No person, firm or corporation shall remove soil from any lot,
tract or parcel of land in the Borough of Flemington and thereafter
deposit the same at any other place but the lot, tract or parcel of
land from which the same was removed, or the Flemington-Raritan Sanitary
Land Fill, located on Pennsylvania Avenue Extension, in the Township
of Raritan, County of Hunterdon and State of New Jersey, the same
being known and designated as Block 36, Lot 14 on the Township of
Raritan tax map.
Any person, firm or corporation who shall violate any provision
of this chapter or fail to comply therewith shall severally, for each
and every such violation and noncompliance, forfeit and pay a penalty
not to exceed the sum of $500.00, or be imprisoned in the Hunterdon
County Jail for a period of not more than 90 days, at the discretion
of the court or jurisdictional officer before whom a conviction may
be found. The imposition of the foregoing penalties shall not bar
the right of the municipality to specifically enforce the provisions
of this chapter.
