The Borough of Prospect hereby recognizes the Prospect Volunteer Fire Company which has been organized by residents of said Borough. No other organization(s) dedicated to the fighting of fires are authorized to operate within the Borough except for those acting under a mutual aid or other agreement approved by Borough Council.
The Prospect Volunteer Fire Company is hereby given all power, so far as the Borough of Prospect has power to grant the same, to enact such rules and regulations for the management and government of individual members thereof as shall be necessary for the proper maintenance and control of said Volunteer Fire Company. Neither the grant of the aforesaid power nor the recognition set forth in § 25-1 shall be construed as constituting the Prospect Volunteer Fire Company as an agent, department or employee of the Borough except insofar as such effect is provided under the provisions of the Act of June 2, 1915, P.L. 736, No. 338, known as the "Pennsylvania Workmen's Compensation Act,"[1] or the Act of November 26, 1978, P.L. 1399, No. 330, known as the "Political Subdivision Tort Claims Act."

The members of Prospect Volunteer Fire Company may elect from their number such officers as may be provided by the bylaws of the fire company.
All appropriations made by the Borough of Prospect to or for the use of said fire company, whether of money or property, and all equipment purchased by the Borough for the fire company shall continue to be the property of the Borough. None of the fire apparatus or equipment so belonging to the Borough shall be permanently removed from the Borough without consent of the Borough Council.
In addition to actually fighting fires or while engaged in going to or returning from any fire, the members of the fire company recognized by the Borough are authorized to do the following things:
A. 
Answer any type of fire alarm or call, whether general alarm, private call or investigation of fire report or emergency call of any type, inside or without the Borough.
B. 
Engage in any type of drill, training, ceremonial, practice, test or parade when duly called or authorized by a proper officer or officers of the fire company.
C. 
Engage in fund-raising activities for the fire company, when authorized by a proper officer or officers of the fire company.
