A minimum elevation of 8.5 feet North American Vertical Datum of 1988 (NAVD 88) shall be established for new construction bulkheads in and along the bayside, nonoceanic areas of the City; and
Bulkhead elevation may be modified only through approval of the City Engineer for bona fide purposes consistent with an engineering need.

A. 
Unimproved bayfront property without existing bulkheads shall be required to have constructed bulkheads to the City minimum standards and in accordance with requirements of the New Jersey Department of Environmental Protection.
B. 
When notified by the City of a nonbulkheaded condition, the owner of unimproved bayfront land shall submit a plan of corrective action to the City no later than 30 days from the receipt of the notice and, when approved, the property owner shall complete all construction within nine months.
C. 
In the event the owner of unimproved bayfront land fails to submit a corrective action plan, or fails to implement such plan following approval by the City, the City shall have the option to take corrective action, including the construction required, and such costs of construction shall become a lien against the property.
D. 
The requirements herein shall not apply to residentially improved bayfront property.
