[1972 Code § 2-5.1; New]
The Council shall appoint a Municipal Clerk for the term of three years or until the appointment and qualification of a successor. Prior to appointment, the Clerk shall have been qualified by training and experience to perform the duties of a Municipal Clerk. No person shall be appointed or reappointed as a Municipal Clerk unless that person holds a Registered Municipal Clerk Certificate issued pursuant to N.J.S.A. 40A:9-133.3 or 40A:9-133.4. The Clerk shall serve as Clerk of the Council and have such other functions, powers and duties as are provided for by the Charter and Code.

The Municipal Clerk shall:
a. 
Keep the minutes and records of the proceedings of the Council.
b. 
Preserve and compile all ordinances and resolutions and at the close of each year, with the advice and assistance of the Township Attorney, the Clerk shall compile, codify and bind all the ordinances and resolutions then in effect, and shall properly index the compilation or codification and provide for its publication.
c. 
Serve as Records Custodian and have and take custody of all official books, papers and documents of the Township for which no other repository is provided by Charter or ordinance, and preserve and keep them safely.
d. 
Provide secretarial and clerical services for the Members of Council in the discharge of their official duties.
e. 
Be the custodian of all deeds, etc., received by the Board of Adjustment.
f. 
In compliance with the Open Public Records Act, provide access to documents as permitted in the Act and collect fees as required.

The Municipal Clerk shall cause the Municipal Seal to be affixed to instruments and writings when specifically authorized by law or when necessary to exemplify any document or record in the Clerk's office, or to certify an act or paper which, from the records of that office shall appear to be a true copy of any public record or proceeding. The Clerk shall not affix the seal or cause or permit it to be affixed to any instrument or writing or other paper except as provided in this section, unless required by law.

The Municipal Clerk shall publish ordinances as required by law and shall file the requisite proofs of publication in the Clerk's office.

The Municipal Clerk shall issue and deliver, with the assistance of the Police Department, if needed, all notices of meetings required to be given to the Council and shall promptly inform the members of the Council of action taken by the Mayor with respect to any ordinance.

The Clerk shall administer licenses pursuant to the provisions of this Code. The Police Department shall assist in the inspection and enforcement procedures required for licensing.

The Municipal Clerk shall receive and transmit all communications to or on behalf of the Council.

The Municipal Clerk shall charge and receive for the use of the Township all fees for searches, transcripts and certifications as shall be authorized by resolution of the Council, and shall collect fees in accordance with the provisions of O.P.R.A.

The Municipal Clerk shall also:
a. 
Perform all the functions required of Municipal Clerks by the general election law and any other law or ordinance and receive for municipal use all fees prescribed.
b. 
Be authorized and responsible for the approval or denial of all applications for raffle and bingo licenses and issuance of said licenses.

c. 
Have all additional functions, powers and duties as may be prescribed by law, ordinance or resolution.

The Municipal Clerk shall be the depository and custodian of all official surety bonds furnished by or on account of any Township office, officer or employee, except his own bond, which shall be placed in the custody of the Chief Financial Officer. The Clerk shall also be the custodian for all formal contracts for work, labor, services, supplies, equipment and materials to which the Township may be a party; all leases of property owned by the Township; and have custody of all performance bonds running to the Township as obligee, and other forms of non-cash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Township.

There shall be a Deputy Municipal Clerk, appointed by the Council, who shall have, exercise and perform the functions, powers and duties of the Clerk in the absence or upon the direction of the Clerk.

The Community Development Director, or other person so designated, shall prepare and issue certificates as to approval of the subdivision of land, pursuant to appropriate authority. Prior to the issuance of each certificate, the status of the relevant subdivision shall be ascertained from the records of the Planning Board maintained in the Department of Community Development and otherwise, as well as records in the Office of the Clerk.

Correspondence and other communications received shall be delivered to the Municipal Clerk's Office, where it shall be sorted and delivered immediately to the proper department without opening when the address is to a specific department or person. General municipal mail and mail addressed to the Council shall be opened in the Clerk's Office and the Clerk shall either reply to the correspondence and provide information requested or refer the matter to the appropriate individual, department, board or body.
