There is hereby created in and for the Borough of Avalon, a
Police Department which shall consist of no more than one Chief of
Police, one Captain, one Administrative Sergeant, one Detective Sergeant,
four Patrol Sergeants, 12 Patrol Officers and one Detective.

The Police Department shall operate as a division within the
Department of Public Safety.

The Director of Public Safety shall be designated as the Appropriate
Authority as required by the New Jersey Statutes. The Appropriate
Authority shall be responsible for the overall performance of the
Police Department. The Appropriate Authority shall adopt and promulgate
Rules and Regulations for the government of the Police Department
and for the discipline of its members. (N.J.S.A. 40A:14-118)

The Police Department shall be organized into a patrol division,
a detective bureau, and such additional organizational units as established
by the Chief of Police with the approval of the Director of Public
Safety.

The Police Department shall preserve the public peace; protect
life and property; detect, arrest and prosecute offenders of the laws
of New Jersey and the ordinances of the Borough of Avalon; direct
and control traffic, provide attendance and protection during emergencies;
provide appearances in court; cooperate with all other law enforcement
agencies; and provide training for the efficiency of its members and
officers. (N.J.S.A. 40A:14-152).

a. Chief of Police Designated. The Chief of Police shall head the Division
of Police.
b. Powers and Duties. The Chief of Police shall be the head of the Police
Department and shall be directly responsible to the Appropriate Authority
for its efficiency and day-to-day operations. Pursuant to policies
established by the Appropriate Authority, the Chief of Police shall:
1. Administer and enforce the Rules and Regulations of the Police Department
and any special emergency directive for the disposition and discipline
of the Department and its members and officers.
2. Have, exercise and discharge the functions, powers and duties of
the Police Department;
3. Prescribe the duties and assignments of all members and officers;
4. Delegate such authority as may be deemed necessary for the efficient
operation of the Police Department to be exercised under the Chief's
direction and control; and
5. Report at least monthly to the Appropriate Authority in such form
as shall be prescribed on the operation of the Police Department during
the preceding month and make such other reports as may be requested
by the Appropriate Authority. (N.J.S.A. 40A:14-118).

a. Application; fee; appointment.
1. Application. All applicants for employment as members or employees
of the Police Department shall complete an application provided by
the Police Department. All information provided by an applicant in
an application shall be complete and accurate. The failure to provide
complete and accurate information may result in the rejection of an
application for employment or the termination of an employee who submitted
incomplete or inaccurate information in an application for employment.
2. Application Fee. At the time of submission of the application, an
applicant for the position of full-time police officer shall also
submit a non-refundable application fee in the amount of $50. No application
for a position as a full-time police officer will be processed without
the payment of the application fee. Class I and Class II Special officers
will not be required to pay an application fee.
3. Appointment. All members and employees of the Police Department shall
be appointed by the Division Head subject to the approval of the Director
of Public Safety and the Mayor.
b. Examination. Each applicant shall comply with all of the laws of
the State of New Jersey pertaining to appointment as a police officer.
No person shall give or accept an appointment as a police officer
in the Borough unless that person has first been given a probationary
or temporary appointment and has successfully completed a police training
course at a school approved and authorized by the Police Training
Commission. Each candidate for appointment to the Police Department
shall be required to submit to such written and oral examination as
may be prescribed by the Director of the Department of Public Safety
and also to submit to a physical and psychological examination by
a licensed physician and a licensed psychologist, respectively, of
the State of New Jersey, which physician and psychologist shall be
designated by the Borough. The purpose and extent of the examinations
shall be for the purpose of ascertaining the extent to which the applicant
is mentally, physically and otherwise qualified to perform the appropriate
duties in the Department. The examinations shall be prepared and conducted
at a time and place by such persons designated by the Director of
the Department of Public Safety. Any applicant who shall fail to attain
a passing grade in such examinations or who shall fail to meet physical
qualifications as may be established by the Director of the Department
of Public Safety, or, in the opinion of the examining physician, is
incapable of performing the duties of a police officer in a safe and
efficient manner, or who is not recommended by examining psychologist
shall be ineligible for appointed to the Department. The examination
shall, where more than one candidate applies, be competitive, and
appointments shall be made from among those who have successfully
passed the examinations.
c. Age Requirement. No person shall be appointed to the Police Department
as a regular or probationary member unless he shall, at the time of
making application, be between the ages of 18 and 35 years, except
as provided by law in the case of veterans.
d. Residency Requirements. In accordance with N.J.S.A. 40A:14-122.1,
there shall be no residency requirement as a condition for appointment
to the Police Department.
e. Oath of Allegiance. Each member of the Police Department shall, before
entering upon the performance of duties, take and subscribe the oath
prescribed by law and such member shall sign and subscribe to such
oath which shall then be filed with the Borough Clerk.
f. Probationary Appointment.
1. Term of Probationary Period. Each person hereafter appointed to the
Department shall be known as a probationary Patrol Officer and shall
serve as a probationary Patrol Officer for a period of one year from
the date of his appointment. The probationary period shall be divided
into two six-month periods, the first six-month period being known
and designated as a probationary period "A" and the second six-month
period as probationary period "B."
Each person appointed or promoted to the position of Administrative
Sergeant, Patrol Sergeant, Detective Sergeant, Captain or Chief of
Police shall likewise serve a probationary period in such capacity
for a period of one year from the date of his appointment or promotion.
The probationary period shall be divided into two six-month periods,
the first six-month period being known and designated as probationary
period "A" and the second six-month period as probationary period
"B."
2. Appointment or Promotion. At the termination of the entire probationary
period, and provided that the candidate or person promoted satisfactorily
meets all the requirements of the position to which he has been appointed
or promoted for the probationary period, the appointment or promotion
as Patrol Officer, Administrative Sergeant, Patrol Sergeant, or Detective
Sergeant, Captain or Chief of Police, as the case may be, shall be
permanent on the approval of the Director of the Department of Public
Safety and the Mayor.
3. Failure to Meet Requirements. Should the candidate not meet the requirements
of the position of Patrol Officer at the end of either probationary
period "A" or "B," his services shall be terminated by the Chief of
Police with the approval of the Mayor. In the event that a candidate
does not meet the promotional probationary requirements for the position
of Administrative Sergeant, Patrol Sergeant or Detective Sergeant,
Captain or Chief of Police, such candidate shall be demoted to the
rank held by such candidate immediately preceding the probationary
promotion.

Conduct and responsibilities of police officers shall be:
a. To possess competence and knowledgeability in their field of work,
and to strive towards continued professional self-improvement.
b. To maintain physical capability, mental alertness and emotional readiness
to perform effectively as a police officer.
c. To exhibit high standards of moral and ethical conduct and to employ
a wholesome sense of humor in dealing with members of the public.
d. To be fair and impartial in the treatment of members of the public
and to recognize the dignity of all with whom they come in contact.
e. To have the ability to exercise good judgment and a mature attitude
in their performance of duties.
f. To understand and accept the individual differences among the public
and to provide necessary assistance to induce successful completion
of their assigned tasks.
g. To strive untiringly for harmonious rapport with the community.
h. To be loyal, dedicated and cooperative with the members of the community,
ready to work in harmony with others and with superiors at all levels
to achieve improvements in public safety.
i. To attend staff meetings.
j. To maintain such records and reports as may be required under the
provisions of State law or their supervisors.
k. To maintain professional competency and efficiency through additional
training whether in-service or otherwise.
l. To comply with all applicable rules, regulations and policies of
the Police Department.

Each regular police officer shall hold office and continue in
his employment during good behavior and efficiency.
No member or officer of the Police Department shall be suspended,
removal, fined or reduced in rank for any cause other than for incapacity,
misconduct or disobedience as provided in the New Jersey State Statutes
and the Police Department's Rules and Regulations. (N.J.S.A. 40A:14-147).
Any member of the Department may be suspended, removed, fined
or reduced from his office or employment for just cause upon due notice
and service of written charges and a hearing before the Director of
the Department of Public Safety. The Director may file charges and
also conduct the hearing thereon, or in the discretion of the Director,
the hearing may be conducted by the Mayor, Business Administrator,
or by a hearing officer appointed for such purpose.

a. Appointment; Term. The Borough Council may appoint special law enforcement
officers in accordance with New Jersey State Statutes for terms not
exceeding one year. They shall possess and exercise all the powers
and duties provided by said statutes during their term in office,
but shall not be continued as regular members of the Police Department
and shall not be entitled to tenure. The Chief of Police may authorize
special law enforcement officers when on duty to exercise the same
powers and authority as regular members of the Police Department including
the carrying of firearms and the power of arrest. (N.J.S.A. 40A:14-146.8
et seq.).
b. Conduct and Responsibilities. Special officers shall carry out their
duties and responsibilities under the direct supervision of the Chief
of Police. The Chief of Police shall specifically define the powers,
rights and duties of special officers. Such powers, rights and duties
shall cease at the expiration of the term for which they were appointed
or upon revocation of their appointment. Special officers may carry
a firearm or other weapon only if authorized to do so and if properly
trained under the direction and supervision of the Chief of Police.
c. Qualification. No person shall be appointed as a special officer
unless such person is a citizen of the United States; is able to read,
write and speak the English language; is physically qualified and
of good moral character; and shall not have been convicted of any
crime. Every such special officer shall be fingerprinted, and such
fingerprints shall be filed with the Division of State Police and
the Federal Bureau of Investigation. The Chief of Police shall periodically
report to the Borough Council concerning the eligibility, qualification
and appointment of special officers.
d. Maximum Number to be Appointed. In accordance with N.J.S.A. 40A:14-146.17,
the number of special officers that may be employed by the Avalon
Police Department shall be as follows:
Class I Special Officers shall not exceed 16.
Class II Special Officers shall not exceed 16.

The Borough shall provide all members of the Police Department
with uniforms, weapons and other equipment necessary for the performance
of assigned duties.

a. Police Manuals.
1. Police Manual. The rules, regulations and standard operation procedure
of the Department as embodied in a manual entitled "Police Manual"
is incorporated and made a part of this section by reference. Said
manual is herewith approved and adopted as the official rules, regulations
and standard operational procedure of the Avalon Police Department.
2. Civil Dispatchers Manual. The rules, regulations and standard operation procedure to civil dispatchers is set forth in the Police Manual which is incorporated herein pursuant to Subsection
a1 above.
b. Distribution of Manuals. The Chief of Police shall make available
to each member of the Police Department and each civilian dispatcher
electronic access to the Police Manual. Any neglect or refusal to
carry out the rules and regulations set forth therein shall be deemed
to be sufficient cause for dismissal from the Department.

a. Establishment; Composition. There is hereby established within the
Police Department a bureau which shall be known as the Detective Bureau.
The Bureau shall consist of such regular police officers and superior
officers of the Borough Police Department as shall be determined by
the Chief of Police, with the approval of the Director of the Department
of Public Safety.
b. Assignment to Bureau. The assignment to and reassignment from the
Detective Bureau shall in no way affect the existing status, title,
seniority and rights of such members of the Police Department as may
be so assigned and reassigned.
c. Supervision of Bureau. The Detective Bureau shall be under the direct
working supervision of the superior officer, assigned to such Bureau,
who shall supervise and direct the activities of the Bureau, and who
shall have the command and control of other members of the Department
assigned thereto, subject to the direction of the Chief of Police,
or in his absence or incapacity, the officer in charge of the Department.

The Division of Beach Patrol of the Borough is hereby established
and shall consist of the following: Chief of the Beach Patrol, Captain
of Beach Patrol, Lieutenant(s), lifeguards, beach tag supervisors
and inspectors, and such other and additional personnel as may be
authorized.

The Division of Beach Patrol shall operate as a division within
the Department of Public Safety.

The Director of Public Safety is the chief administrative officer
of the Avalon Beach Patrol acting under the supervision of the Mayor. The Mayor may, in his/her discretion delegate certain
or all of the daily administrative duties to the Chief of Police (Deputy
Director of Public Safety) by Mayoral Executive Order or otherwise.

The Division of Beach Patrol shall perform the following duties:
a. Patrol the beach and oceanfront of the Borough.
b. Advise and warn bathers and other persons of any danger.
c. Staff the lifeguard stands and lifeboats of the Borough.
d. Aid and assist any person in danger either on the beach or in the
waters of the ocean.
e. Maintain order on the beach.
f. Perform such other duties as directed by the Director or Deputy Director
of Public safety or as prescribed in any manual approved by Resolution
of Borough Council,

a. Chief of Beach Patrol Designated as Division Head. The head of the
Division of Beach Patrol shall be the Chief of the Beach Patrol who
shall be appointed by the Director of Public Safety with the consent
and approval of the Mayor.
b. Powers and Duties. The duties and responsibilities of the Chief of
the Beach Patrol shall include:
1. Responsibility for the day-to-day operations of the Avalon Beach
Patrol and all subordinate officers and lifeguards including the duty
to supervise beach tag supervisors and inspectors and the beach tag
inspection program;
2. Recommending to the Director and Deputy Director suitable individuals
who are qualified for appointment to the position of Lieutenant of
the Beach Patrol;
3. Responsibility for the determining the qualifications of applicants
for the position of lifeguard through appropriate pre-hire testing
and certifying qualified applicants to the Department Head, or his/her
designee for appointment as lifeguards;
4. Responsibility for ongoing training of lifeguards in lifesaving activities
and techniques;
5. Performing those duties and responsibilities specified in the approved
job description as the same may be amended from time to time;
6. Performing those duties and responsibilities as may be prescribed
in any manual approved by resolution of the Borough Council;
7. Performing such further and additional duties as may be directed
by the Department Head or the Deputy Department Head (Director of
Public Safety and Deputy Director of Public Safety).
c. Qualifications. The Chief of the Beach Patrol shall be qualified
through skills, training, and experience, as may be determined by
the appointing authority, to carry out the duties and responsibilities
of this position. In addition, the Chief shall be certified in Cardiopulmonary
Resuscitation ("CPR") and shall continue to possess a current valid
certification throughout his/her term of employment.
d. Term; Employment Status; Reappointment. The Chief of the Beach Patrol
shall be appointed for a term of three years from the date of appointment
and may be removed for cause at any time during said term. Any permanent
vacancy in the office, if filled, shall be filled for the unexpired
term. Any reappointment shall be for a successive term of three years.
The Chief shall not acquire tenure in office nor be entitled or eligible
to receive the employee-benefits available to full-time employees
unless required by law.
The Chief of the Beach Patrol shall be deemed a year-round employee
and shall work in accordance with the following schedule:
1. During
the tourist season (generally from Memorial Day through Labor Day)
the Chief shall work a full-time schedule as approved by the Department
Head.
2. During
the off-season, the Chief shall work a part-time flexible schedule
as approved by the Department Head and shall devote such time as may
be required to fulfill the duties and responsibilities of the position.

a. Captain of Beach Patrol. The Captain of Beach Patrol shall be the
Assistant Division Head and shall be appointed by the Director of
Public Safety with the consent and approval of the Mayor.
b. Powers and Duties. The Captain of Beach Patrol shall be the Assistant
Division Head and the Administrative Coordinator of the Avalon Beach
Patrol and shall assist the Chief of the Beach Patrol as well as the
Director and Deputy Director of the Department of Public Safety.
The Captain of Beach Patrol shall perform such other duties
as directed by the Director or Deputy Director, the Chief of Beach
Patrol, as well as those duties and responsibilities specified in
the approved job description as the same may be amended from time
to time; as well as those duties and responsibilities as may be prescribed
in any manual approved by resolution of the Borough Council.
The Captain shall also act as Division Head in the absence of
the Chief of Beach Patrol.
c. Qualifications. The Captain of the Beach Patrol shall be qualified
through skills, training, and experience, as may be determined by
the appointing authority, to carry out the duties and responsibilities
of this position. In addition, the Captain shall be certified in cardiopulmonary
resuscitation ("CPR") and shall continue to possess a current valid
certification throughout his/her term of employment.
d. Term; Employment Status; Reappointment. The Captain of the Beach
Patrol shall be appointed for a term of three years from the date
of appointment and may be removed for cause at any time during-said
term. Any vacancy in the office, if filled, shall be filled for the
unexpired term. Any reappointment shall be for a successive term of
three years. The Captain shall not acquire tenure in office nor be
entitled or eligible to receive the employee-benefits available to
full-time employees unless required by law. The Captain of the Beach
Patrol shall be deemed a year-round employee and shall work the following

a. Appointments. The Director or Deputy Director of Public Safety, with
the consent and approval of the Mayor, shall have the power to appoint:
1. A suitable number of persons, to be designated as Lieutenants of
Beach Patrol to perform such duties and responsibilities as assigned
by the Chief of Beach Patrol.
2. Lieutenants shall be appointed for a term of one year. Such individuals
shall also have taken and satisfactorily completed/passed a lifesaving
course approved by the American Red Cross or other comparable program.
Lieutenants shall also have taken and passed a course in CPR (cardiopulmonary
resuscitation) and shall maintain a current, valid certificate in
CPR training.
3. Appoint a suitable number of persons as lifeguards as recommended
by the Chief of Beach Patrol. The persons so appointed shall have
been certified by the Chief of Beach Patrol to possess the required
training and experience to permit them to discharge their duties and
responsibilities appropriately. At a minimum, such individuals shall
demonstrate proficiency in swimming and the utilization of lifeguard
equipment. Such individuals shall also have taken and satisfactorily
completed/passed a lifesaving course approved by the American Red
Cross or other comparable program. Lifeguards shall also have taken
and passed a course in CPR (cardiopulmonary resuscitation) and shall
maintain a current, valid certificate in CPR training.
b. Status as Seasonal Employees. Unless otherwise appointed differently,
all lieutenants, lifeguards, beach tag supervisors and inspectors,
and any other personnel shall be seasonal employees and shall be employed
only for such periods, as the Borough shall determine. As seasonal
employees, their employment shall terminate at the end of the season
for which they were hired, and they shall be subject to the provisions
of the Seasonal Employee Personnel Policy Handbook and they shall
abide by the terms, conditions, and provisions thereof. As seasonal
employees, they shall have no right to or expectation of reemployment
in any subsequent year.

All lifeguards as well as superior officers shall be issued
appropriate uniforms and equipment sufficient to permit the performance
of their duties.

a. Subject to the approval of the Mayor, the Deputy Director of Public
Safety, in consultation with the Chief and Captain of Beach Patrol,
and with the advice and assistance of the Borough's Labor Attorney,
may prescribe policies, rules, and regulations for the operation of
the Beach Patrol, including discipline policies.
b. Any matters to be incorporated into the Employee Personnel Manual,
or the Seasonal Employee Manual shall first be submitted to and approved
by resolution of Borough Council.

a. Emergency medical services, including ambulance service within the
Borough shall be provided by two separate components as follows:
1. By volunteer members of the Avalon Rescue Squad Inc. who possess
the required training and certifications required by the State of
New Jersey or any agency thereof and who are admitted to membership
in the Avalon Rescue Squad, Inc. in accordance with the rules, regulations,
and procedures established by the corporate Board of Trustees or Directors
and in accordance with corporate bylaws;
AND
2. By employees of the Borough who are employed on either a full time
or part time basis as Emergency Medical Technicians (EMTs).
b. In rendering ambulance and emergency medical services in the Borough
and activities related thereto, both the volunteers and the EMT employees
of the Borough shall operate and function as a single unit under the
supervision of the Chief of Emergency Medical Service who is Division
Head of the Division of Rescue Squad and assisted by the Coordinator
of Emergency Medical Services.

c. With respect to all corporate affairs and all other non-medical related
services, including, but not limited to, all fund raising activities
and compliance with those laws and regulations applicable to tax exempt
entities, the volunteers of the Avalon Rescue Squad, Inc., and the
corporation itself shall be governed by and subject to the corporate
charter and bylaws of the corporation. The Borough recognizes and
acknowledges that Avalon Rescue Squad, Inc. is a separate, independent,
and autonomous corporate entity governed by its own board of directors
or trustees and officers elected or appointed in accordance with the
corporate bylaws. The Borough shall have no control nor attempt to
assert any control over the corporate affairs and activities of the
Avalon Rescue Squad, Inc. as described herein.
d. Nothing contained herein shall be construed as prohibiting the Borough,
in recognition of the very valuable and vitally necessary services
provided by the volunteers of the Avalon Rescue Squad Inc., from assisting
the Avalon Rescue Squad, Inc., its Board of Directors or Officers
in any of its non-medical activities, or otherwise, to the extent
permitted by law. Any such assistance shall be offered only to the
extent that it will not impair or infringe upon the corporate identity
and independence of the Avalon Rescue Squad, Inc. and provided further
that any such assistance shall be rendered only with the express consent
and approval of the corporate Board of Directors.
e. In recognition of the fact that Rescue Squad — Emergency Medical
Services are funded by public contributions to the Avalon Rescue Squad,
Inc. ("Corporation") solicited through corporate fund raising activities
and also by municipal appropriations in the annual municipal budget,
and in order to avoid any duplication of expenditures of public monies
and to assure that all funds are expended in the most efficient and
cost conscious manner possible, it is in the public interest that
there be consultation and an exchange of financial information on
some regular and periodic basis and a coordination of expenditures.
In furtherance of that objective and to promote the mutual cooperation
that is to be encouraged between the Corporation and the Borough,
the Corporation is requested to file with the Division Head and with
the Borough Chief Financial Officer, at least quarterly, a record
of all expenditures made by the Corporation. In similar fashion, the
Borough shall provide to the Corporation, at least quarterly, a report
of all line item expenditures from the municipal budget.

a. Subject to the provisions of the preceding section, the Rescue Squad
shall be a Division within the Department of Public Safety to be known
as the "Division of Rescue Squad — Emergency Medical Services".
b. For administrative purposes, and only regarding the rendering of
emergency medical services and all activities related thereto, The
Avalon Rescue Squad Inc. is assigned to the Department of Public Safety,
Division of Rescue Squad — Emergency Medical Services.

The Division shall be administered by the Division Head who
shall be appointed by the Mayor.

The Division of Rescue Squad — Emergency Medical
Services shall provide emergency medical services and ambulance service
within the Borough.

a. Appointment.
The Division Head shall be the Chief of Emergency Medical Services.
b. Powers and Duties.
The Division Head of the Avalon Rescue Squad shall be the Chief
of Emergency Medical Services who shall have all the administrative
power and authority and the overall supervisory responsibility for
the Division.
The Division Head shall administer, supervise and direct the
activities of the Division of Rescue Squad — Emergency
Medical Services including but not limited to the following:
1. Direct and supervise the work of the Coordinator of Emergency Medical
Services if there should be one;
2. Direct and administer activities resulting in or leading toward the
establishment of necessary and appropriate emergency medical facilities,
staffing of facilities by emergency trained medical and auxiliary
personnel, supervise the installation of first responder communication
systems, and acquisition of emergency vehicles.
3. Maintain records of facilities and personnel to be maintained in
the Police Records Department.
4. Supervises the development and plans of training programs for the
ambulance and rescue personnel
5. Oversees the development of a program of cooperation with schools
and community organizations to encourage public interest in and knowledge
of basic and advanced first aid training.
6. Perform such further duties as may be required by general law or
Borough Ordinances.
7. Perform such further and additional duties as may be prescribed by
the Mayor, Director of Public Safety, Business Administrator or Borough
Council.
8. Prepares annual report to the Mayor and Council.
9. Issues disciplinary actions when necessary against EMS personnel.
10. Establishes policies and procedures
The Division Head may, in his/her discretion, delegate some
responsibility for the performance of certain duties and responsibilities
to the Coordinator of Emergency Services, should there be one, or
another member of the Division as may be appropriate under the circumstances,
on either a temporary or permanent basis and reassign such duties
and responsibilities as circumstances make necessary; provided, however,
that the ultimate responsibility for the management, supervision and
oversight of the Avalon Rescue Squad shall remain with the Chief of
Emergency Medical Services in his/her capacity as Division Head and
such ultimate responsibility shall not be delegated to any subordinate.
11. In
the performance of the above duties or any other duties involving
the Rescue Squad – Emergency Medical Services, the
Chief of Emergency Medical Services, in his/her capacity as Division
Head, shall report and be responsible to the Deputy Director of Public
Safety who retains overall responsibility for all divisions within
the Department of Public Safety.

The Assistant Division Head, should one be appointed, shall
be the Coordinator of Emergency Medical Services.

The Division Head shall be assisted by the Coordinator of Emergency
Medical Services, should one be appointed, who shall be the Assistant
Division Head who shall be an employee of the Borough and appointed
by the Mayor on the recommendation of the Director of Public Safety,
or on the Mayor’s own initiative in accordance with this subsection.
a. Qualifications of Coordinator.
The Coordinator shall be qualified by training and experience
to perform the duties of the position and shall have, at a minimum,
the following qualifications:
1. Current valid New Jersey Driver's License;
2. Three years of experience providing emergency medical care; and a
demonstrated capacity for leadership and supervisory skills;
3. Possess a current and valid Emergency Medical Technician Certificate
issued by the New Jersey Department of Health which Certificate must
be renewed or updated at such times as required by law;
4. Possess knowledge of the principles of emergency medical or first
aid treatment; and the methods used in rescuing and transporting accident
or catastrophe victims and others requiring emergency medical assistance;
5. Knowledge of the principles for emergency medical and first aid treatment;
6. Knowledge of the techniques used to administer pulmonary and cardiac
resuscitation;
7. Knowledge of the techniques used to administer oxygen;
8. Knowledge of the appropriate emergency treatment depending on the
patient's condition;
9. Ability to organize assigned work and develop effective work methods;
10. Ability to provide assignments and instructions and develop work
schedules for assigned employees and to supervise the performance
of their work;
11. Ability to establish and maintain cooperative working relationships
with coworkers and others involved in the work of the unit;
12. Ability to prioritize emergency medical treatment needs;
13. Ability to remain calm in a crisis situation;
14. Ability to exercise good judgment under stressful circumstances;
15. Ability to determine the nature and extent of injury and provide
emergency medical treatment;
16. Ability to administer first aid, CPR and other emergency medical
care;
17. Ability to establish necessary records and files;
18. Ability to utilize various types of electronic and/or manual recording
and information systems used by the Borough or related units;
19. Knowledge of medical care facilities and medical emergency transport
vehicles;
20. Knowledge of the mutual aid and mobilization plans of local emergency
medical squads;
21. Knowledge of medical triage;
22. Knowledge of the principles of first aid training programs;
23. Knowledge of first responder communication systems;
25. Ability to establish necessary records and files;
26. Ability to utilize various types of electronic and/or manual recording
and information systems used by the agency, office, or related units.
b. Duties of Coordinator.
The Coordinator shall perform the following duties:
Under direction of the Division Head:
1. Supervises emergency medical personnel who answer calls for emergency
medical treatment.
2. Schedules work shifts of emergency medical personnel.
3. Maintains a log of ambulance calls and records of runs made.
4. Assists the Division Head in the preparation of the annual budget
and makes recommendation to the Division Head concerning budget issues
and expenditures. This shall include all purchase orders (PO's). PO's
may be recommended to the Division Head by the Coordinator but only
the Division Head shall have the authority to authorize and issue
PO's on behalf of the Department and this Division.
5. Prepares quarterly reports on the operation of the unit and more
frequently when directed to do so and such further and additional
reports as may be requested by the Division Head.
6. Participates in Interviews and recommends applicants for emergency
medical positions.
7. Prepares and arranges for training of all technicians by the State
Health Department and is responsible for seeing that all technicians
maintain current certifications and that individual records of technicians
are current and up to date in accordance with Standard Operating Procedures
for the Division. Brings to the immediate attention of the Division
Head any technician who fails to maintain required certifications.
8. Attends conferences on emergency medical services and instructs emergency
medical personnel on these services.
9. Inspects ambulances and all medical equipment to insure that equipment
is operative and in good condition. Makes certain that required inspections
are done by the duty crew coming on duty.
10. Performs other work as required and directed by the Division Head;
11. Periodically inspects facilities and supplies to ensure capability
of meeting the Borough's emergency needs and submits recommendations
to the Division Head periodically.
12. Assists, when requested to do so, in the development of policies
and procedures for the Division.
13. Assists groups in the development and presentation of basic and advanced
first aid training classes.
14. Under supervision, confers with coordinators of emergency programs
in other areas to discuss problems, coordinate activities and cooperate
in area or statewide plans.
15. Attends meetings as required.
16. Informs emergency medical squads of any relevant information.
17. Coordinator shall personally review all EMS Charts and require corrections
as needed and discuss all issues with EMT. The Coordinator shall bring
to the attention of the Division Head the failure of an EMT to implement
corrective action or where the actions of an EMT are below acceptable
standards.
18. Evaluate EMS personnel every six months.
19. Advise division head of EMS personnel work deficiencies.
20. Works duty crew shifts as prescribed by Department or Division Head
and to cover shift shortages when no other EMS personnel is available
or able to work.
21. Performs such additional duties as may be prescribed by the Division
Head, or as may be directed by the Mayor, Director of Public Safety,
Business Administrator or Borough Council acting through the Division
Head.
In the absence of a Coordinator of Emergency Medical Services
(Assistant Division Head), the duties assigned to the Coordinator
herein shall be performed by the Chief of Emergency Medical Services
(Division Head).

a. Appointment.
1. Volunteer Members of the Avalon Rescue Squad Inc. shall be appointed
in accordance with the constitution and bylaws of such corporation.
2. Borough employees who are appointed to the Rescue Squad shall be
appointed by the Mayor based upon the written certification of the
Chief of Emergency Medical Services that the individual(s) is/are
qualified for appointment under the laws of New Jersey and the requirement
of the New Jersey State Department of Health or other agency having
jurisdiction. The Mayor may, in the exercise of his discretion, delegate
the hiring of Emergency Medical Technicians to the Chief of Emergency
Medical Services who shall provide notice of such hires to the Deputy
Director of Public Safety (Chief of Police) and the Division of Human
Resources and the Treasurer’s office.

b. Qualification.
All persons appointed to the Rescue Squad shall possess, at
a minimum, the training and certification(s) required by state law
and the rules and regulations of the New Jersey Department of Health
as the same may be amended and supplemented.

An emergency medical technician employed by the Borough on either
a full- or part-time basis may serve as a corporate director or officer
of that corporation known as "Avalon Rescue Squad Inc.," its successors
and assigns with the express prior approval of the Department Head
of Public Safety or the Deputy Director.
In serving in any such corporate capacity the employee shall
be acting solely in his/her individual capacity and not as an agent
or representative of the Borough of Avalon. Such employee shall have
no authority whatever to bind the Borough to any obligation of any
nature whatsoever.

The Fire Department of the Borough of Avalon is hereby created
and established with jurisdictional boundaries coextensive with the
boundaries of the Borough.

For administrative purposes only, the Avalon Volunteer Fire
Department is assigned to, but is not part of, the Department of Public
Safety.

The Avalon Volunteer Fire Department is hereby recognized and
accepted as the firefighting entity of the Borough.

The Borough recognizes that the Avalon Volunteer Fire Department,
Inc. (AVFD) is a private, autonomous body with separate government
and management from other departments or agencies of the Borough.
The AVFD is a corporation organized and existing under the laws of
the State of New Jersey and is a tax exempt entity under the laws
of the United States. The composition, government and management of
the Avalon Volunteer Fire Department shall be in accordance with constitution,
bylaws and rules which may be adopted by such Department subject to
the provisions of law.

a. Borough Council makes the following factual determinations:
1. The Avalon Volunteer Fire Department (AVFD) is recognized and designated as the firefighting entity of the Borough. (Code §
2-65.3).
2. The AVFD is composed entirely of unpaid volunteers and the majority
of whom reside in mainland communities outside the geographical boundaries
of the Borough with only a minimum of the firefighting membership
residing within the Borough. Past experience has demonstrated that
it is difficult for such non-resident firefighters to respond to fire
calls in the evening and overnight hours. Moreover, during such hours
response time to arrive at the fire station is delayed because of
the distance most firefighters have to travel to arrive at the fire
station. This results in a delay in arriving at the scene of the fire
call. In some cases, fire apparatus has necessarily been dispatched
with less than a full crew and this results in an inadequate response
and places the responding firefighters in jeopardy and constitutes
a threat to person and property and a general threat to public safety.
3. As a consequence of this situation, and in an effort to have an adequate
force available and keep response time to a minimum, the Chief and
other Officers of the AVFD have recommended to Borough Council a plan
which would have firefighters staff the fire station during the overnight
hours so as to be readily available in the event of a fire call or
other emergency and thereby reduce response time to an acceptable
level.
4. Pursuant to such recommendation, those firefighters who staff the
fire station overnight would receive a stipend, the amount of which
would be determined in accordance with a plan, rules and regulations
developed by the AVFD and approved by the Borough as herein provided,
and provided further, that such plan shall comply in all respects
with the requirements of the Fair Labor Standards Act and other applicable
and controlling law as determined by the Borough Solicitor.
b. Effective October 1, 2016, there shall be established a stipend program
to compensate volunteer firefighters of the AVFD who staff the fire
station during the overnight hours. This program shall be implemented
and monitored by the Business Administrator in consultation with the
Chief Financial Officer. Such stipend program shall comply with the
requirements of the Fair Labor Standards Act; the regulations of the
Internal Revenue Service regarding payments to volunteers and any
and all other applicable and controlling Federal or State law.
c. Effective January 1, 2017, such program shall be funded by an appropriation
in the annual municipal budget. Prior to implementing such program,
the Business Administrator, in consultation with the Chief Financial
Officer, shall negotiate with the AVFD a Memorandum of Understanding
(MOU) to be approved by the Borough Solicitor which MOU shall embody
all of the terms, conditions, and rules and regulations for the implementation
and administration of such program.
d. The initial MOU shall be approved by Borough Council and, once finalized
and approved, may continue in force from year to year thereafter,
subject to Borough annual budgetary appropriations, unless either
the Borough or the AVFD shall give written notice to the other of
an intent to terminate or amend such agreement which notice shall
be given and received not later than October 1 for the following calendar
year. Any amendment to the MOU shall first be approved by Borough
Council before taking effect.
e. The program established by this section shall apply only to firefighters
of the AVFD and shall not extend to Fire Police or any other personnel
other than actual firefighters.

Pursuant to N.J.S.A. 40A:14-26; N.J.S.A. 40A:14-156.1 et seq.,
and N.J.S.A. 40A:14-146.8 et seq., there is hereby established a Mutual
Aid Agreement with all other municipalities in Cape May County, New
Jersey, which adopt a reciprocal ordinance to provide mutual police
or fire aid in case of emergency. This Agreement shall apply whenever
the Borough of Avalon may have an emergency within its boundaries
requiring additional police or fire assistance to protect life and
property or to assist in suppressing a riot or disorder; and whenever
another municipality in this County who has enacted a reciprocal ordinance
may experience a similar emergency requiring additional police assistance.

Pursuant to N.J.S.A. 40A:146-10, a special law enforcement officer
under the supervision and direction of a full-time Chief of Police
is hereby authorized to perform his duties in another municipality
in Cape May County which has enacted a reciprocal ordinance to provide
mutual police or fire aid in case of emergency.

The Chief of the Police Department or Chief of the Fire Department
is authorized to request assistance from their respective counterpart
who is the Chief in another municipality within Cape May Council to
provide aid during and after any emergency.

The Chief of the Police Department or Chief of the Fire Department
shall provide assistance to another municipality or municipalities
in Cape May County, making a valid request to supply such personnel
and equipment as required to the extent possible without endangering
persons or property within the Borough of Avalon. The members of the
Police Department or Fire Department supplying aid shall have the
same powers, authority, rights and immunities of the members of the
Police Department and Fire Department of the municipality to which
assistance is rendered.

The Borough of Avalon shall, upon providing assistance to another
municipality who has enacted a reciprocal mutual aid ordinance, assume
the cost and expense of providing its personnel and equipment to the
requesting municipality, except in such instances where the requesting
municipality receives State and Federal aid by way of reimbursement.
In such circumstances the cost incurred by the Borough of Avalon shall
be submitted to the community requesting assistance.

Members of the Police Department or Fire Department of the Borough
of Avalon suffering injury, or their legal representatives, if death
results, while rendering assistance in another municipality, shall
be entitled to all such benefits they would have realized if injury
or death had occurred in the performance of normal duties in the Borough
of Avalon.
