Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle N.J.S.A. 39:1-1
et seq. shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a. The
Chief of Police, is hereby authorized to provide by regulation for
the closing of any street or portion thereof to motor vehicle traffic
on any day or days whenever he finds that such closing is necessary
for the preservation of the public safety, health or welfare.
b. Any regulations promulgated by the Chief of Police and in accordance with Subsection
a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated hereunder shall be punished
by a fine not to exceed $50.
d. Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace office may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage,
which may result from such removal before regaining possession of
the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty as prescribed by law or such penalty as established in §
1-5 of this Code.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

The provisions of this chapter shall be enforced by any law
enforcement officer who is a member of the Avalon Police Department
as well as by any other law enforcement officer having jurisdiction.
In addition to the foregoing, certain provisions of this chapter shall
be enforced by any sworn member of the Avalon Fire Police.
Traffic controls for street and highway construction and maintenance
operations.

The Borough Council finds and declares that problems of traffic
control occur when traffic must be moved through or around street
construction, maintenance operations and utility work, above or below
the ground which requires blocking the street and obstructing the
normal flow of traffic; and that such obstructions are or can become
dangerous when not properly controlled. In order to better promote
the public health, safety, peace and welfare, it is necessary to establish
controls and regulations directed to the safe and expeditious movement
of traffic through and around construction and maintenance zones and
to provide safety for the work forces performing these operations.
The Borough of Avalon; in the County of Cape May, State of New
Jersey does hereby adopt the current Manual on Uniform Control Devices
for Streets and Highways hereafter known as the M.U.T.C.D., except
as hereby supplemented and amended, as it controls and regulates whenever
construction, maintenance operations or utility work obstructs the
normal flow of traffic. Any person, contractor or utility that fails
to comply with the provisions of the M.U.T.C.D. while performing such
work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under the public utility
agreement, wishing to conduct work on, under or above the street to
contact the Police Department of the Borough of Avalon in order to
arrange a pre-construction meeting and submit plans for the safe movement
of traffic during such period of construction or work. Any person,
contractor or utility who fails to comply with this section prior
to the start of such work, or whose plans are not approved by the
Police Department of the Borough of Avalon is in violation of this
section.

The person, contractor or utility shall provide at least two
(2) emergency contact telephone numbers to be called in case of emergency
problems at the construction or maintenance site prior to the start
of any work. If, for any reason, emergency contact must be made, or
if the emergency contact person does not respond to a call from the
Police Department to correct such hazardous condition, the Police
Chief may respond to correct the hazardous condition(s). The reasonable
fees for such emergency services by the Borough shall be charged to
the person, contractor, or utility responsible for the condition.

There shall be no construction, maintenance, operations, or
utility work on any roadway in the municipality before the hour of
9:00 a.m. or after 4:00 p.m. The Officer in charge of the Borough
Police Department may adjust this time limit to permit work prior
to 9:00 a.m. or after 4:00 p.m. If the officer in charge determines
that the construction or maintenance operations prior to 9:00 a.m.
or after 4:00 p.m. would substantially delay traffic or cause a safety
or health hazard, the work shall then be permitted only between 9:00
a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Borough of Avalon Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Police Department that same is necessary
to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, back filling of open excavations and/or related
work, in order to abate any nuisance and/or safety hazard or for any
violation of this section.

It is to be expressly understood that no materials, vehicles
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, light devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than $100 nor more than $500 and/or be imprisoned
in the County Jail for a term not exceeding 90 days. For a second
offense, upon conviction thereof, pay a fine of not less than $250
and/or be imprisoned in the County Jail for a tern not exceeding 90
days.
A separate offense shall be deemed committed on each day during
or on which violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other, more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a. Upon
the declaration of an emergency, there shall be no parking upon the
streets where temporary EMERGENCY NO PARKING signs are displayed.
The Chief of Police or, in his absence, the ranking police officer
is authorized to declare an emergency and to direct the posting of
EMERGENCY NO PARKING signs when weather conditions, accidents, road
construction, fire or public celebrations dictate or require avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that EMERGENCY NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle,
which has been parked prior to the posting of the signs.
b. The
effectiveness of this section is contingent upon the signs being erected
as required by law.

a. Whenever snow has fallen and the accumulation is such that it covers
the streets and highways, an emergency shall exist and no vehicle
shall be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after the snow
has ceased until the streets have been plowed sufficiently and to
the extent that parking will not interfere with the normal flow of
traffic.
b. Any unoccupied vehicle parked or standing in violation shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic
and any police officer may provide for the removal of such vehicle.
The owner shall pay the reasonable costs of the removal and storage,
which may result from such removal before regaining possession of
the vehicle.

traffic sign or signal, no operator of a vehicle shall stand or park

seventy-five (75) feet of said entrance, when properly signposted;
l. Alongside or opposite any street excavation or obstruction when stopping,
standing, or parking would obstruct traffic, when properly signposted;
m. On the roadway side of any vehicle stopped or parked at the edge
or curb of a street;
n. Upon any bridge or other elevated structure upon a highway, or within
a highway tunnel or underpass, or on the immediate approaches thereto
except where space for parking is prohibited;
o. In any place on public or private property appropriately marked for
vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5,
N.J.S.A. 52:27D-119 et seq. or any other applicable law unless the
vehicle is authorized by law to be parked therein and a handicapped
person is either the driver or a passenger in that vehicle. State,
County or municipal law enforcement officers or parking enforcement
authority officers shall enforce the parking restrictions on spaces
appropriately marked for vehicles for the physically handicapped on
both public and private property.
No person shall move a vehicle not lawfully under his control
into any such prohibited area or away from a curb such distance as
is unlawful.

The Borough of Avalon is a barrier island resort community located
on the Atlantic Ocean in Cape May County, New Jersey with a year-round
population of approximately 2,264 residents. It has a total of 5,436
dwelling units. The summer population increases to 32,000 or more
than a fifteen fold increase. (Source: Cape May County Comprehensive
Plan issued by the Cape May County Planning Board for 2010.)
This increase of population during the summer months places
an increased demand on all municipal services and infrastructure.
It creates a demand for rental accommodations and results in a tremendous
increase in vehicular traffic. Parking spaces are in demand and in
short supply throughout the Borough and particularly in residential
areas where there is frequently insufficient off-street parking with
the result that owners, visitors and their guests must use on- street
parking.
The demand for on-street parking is further compounded by the
fact that many non-residents from surrounding mainland communities
visit the Borough on a daily basis to utilize the Borough beach, marinas,
athletic fields and other recreational and open-space facilities.
This results in a heightened demand for seasonal parking.
For these, and other reasons, the Borough Council has determined
that certain parking restrictions are necessary during the summer
season which generally extends from early May until late September.
At the same time, it is necessary to recognize the ongoing needs of
certain commercial operations and the services they provide to the
Borough's residents and visitors and not unduly restrict their normal
operations.

a. For purposes of this section the following definitions, as contained
in N.J.S.A. 39:1-1 shall apply:
CONSTRUCTION TOOL TRAILERS
shall mean every utility trailer commonly known as such and
containing tools, materials or supplies for contractors, sub-contractors
and other craftsmen, and which may be parked on or at or near construction
sites but only during the period of actual construction and only during
the period of time when a particular contractor, sub-contractor, or
craftsmen who owns or leases such vehicle is actually engaged in working
on the project. Such trailer shall contain the Contractor's name and
New Jersey State License Number which shall not be less than three
inches in height and permanently affixed to each side of the trailer
vehicle in such a manner and location to be clearly observable when
the trailer doors are open and shall not be otherwise obscured. In
the absence of such identifying information, the trailer shall not
meet this definition.
POLE TRAILER
shall mean every vehicle without motive power designed to
be drawn by another vehicle and attached to the towing vehicle by
means of a reach, or pole, or by being boomed or otherwise secured
to the towing vehicle, and ordinarily used for transporting long or
irregularly shaped loads, such as poles, pipes, or structural members
capable, generally, of sustaining themselves as beams between the
supporting connections. [N.J.S.A. 39:1-1 et seq.]
RECREATION VEHICLE
commonly referred to as an RV, shall mean a self-propelled
or towed vehicle equipped to serve as temporary living quarters for
recreational, camping or travel purposes and used solely as a family
or personal conveyance. This definition shall include the terms "camping
trailer" and "truck camper" as those terms are defined in N.J.A.C.
8:22-1.2. All of these terms are intended to be encompassed within
the definition of "trailer-type vehicle" as defined in this section.

SEMITRAILER
shall mean every vehicle with or without motive power, other
than a pole trailer, designed for carrying persons or property and
for being drawn by a motor vehicle and so constructed that some part
of its weight and that of its load rests upon or is carried by another
vehicle. [N.J.S.A. 39:1-1 et seq.]
STREET
shall mean any municipal, County or State road or highway
including the right-of-way which is located within the boundaries
of the Borough of Avalon.
TRAILER
shall mean every vehicle with or without motive power, other
than a pole trailer, designed for carrying persons or property and
for being drawn by a motor vehicle and so constructed that no part
of its weight rests upon the towing vehicle. [N.J.S.A. 39:1-1 et seq.]
b. The following definitions are not defined by the New Jersey Motor
Vehicle Code but as used in this chapter and section shall have the
following definition:
TRAILER-TYPE VEHICLE
is intended as an all-inclusive term and shall be used herein
to describe, collectively, each of the several trailer types defined
in this section, and whenever said term is used in this section shall
mean and shall encompass each and every such trailer defined in this
section. It shall include recreational vehicles commonly known as
RV's, campers and any other similar type vehicle equipped for sleeping
of one or more persons. This term shall not include boat trailers
and water-craft trailers.
UTILITY TRAILER
shall mean any class 1 through class 4 ball hitch or pintle
hitch towable trailer vehicle, whether the same is enclosed or open
and any and every trailer or type of trailer, which is not otherwise
defined in this section, and which is used for the storage, hauling
or transportation of any items or animals. This term shall not include
boat trailers and water-craft trailers.

a. Effective May 1, 2019, it shall be unlawful for any person or entity
to park any trailer-type vehicle, as defined herein, on any Borough
street commencing at 12:01 a.m. on the third Monday in June through
and including 12:00 midnight of the second Sunday in September and
including Memorial Day and the Saturday and Sunday immediately preceding
Memorial Day.
b. Exception. The provisions contained in Subsection
a shall not apply to:
1. Semitrailers, construction trailers, storage trailers; trailer-type
vehicles; and construction tool trailers: construction machinery and
construction equipment.
(a)
In-season: Under no circumstances may any semitrailer or any
trailer-type vehicle, including construction tool trailers, be parked
on the public streets or public thoroughfares at any time during the
in-season as defined in this chapter; provided, however, that such
trailers may be parked on the actual construction site or in the construction
zone. If not parked or located in either of such areas the same must
be removed from the street and may not return thereto until the time
scheduled for the resumption of construction activity. Such trailers
may, however, be parked at construction sites and in the immediate
vicinity thereof, that is, within 200 linear feet of the actual construction
site, during those hours and times that construction activity is permitted.
Under no circumstances may the area of the public sidewalk or any
part thereof be blocked. For purposes of this chapter, the term "immediate
vicinity" shall mean within 200 linear feet of the actual construction
site.
(b)
Off-season: Except when and where a construction zone has been
established pursuant to this chapter, the in-season parking restrictions
shall not apply. Whenever such a zone has been established in the
off-season, the parking restriction applicable to in-season shall
apply.
2. Boat and watercraft trailers which shall not be parked on any Borough
street from 12:01 a.m. on June 1 through and inclusive of 12:00 midnight
on September 30 of each year.
3. Trailer-type vehicles which are making deliveries or providing any
service to any business or residence may be parked temporarily and
only for brief time periods while engaged in such activity.
c. Street Parking. When parked on any street a construction tool trailer
and all other trailer-type vehicles shall be parked so as to conform
to the requirements of the New Jersey Motor Vehicle Code, N.J.S.A.
39:1-1 et seq. (Cross reference: § 20-7.9)
d. Disputes. Any dispute that arises as to whether a particular contractor,
subcontractor or other craftsman is actually and actively then currently
engaged in the particular construction project shall be resolved by
the Construction Official, whose decision shall be final.

a. Definitions. As used in this subsection:
BOAT TRAILER AND WATERCRAFT TRAILER
shall mean any vehicle without mode of power that is required
to be or is capable of being pulled, towed, or drawn by another vehicle
and which is designed or used for carrying, hauling or transporting
power boats, sailboats, wave runners, jet skis or any other type of
vehicle used in or on the water.
b. Boat and watercraft trailers when parked on the street must be parked
so as to conform to the requirements of the New Jersey Motor Vehicle
Code, N.J.S.A. 39:1-1 et seq.
c. Parking of Boat Trailers and Watercraft Trailers Prohibited Between
June 1 and September 30. No person shall park, store, or permit the
parking or storage of boat trailers or watercraft trailers (attached
or detached) of any type or description, regardless of whether such
trailer is licensed and/or registered, and regardless of whether a
boat or other watercraft is currently located on the trailer, on any
municipal, state or county roadway in the Borough of Avalon between
June 1 and September 30 of each year inclusive of such dates.
d. Parking of Boat Trailers and Watercraft Trailers between October
1 and May 31. Between October 1 and May 31 the owner of a boat trailer
or watercraft trailer (attached or detached) may park the trailer
directly in front of, and immediately adjacent to, the curb or property
line of any property owned by the trailer owner, or lessee or occupied
by the trailer owner or lessee as a tenant under a written lease,
with the owner of the property.
e. Posting of Signs. Signs shall be established at Avalon entrance points
indicating that parking of boat and watercraft trailers on Borough
streets is prohibited between June 1 and September 30 and is restricted
as provided herein between October 1 and May 31.

a. Whenever a "construction zone" (as defined in Chapter
20, Article
II, § 2.16) is in existence, only construction vehicles or construction equipment may be parked in such zone. Any other motor vehicles are prohibited from parking in such zone.
b. The use of such zone is restricted to licensed commercial motor vehicles which clearly display the contractor's name and business, the state contractor's license number issued by New Jersey or another state, and telephone contact information. Any vehicle failing to meet these criteria shall be prohibited from parking in said zone and subject to being towed in accordance with §
8-3 of this Code.
c. Any unauthorized vehicle parked in a construction zone is subject to being towed at the owner's expense in accordance with §
8-3 of this Code.

a. Boat Trailers and Watercraft Trailers. Penalty. The owner of any
boat trailer or watercraft trailer who parks that trailer in violation
of the provisions of this subsection shall be subject to the following:
1. A fine in the amount of $200 for each violation. In addition, the
Borough, at its option, may arrange for the towing of the trailer
off of the public street, with the cost of any towing or storage fee
to be paid by the owner of the trailer.
2. If the trailer is incapable of being towed for any reason including,
but not limited to, the trailer being attached to a motor vehicle
that prevents the trailer from being towed, the owner shall pay a
fine in the amount of $300 for violation.
3. Separate violations. Each day, or part of a day, that a boat trailer
or watercraft trailer is parked in violation of this subsection shall
be considered a separate violation. It shall not be a violation of
this subsection for a person to park, store, or permit the parking
or storage of boat trailers or watercraft trailers on private property.
b. Penalty for Other Violations. The penalty for any other violation, that is, for which a specific penalty is not established in this chapter, shall be the general penalty imposed in the Code of the Borough of Avalon, Chapter
1, §
1-5.

a. Pursuant to N.J.S.A. 40:67-16.1 the Borough hereby establishes a
designated truck route within the Borough. This determination is necessary
in order to facilitate the orderly and safe movement of truck traffic
at all times but particularly in the summer months, when the Borough
experiences a twenty-fold increase in population and a corresponding
increase in vehicular, bicycle and pedestrian traffic. Such designated
truck route will serve to diminish traffic congestion and will promote
public safety and convenience. The Borough Council finds, determines,
and concludes that the designated route complies with the requirements
of N.J.S.A. 40:67-16.3 insofar as the designated route connects with
a County road (Avalon Boulevard CR 601) which provides entrance to
and exit from the Borough.
b. All trucks having a total combined gross weight of vehicle plus load
in excess of four tons shall be excluded from all streets of the Borough,
except for the designated truck route and except as otherwise provided
herein.
c. Nothing in this chapter shall be construed to prevent such trucks
from making deliveries or pick-up of merchandise or other property
along streets from which such trucks are excluded nor shall it exclude
trucks used by public utility companies in connection with the construction,
installation, operation or maintenance of public utility facilities
as permitted by N.J.S.A. 40:67-16.2. This section shall be subject
to the following:
1. Upon completion of the local pick-up or delivery of merchandise or
other property, such truck shall return to the designated truck route
by the shortest and most direct route available.
2. Those vehicles making more than one pick-up or delivery shall return
to and use the designated truck route between deliveries whenever
it is possible to do so.

Whenever the Borough has designated a construction zone at an active construction site within the Borough, in accordance with the provisions of Chapter
20 of this Code, parking shall be restricted to the following:
a. Construction vehicles only which are owned, leased or operated by a general building contractor or subcontractor, craftsman or repairman (hereafter collectively "contractor") who is/are at the time actively involved in the construction activity. Any such vehicle shall be plainly and permanently marked with the contractor's name, state contractor's license number, and telephone contact number. "Construction vehicles" shall mean a commercial motor vehicle used for commercial purposes on the highways, such as the transportation of goods, wares and merchandise, excepting such vehicles as are run only upon rails or tracks and vehicles of the passenger car type used for touring purposes or the carrying of farm products and milk, as the case may be (N.J.S.A. 39:1-1). The term shall also mean and include any of the several type vehicles mentioned in §
8-16.3 of this Code whenever such vehicle is used, either directly or indirectly, in the construction process.
b. "Construction equipment" which shall include equipment which is being actively used in the construction activity and which is not licensed or otherwise permitted to operate independently on the streets and highways of this state and which must be transported to a construction site by means of another motor vehicle which is licensed for operation of the streets and highways of this state. Construction equipment shall also include dumpsters which continue to require a Borough permit to be placed in the Borough street even in that area designated as a construction zone. Other examples of construction equipment may include, but are not limited to, loaders, excavators, boom lifts, sky lifts, front-end loaders, skid steers and other similar-type equipment. Construction equipment does not include portable toilets, which must be located on the actual construction site in accordance with the provisions of Chapter
20 of this Code.
c. The contractor shall be responsible for erecting signs to be provided by the Borough and to be erected at the outer limits of each construction zone. Such signs shall be maintained by the contractor throughout the construction process. Such signs shall indicate that parking within such construction zone is limited to authorized vehicles and equipment only, that is, only those vehicles and equipment specified in Subsections
b and
c hereof. Such signs shall be removed by the contractor upon application for a temporary or final certificate of occupancy.
d. The owner, lessee or operator of any unauthorized vehicle parked in the construction zone shall be in violation of this chapter and, upon conviction, shall be liable for such penalties as prescribed in §
1-5 of this Code. In addition, any unauthorized vehicle shall be subject to being removed by any police officer or code enforcement officer who may provide for such removal. The owner of any unauthorized vehicle which is towed from a construction zone shall bear the reasonable costs of removal and storage, which may result from such removal before regaining possession of the vehicle.

In accordance with the provisions of N.J.S.A. 39:4-197, no person
shall park a motor vehicle in any of the hereinafter designated locations
unless such persons shall have been issued special identification
cards by the New Jersey Motor Vehicle Commission and when using a
motor vehicle on which is displayed a certificate, for which a special
vehicle identification card has been issued pursuant to N.J.S.A. 39:4-206.
Procedure for Application and Approval of Handicapped Parking
at Private Residences (on street).
Reserved parking spaces restricted only to handicapped individuals
shall be established in accordance with the following:
a. An applicant for a reserved parking space in front of a private residence
shall make application to the Chief of Police, or his designee, of
the Borough of Avalon. It shall be the sole responsibility of such
applicant to provide to the Chief of Police all documentation and
forms necessary or required to establish the nature and extent of
the handicap. The Chief of Police shall review such documentation
for compliance with the terms and conditions imposed by New Jersey
Statute and the rules and regulations of the Motor Vehicle Commission
of the State of New Jersey.
b. Upon a determination that the applicant is qualified for a reserved
parking space restricted to handicapped persons, the Chief of Police
shall file with the Borough Clerk a certification as to the applicant's
eligibility and the Chief shall certify that based upon his investigation,
the applicant is qualified for a handicapped parking space to be established
at the applicant's residence.
c. Upon receipt of the Certification of the Chief of Police, the Borough
Clerk shall inform the Borough Council, which shall thereupon adopt
a formal resolution which shall establish a reserved parking space
restricted only to handicapped, which resolution shall further designate
the location or address where such restrictive parking shall be established.
The reserved parking shall be eliminated and the restrictive parking
signs removed once the handicapped condition no longer exists or the
applicant no longer qualifies.
d. The resolution adopted by Borough Council pursuant to this ordinance
shall have the force and effect of law and any violation of such resolution
shall be prosecuted in the Municipal Court, or other Court of competent
jurisdiction, in the same manner and to the same extent as other motor
vehicle violations.

Whenever it has been determined that a need exists for one or
more restricted "Handicapped Only" parking spaces on any public street,
public parking areas or similar public and quasi-public places within
the Borough, the Chief of Police shall so certify and file such certification
with the Borough Clerk, who shall then notify Borough Council which
shall then consider the matter and if satisfied that such need exists,
may adopt a formal resolution approving the restricted parking and
designating the location(s) thereof. Any such restricted parking space
may be eliminated by the adoption of a formal resolution by Borough
Council upon the recommendation of the Chief of Police.

a. Any person
parking a motor vehicle in a restricted parking space without special
vehicle identification card shall be liable to a fine of $250 for
the first offense and, for subsequent offenses, a fine of at least
$250 and up to 90 days' community service on such terms and in such
form as the court shall deem appropriate, or any combination thereof.

b. A person violating any other provision of this chapter shall, upon conviction, be subject to the penalty provisions set forth in §§
1-5.1 through
1-5.5 of the Borough Code unless a different penalty is expressly provided by a specific New Jersey statute or Borough ordinance or this Code, in which case the designated penalty so indicated shall apply.

A. PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN MUNICIPALITY OWNED
PROPERTY
No person shall park, stop or stand a motor vehicle at any time
between the hours hereinafter specified, prevailing time, on any of
the following described municipally owned property.

Effective January 1, 2024, parking shall be prohibited between
the hours of 10:00 p.m. and 8:00 a.m. the following morning except
for municipal vehicles and Borough employees, elementary school employees,
and volunteers with a special permit issued by the Borough.

Such special permits shall be issued only to those Borough employees
who physically work in the Borough Hall and to Avalon Volunteer Fire
Department firefighters who are certified by the Chief of the Avalon
Volunteer Fire Department and emergency medical technicians (EMTs)
who are certified by the Chief of Emergency Medical Services and to
employees of the Avalon Elementary School who are certified by the
Chief School Administrator.

Any vehicle parked or standing in violation of this section
shall be in violation hereof and any police officer may provide for
the removal of such vehicle. The owner shall pay the reasonable costs
of the removal and storage, which may result from such removal before
regaining possession of the vehicle.

B. SPECIAL PERMIT ZONES
Parking shall be prohibited in the following locations unless
a special permit authorizing such parking has been obtained from the
Chief of Police of the Borough of Avalon.

a. Regulation for Parking of Vehicles on Municipal Park Property During
Certain Hours.

The Borough Council of any municipality may, by ordinance, authorize
the Mayor or other chief executive officer of the municipality, or
the officer in charge of streets in any municipality not having a
chief executive officer, if he shall find that a safety problem exists
for ingress and egress to any public or private school or for the
provision of recreational facilities for children attending such school,
or both, due to a lack of a suitable area surrounding the school,
to close by regulation any portion of any street within the block
upon which such school is located to the use of through traffic during
such time as he shall determine, not to exceed 1 hour between 7:30
a.m. and 10:00 a.m., 2 hours between 11:00 a.m. and 2:00 p.m., and
1 hour between 2:30 p.m. and 4:30 p.m., on any days upon which such
school is in session, and to permit the use of said portion of said
street, during said hours, for ingress and egress to such school and
for the use by the pupils of such school for recreational purposes
under proper supervision, and to provide adequate police facilities
for such supervision and for the control of traffic upon such portion
of said street, which ordinance shall provide for the posting of proper
warning signs in said street, indicating that said street is so closed
and the purpose thereof, during the time when the same is so closed,
and shall provide penalties for the violation of terms of such ordinance
or of any regulation promulgated thereunder.
