sisters, aunts, uncles, and first cousins.
IMPERVIOUS SURFACE RATIO
A measure of the intensity of land use as measured by dividing
the total area of all impervious surface within the site by the site
area.
IMPROVEMENTS
Any type of structure, excavation or paved section.
INSTITUTIONAL USE
Any land owned by the Township of Winslow and land used for
the following public or private purposes; educational facilities,
including universities, colleges, elementary and secondary and vocational
schools, kindergartens and nurseries, churches and their accessory
uses, cultural facilities such as libraries, galleries, museums, concert
halls, theaters and the like; hospitals, including such educational,
clinical, research and convalescent facilities as are integral to
the operation of the hospital; medical and health service facilities,
including nursing homes, supervised residential institutions, rehabilitation
therapy centers and public health facilities, law enforcement facilities;
military facilities; and other similar facilities.
JUNKYARD
The use of any lot for the storage, keeping or abandonment
of junk, including wrecked or disabled vehicles, parts of vehicles,
scrap metals or other scrap material or building material, or for
the dismantling, demolition or abandonment of structures, automobiles
or other vehicles, equipment and used machinery or parts thereof;
provided, however, that this definition shall not be deemed to include
any of the foregoing uses which are accessory and incidental to any
lawful agricultural, commercial or industrial use permitted in any
zone. The term "junkyard" as herein defined includes automobiles wrecking
yards and yards or lots used for the accumulation of used building
materials. The outdoor storage, parking, keeping, or deposit of any
lot of two (2) or more vehicles without lawful license plates and
current Motor Vehicle Inspection stickers, which vehicles are not
accessory and incidental to a lawful agricultural, commercial or industrial
use permitted in any zone shall be deemed to be a "junkyard".
LANDFILL
Sites, including open dumps, where solid waste, liquid and
dry sewage sludge, and liquid and dry chemical waste are disposed
of by land application with or without the use of management practices
or soil covering.
LANDOWNERS
The legal or beneficial owner or owners of land, including
the holder of an option or contract to purchase (whether or not such
option or contract is subject to any condition), a lessee if he is
authorized under the lease to exercise the rights of the "landowners,"
or other persons having proprietary interest in land.
LANDSCAPING
The installation of plant material or seed as a part of development.
LOADING SPACE
An off-street berth on the same lot with a building or group
of buildings for temporary parking of a vehicle while loading or unloading.
LOT
A designated parcel, tract, or area of land established by
a plat or otherwise as permitted by law which may be used, developed,
or built upon as a unit.
LOT AREA
The size of a lot measured within the lot lines and expressed
in terms of acres or square feet.
LOT, CORNER
A lot with two (2) adjacent sides abutting upon streets or
other public spaces.
LOT COVERAGE
The area of a lot covered by buildings, structures, paved
surfaces, and compacted stone. Paved surfaces include, but are not
limited to, sidewalks, patios and decks, whether constructed of blacktop,
compacted stone, flagstone, brick, concrete, wood or similar material,
but excludes water surfaces of any swimming pool. For purposes of
this chapter, the water surface area of any swimming pool shall not
be calculated as lot coverage.

LOT DEPTH
The shortest horizontal distance between the front line and
a line drawn parallel to the front line through the midpoint of the
rear lot line. In case of a lot having curved frontage, the rear line
shall be drawn parallel to a chord connecting the points of intersection
of the front lot line with the side lot lines.
LOT FRONTAGE
The horizontal distance between the side lot lines measured
along the street line. The minimum "lot frontage" shall be the same
as the lot width, except that on curved alignments with an outside
radius of less than five hundred (500) feet, the minimum distance
between the side lot lines measured at the street line shall not be
less than seventy-five percent (75%) of the required minimum lot width.
In the case of a corner lot, either side may be considered the "lot
frontage", provided that the minimum frontage requirement is met for
the zone in which the lot is located.
LOT, INTERIOR
A lot, the side lines of which do not abut the street.
LOT LINE
Any line forming a portion of the exterior boundary of a
lot. The "lot line" is the same line as the street line for position
of a lot abutting a street. "Lot lines" extend vertically in both
directions from ground level.
LOT WIDTH
The horizontal distance between side lot lines measured at
setback points on each side lot line an equal distance back from the
street line. The minimum "lot width" shall be measured at the required
building setback line.
MAINTENANCE GUARANTEE
Any security other than cash which may be accepted by the
township for the maintenance of improvements required by this chapter
pursuant to N.J.S.A. 40:55D-1 et seq.
MAP, OFFICIAL
A map adopted in accordance with the Official Map and Building
Permit Act, Chapter 434 of the Laws of 1953, or any prior act authorizing
such adoption. Such a map shall be deemed to be conclusive with respect
to the location and width of the streets, public parks and playgrounds
and drainage right-of-way shown thereon.
MASTER PLAN
A composite of the mapped and written proposals recommending
the physical development of the municipality which shall have been
duly adopted by the Planning Board.
MEDICAL CLINIC
A building constructed as a professional building for the
offices of three (3) or more medical practitioners.
MOBILE RETAIL FOOD ESTABLISHMENTS (FOOD TRUCKS)
Any movable restaurant, truck, van, trailer, cart, bicycle
or other movable unit, including hand-carried, portable containers
in or on which food or beverage is transported, stored or prepared
for retail sale or given away at temporary locations.

MOTEL-HOTEL
A building or a group of buildings having units containing
sleeping accommodations which are available for a temporary rental
occupancy by transients and providing sufficient off-street parking
facilities adjacent or convenient thereto.
MUNICIPAL AGENCY
Means the Municipal Planning Board or Board of Adjustment,
or a governing body of Winslow Township when acting pursuant to the
Municipal Land Use Law and any agency which is created by or responsible
to the township when such agency is acting pursuant to the Municipal
Land Use Law.
NONCONFORMING LOT
Means a lot, the area, dimension or location of which was
lawful prior to the adoption, revision or amendment of the zoning
ordinance, but fails to conform to the requirements of the zoning
district in which it is located by reason of such adoption, revision
or amendment.
NONCONFORMING STRUCTURE
A structure the size, dimension or location of which was
lawful prior to the adoption, revision, or amendment of a zoning ordinance,
but which fails to conform to the requirements of the zoning district
in which it is located by reasons of such adoption, revision or amendment.
NONCONFORMING USE
A use or activity which was lawful prior to the adoption,
revision or amendment of a zoning ordinance, but which fails to conform
to the requirements of the zoning district in which it is located
by reasons of such adoption, revision or amendment.
NURSING HOME
Any building in which more than one (1) room or a specified
area is used for the accommodation, reception or treatment of the
aged or the sick who are residents therein, excluding members of the
resident's family.
OFFICE
A place for the transaction of business where reports are
prepared, records kept and services rendered, but where no retail
sales, except in connection with professional services, are offered
and where no manufacturing, assembly or fabricating takes place.
OFF-SITE
Means located outside the lot lines of the lot in question
but within the property (of which the lot is part) which is the subject
of a development application or contiguous portion of a street or
right-of-way.
OFF-TRACT
Means located off the property which is the subject of the
development application or off a contiguous portion of a street or
right-of-way.
ONSITE
Means located on the lot in question.
OPEN-SPACE
Means any parcel or area of land or water essentially unimproved
and set aside, dedicated, designated or reserved for public or private
use for enjoyment or for the use and enjoyment of owners and occupants
of land adjoining or neighboring such open space.
OWNER
Any individual, firm, association, syndicate, copartnership
or corporation, trust or other legal entity having sufficient proprietary
interest in the land sought to be subdivided to commence and maintain
proceedings to subdivide the same under this chapter.
PARKING AREA
An open, off-street land area, including parking spaces and
access and egress drives or aisles, used or required by this chapter
for parking of automobiles or other vehicles exclusively, and in which
no gasoline or automobile accessories are sold and no other business
is conducted.
PARKING SPACE, AUTOMOBILE
That area required for the parking or storage of one (1)
automobile, including necessary aisle or driveway space providing
access thereto.
PEDESTRIAN WAY
A right-of-way easement provided for the purpose of pedestrian
access and passage.
PERFORMANCE GUARANTEE
Any security approved by the Township Solicitor as to form
and by the Township Engineer as to amount and accepted in lieu of
the requirement that certain improvements be made prior to approval
of a site plan or a subdivision plan. Said security may take the form
of performance bonds, escrow agreements and other similar collateral
or surety agreements.
PERSON/PERSONS
An individual, corporation, public agency, business, trust,
partnership, association, two (2) or more persons having a joint or
common interest, or any other legal entity.
PLANNED COMMUNITY DEVELOPMENT
An area with a specified contiguous acreage to be developed as a single entity according to a plan, containing one (1) or more planned residential developments; one (1) or more public, quasi-public, or commercial areas in such ratios of nonresidential uses to residential uses; and a designated portion of open space as specified under Article
IX of this chapter.
PLAT, PRELIMINARY
The map indicating the proposed layout of the subdivision which is submitted to the Secretary of the Planning Board for consideration and tentative approval and which meets the requirements of this chapter and Chapter
246, entitled Subdivision of Land, of the Winslow Township Code.
PLAT, FINAL
The final map of all or a portion of the subdivision, which is presented to the Planning Board for final approval in accordance with the regulations of this chapter and Chapter
246, entitled Subdivision of Land, of the Winslow Township Code, and which, if approved, shall be filed with the proper county recording officer.
PLAT, SKETCH
A plan of sufficient accuracy and detail used, for the purpose of discussion and classification of a subdivision as provided for in this chapter and Chapter
246, entitled Subdivision of Land, of the Winslow Township Code.
PORCH
A roofed open structure projecting from the front, side or
rear wall of a building. A porch may be screened or glass enclosed.
PRINCIPAL USE
The main purpose for which any lot or building is used.
PUBLIC AGENCIES
The government of the United States of America, the State
of New Jersey, or any other state; their political subdivision, agencies
or instrumentalities; and interstate and regional agencies exercising
sovereign powers of government.
QUARRY BLEND
Shall conform to the description of dense graded aggregate
as found in Subsection 901.08 of the NJDOT Standard Specifications
for Road and Bridge Construction, dated 1983 and/or any amendments
thereto.
RECREATION, ACTIVE
Intensive recreation including facilities for physical activities,
games, team sports, and generally any recreation that is not passive
or low intensive.
RECREATION, PASSIVE OR LOW INTENSIVE
Recreation with insignificant impact on surrounding areas
or on the environmental integrity of the area, such as hiking, hunting,
trapping, fishing, canoeing, nature study and bicycling.
RECREATIONAL AREA
A private or public space, including essential buildings
and structures used for play and recreation space for individuals.
RESOURCE EXTRACTION
The dredging, digging, extraction, mining, and quarrying
of sand, gravel, or minerals for commercial purposes not including,
however, the private or agricultural extraction and use of extracted
material by a landowner.
RESTAURANT
An establishment in which food and drink is to be consumed
while seated at a table, counter, or a booth within a building on
the premises.
RETAIL SALES
Any sales of goods and services to the general public, as
distinguishes from wholesale sales.
RIGHT-OF-WAY
The area between the outer boundaries of the public street
or way, whether improved or unimproved and whether acquired by deed
or easement. The term "right-of-way" shall apply to planned future
roadways or widenings when these are shown on an adopted master plan
or an official map.
SERVICE STATION
Lands and buildings where motor fuel lubricants, miscellaneous
accessories and minor repair services for motor vehicles are dispensed,
but where no vehicular painting and/or bodywork is done and where
no junked or unregistered motor vehicles are kept or stored.
SETBACK LINE
A line within any lot, usually marking the limits or a required
yard space, parallel to any street line between which line and street
line no building or portion thereof may be erected, except as provided
in this chapter.
SHOPPING CENTER
One (1) or more buildings or parts thereof, designed as a
unit to be occupied by one (1) or more business enterprise for the
conduct of business.
SIGN
Any outdoor advertising sign or outdoor advertising structure.
A.
AREA OF SIGN—Shall be computed as including the entire
area within a regular geometric form or combinations of regular geometric
forms connecting all of the elements of the matter displayed. A sign
may be single surfaced or multisurfaced. The area of each surface
shall be included in the calculation for the maximum permitted area
of the sign.
B.
BUSINESS SIGN—A sign intended to advertise the use of
the lot on which it is located for the distribution, production or
sale of goods, the performance of services or the name of the proprietor,
renter or lessee of the lot or structure.
C.
CANOPY SIGN—A sign attached to or made a part of the canopy.
D.
CONSTRUCTION SIGN—A temporary sign used to advertise the
erection or alteration of a structure on the lot on which it is displayed.
E.
DIRECTIONAL SIGN—A nonbusiness sign beneficial to public
safety or traffic control in connection with a use on the lot on which
it is displayed or beneficial to public convenience and safety in
connection with directions to the location of a municipal, religious
or noncommercial public facility.
F.
FREESTANDING SIGN—A sign standing upon the ground supported
by one (1) or more upright legs or posts standing upon the ground,
with or without braces, and not attached to any structure.
G.
ILLUMINATED SIGN—A sign which is lighted by a self-contained
interior light or by lights projected or directed onto the sign.
H.
ILLUMINATION—The lighting or floodlighting of signs, on
property for purposes of identification, advertising or security,
outside the confines of a structure, by means of electricity or the
combustion of gases or liquids, or the lighting of an area, object
or structure.
I.
NONILLUMINATED SIGN—Any sign other than an illuminated
sign.
J.
PROFESSIONAL SIGN—A sign containing not more than the
name, address and profession of the occupant of a structure on the
lot on which it is displayed.
K.
PROJECTING SIGN—A wall sign projecting or extending more
than twelve (12) inches from the face of the building or structure
on which it is attached.
L.
PUBLIC CONVENIENCE SIGN—A sign used to identify a charitable,
hospital, institutional, municipal, nonprofit fraternal or membership,
religious or school use of a structure on the lot on which it is displayed.
M.
REAL ESTATE SIGN—A nonilluminated temporary sign used
to advertise the availability, lease, rental or sale of the lot or
structure on which it is displayed.
N.
TEMPORARY SIGN—A sign which offers premises for sale,
rent or development or which advertises their services of professionals
or building trades during construction or alteration of the premises
upon which the sign is located.
O.
TRAFFIC SIGN—A sign erected by the Township of Winslow
or by a town, county or state agency and used to inform, control or
direct traffic.
P.
WALL SIGN—A sign painted on, recessed in or affixed in
any manner to a wall of a building or structure.
SITE PLAN, MINOR
A development plan for less than two thousand five hundred
(2,500) square feet of floor area and less than fifty percent (50%)
of impervious surface, provided that such site plan:
A.
Does not involve planned development, any new street, or extension
of any off-street improvement which is to be prorated pursuant to
N.J.S.A. 40:55D-42; and
B.
Contains the information reasonably required in order to make
an informed determination as to whether the requirements established
by ordinance for approval of a minor site plan have been met.
SITE TRIANGLE
A triangular area abutting two (2) intersecting streets where
vision is unobstructed. The sight triangle is formed by the intersection
street sidelines and a line connecting a point on each sideline a
set distance from the intersection.
SMALL WIND ENERGY SYSTEM
A wind energy system, as defined herein that is used to generate
electricity, and has a nameplate capacity of one hundred (100) kilowatts
or less.

SOLAR ENERGY SYSTEM
A solar energy system and all associated equipment which
converts solar energy into a usable electrical energy, heats water
or produces hot air or other similar function through the use of solar
panels.

SOLAR FARM
An energy generation facility or area of land principally
used to convert solar energy to electricity to provide for some or
all of the energy needs for buildings or structures on the subject
parcel ("behind the meter" or "net metering" systems) or to generate
energy beyond the needs for buildings or structures on the subject
parcel or to generate energy on a parcel with no buildings or structures
("back to the grid" systems).

SOLAR PANELS
A structure containing one or more receptive cells, the purpose
of which is to convert solar energy into usable electrical energy
by way of a solar energy system.

STATE
The State of New Jersey or any of its agencies.
STORY
That portion of a building included between the upper surface
of a floor and the upper surface of the floor or roof next above.
A mezzanine floor, or intermediate level between the floor and ceiling,
shall be counted as a story if it covers over one-third (1/3) of the
area of the floor next below it.
STREET
Any street, avenue, boulevard, road, lane, parkway, viaduct,
alley or other way which is an existing State, County or Municipal
roadway, or a street or way shown upon a plat heretofore approved
pursuant to law or approved by official action, or a street or way
on a plat duly filed and recorded in the office of the County Recording
Officer prior to the appointment of a Planning Board and the grant
to such Board of the power to review plats, and includes the land
between the street lines, whether improved or unimproved, and may
comprise pavement, shoulders, gutters, sidewalks, parking areas and
other areas within the street lines. For the purpose of this chapter,
"streets" shall be classified as follows:
A.
ALLEYS—Minor ways which are used primarily for vehicular
service access to the back or the side of properties otherwise abutting
on a street.
B.
ARTERIAL STREETS—Those which are used primarily for fast
or heavy traffic.
C.
COLLECTOR STREETS—Those which carry traffic from minor
streets to the major system of arterial streets, including the principal
entrance streets of a residential development and streets for circulation
within such a development.
D.
MARGINAL-ACCESS STREETS—Streets which are parallel to
and adjacent to arterial streets and highways and which provide access
to abutting properties and protection from through traffic.
E.
MINOR STREETS—Those which are used primarily for access
to the abutting properties.
STREETLIGHTING
Streetlights, including under-ground wiring, pedestals, stanchions,
fixtures and lighting elements, transformers and all other necessary
components to ensure proper lighting along streets.
STREET LINE
The edge of the existing or future street right-of-way, whichever
would result in the widest right-of-way, as shown on the Official
Map or as required by this chapter, forming the dividing line between
the street and lot.
STRUCTURE
A combination of materials to form a construction for occupancy,
use or combination having a fixed location on, above, or below the
surface of land.
SUBDIVIDER
Any individual, firm, association, syndicate, copartnership,
corporation, trust or any other legal entity commencing proceedings
under this chapter to effect a subdivision of land hereafter for himself
or for another.
SUBDIVISION
The division of a lot, tract or parcel of land into two (2)
or more lots, sites or other divisions of land for the purpose, whether
immediate or future, of sale or building development, except that
the following divisions shall not be considered "subdivision"; provided,
however, that no new streets or roads are involved: divisions of land
for agricultural purposes where the resulting parcels are three (3)
acres or larger in size, divisions of property by testamentary or
intestate provisions or divisions of property upon court order. "Subdivision"
also includes resubdivision and, where appropriate to the context,
relates to the process of subdividing or to the lands or territory
divided.
SUBDIVISION, MINOR
A subdivision of land or the creation of not more than four
(4) lots provided that such subdivision does not involve a planned
development, a new street, or the extension of any off-tract improvement,
the cost of which is to be pro-rated pursuant to N.J.S.A. 40:55D-42.

SWIMMING POOL
Facilities constructed above or below ground having a depth
of more than two (2) feet and/or a water surface of one hundred (100)
square feet or more and designed and maintained for swimming purposes.
TOWERS
Towers shall include water towers, antennas and similar structures.
In no event shall the height of any tower or similar structure exceed
the distance from the nearest property lot line to the base of the
tower structure.
A.
Exceptions to height limitations:
(1)
Amateur radio, ham radio and civilian band radio operators with
or without a booster (amplifier) which are accessory to otherwise
permitted uses. The erection of any type of tower, including but not
limited to self-supporting lattice towers, guy towers, or monopole
towers for transmission or reception of radio waves, shall be permitted
in any zone within the township unless precluded by another Federal
or State law or regulation, on the condition that the following requirements
are satisfied:
(a)
Towers shall be of a height not in excess of sixty-three (63)
feet including the height of any antenna on said tower.
(b)
Towers and/or antennas which are accessory to otherwise permitted uses located on any property owned, leased or otherwise controlled by the governing body shall be exempted from the requirements of Section
294-113. In the Pinelands Area, such accessory towers and/or antennas shall not exceed a height of two hundred (200) feet.

TRACT
A parcel or portion or other division of land which is in
whole or in part proposed for development, composed of a portion of
one (1) lot, or one (1) or more contiguous lots in the same ownership.
Lots separated by easements, streets, or other public rights-of-way
shall be considered contiguous for the purpose of this chapter.
UNDERTAKING ESTABLISHMENT
A licensed mortician concerned with the arrangement of cremation
or burial of the dead and the overseeing of burials.
USE
Any activity, occupation, business or operation carried on
or intended to be carried on, in a building or on a tract of land.
USE, PRINCIPAL
The main purpose for which any lot or building is used.
UTILITIES
Those services customarily rendered by a corporation or the
municipality under the review of the public utilities commission or
a local authority for public service such as electricity, gas, telephone,
water and sewerage including the appurtenances used in connection
with the supplying of such services.
VEGETATION
Any plant material including grasses, shrubs, and trees.
WIND ENERGY SYSTEM
A wind turbine and all associated equipment, including any
base, blade, foundation, nacelle, rotor, tower, transformer, vane,
wire, inverter, batteries or other component necessary to fully utilize
the wind generator.

WIND TURBINE
Equipment that converts energy from the wind into electricity.
This term includes the rotor, blades and associated mechanical and
electrical conversion components necessary to generate, store and/or
transfer energy.

YARD
An open space extending between the closest point of any
building and lot line or street line.
YARD, FRONT
The yard extending along the full length of the front line,
and being the minimum horizontal distance between the front lot line
(or street line) and the front line of the building or any projection
thereof, other than steps.
YARD, REAR
An open space extending the full width of the lot and lying
between the rear lot line and closest point of any building or structure
on the lot except for swimming pools and similar open structures.
YARD, SIDE
An open space extending from the front yard to the rear yard
and lying between each side of the side lot line and closest point
of any building or structure on the lot except for swimming pools
and similar open structures.
