For the purposes of Chapter 418, Articles I through VI, the following words and phrases shall have the meanings set forth below:
ACT 101
The Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, 53 P.S. § 4000.101 et seq.
ACT 90
The Pennsylvania Waste Transportation Safety Act of 2002, 62 P.S. § 6201 et seq.
ACT 97
The Pennsylvania Solid Waste Management Act of 1980, 35 P.S. § 6018.101 et seq.
ALUMINUM
All-aluminum scrap or empty beverage and food containers.
ASHES
The residue resulting from the burning of wood, coal, or other combustible material. This definition excludes ashes from industrial processes.
AUTHORIZED COLLECTOR
A person, individual, partnership, corporation, or employer or agent thereof authorized by contract with the municipality to collect solid waste from residential, commercial, and institutional properties, as herein defined, under the terms and conditions of this chapter. In the event of municipal collection, this definition shall include the Board of Supervisors and employees thereof.
BIMETALLIC CANS
Empty food or beverage containers consisting of ferrous sides and bottoms and aluminum tops.
BULK WASTE
Large items of solid waste, including, but not limited to, appliances, furniture, and tree branches, which require collection in other than conventional compactor solid waste collection vehicles.
COLLECTOR
Any person, firm, partnership, corporation, or public agency who is engaged in the collection and/or transportation of solid waste and/or recyclable materials in the municipality.
COMMERCIAL PROPERTIES
All properties used for industrial or commercial purposes. Multiple-dwelling residential buildings containing more than four dwelling units shall be treated as commercial properties.
COMMUNITY ACTIVITY
Events that are sponsored by public or private agencies or individuals, that include, but are not limited to, fairs, bazaars, socials, picnics, and organized sporting events attended by 200 or more individuals per day.
COMPOSTING
A controlled microbial degradation of organic waste to produce a relatively nuisance-free product of potential value as a soil conditioner.
COMPOSTING PLANT
A facility used for composting.
CONTAINER
A can, mechanical bin, box, or disposable container used for the storage of solid waste or recyclable materials.
CORRUGATED PAPER
Structural paper material with an inner core shaped in ridged parallel furrows and ridges.
COVERED ELECTRONIC DEVICES
Desktop computers, laptop computers, computer monitors, computer peripherals, televisions, tablets, e-readers, and other similar devices, as set forth in the Covered Device Recycling Act, 35 P.S. § 6031.101 et seq.
CURBSIDE RECYCLING COLLECTION
The scheduled collection and transport of recyclable materials placed at the curb or street line by residential property owners.
DISPOSAL
The deposition, injection, dumping, spilling, leaking, or placing of solid waste into or onto the land or water in a manner that the solid waste or a constituent of the solid waste enters the environment, is emitted into the air, or is discharged to the waters of the commonwealth. Disposal facilities include, but are not limited to, municipal waste landfills and construction/demolition waste landfills as defined by the following: Act 101; Act 07; and PA DEP rules and regulations, as set forth at 25 P.S. §§ 75 and 272.
DISPOSAL SITE OR FACILITY
A site, location, tract of land, area, or premises used or intended to be used for solid waste disposal. Disposal sites or facilities include, but are not limited to, solid waste landfills and construction/demolition waste landfills as defined by Act 101, Act 97, and/or PA DEP rules and regulations (25 Pa. Code, Chapters 75 and 271).
DUMP
A site for the consolidation of waste from one or more sources, which has little or no management.
FARM PROPERTY
A parcel or parcels of land devoted primarily to agriculture, either to raising crops, livestock, poultry or pasture.
GARBAGE (FOOD WASTE)
Animal and vegetable waste resulting from the handling, preparation, cooking, and serving of goods. It does not include wastes from industrial processing or manufacturing of food products, bodies of dead animals, or human or animal excrement.
GLASS CONTAINERS
Bottles and jars made of clear, green or brown glass. Expressly excluded are noncontainer glass, plate glass, blue glass and porcelain and ceramic products.
HAZARDOUS WASTE
Solid waste that is especially harmful or potentially harmful to public health. This shall include, but not be limited to, explosives, toxic materials, and medical waste. For the purposes of this chapter, hazardous waste does not include small quantities of such waste available on a retail basis to homeowners (e.g., aerosol cans, pesticides, fertilizers, etc.).
HIGH-GRADE OFFICE PAPER
All white paper, bond paper and computer paper used in commercial, institutional and municipal establishments.
INCINERATOR
Any device used for the burning of solid waste where the factors of combustion (i.e., temperature, retention time, turbulence, and combustion air) can adequately be controlled.
INSTITUTIONAL PROPERTIES
Those properties that house or serve groups of largely unrelated people (e.g., hospitals, schools, and/or nursing homes).
LICENSED COLLECTOR
A person, firm, partnership, corporation, or public agency that has written authorization from the Pennsylvania Department of Environmental Protection ("PA DEP") under the Pennsylvania Waste Transportation Safety Act of 2002, 62 P.S. § 6201 et seq., to collect, haul, transport, and dispose of municipal waste.
MUNICIPALITY
The Township of Middletown, Bucks County, Pennsylvania.
MUNICIPALITY PROPERTY
Any and all real property owned, leased, or under the operation or control of the municipality.
NEWSPRINT
Paper of the type commonly referred to as "newspaper" and distributed at fixed or varying intervals. Expressly excluded, however, are all other paper products of any nature whatsoever.
OPERATOR
Any person who manages any solid waste storage, transfer, processing, or disposal operation.
PA DEP
The Pennsylvania Department of Environmental Protection.
PERSON
Any individual, firm, partnership, association, corporation, institution, or other entity.
PLASTIC
Empty plastic food and beverage containers. Due to the large variety of types of plastic, the recycling regulations may stipulate specific types of plastic which may be recycled.
PRIVATE COLLECTOR
A licensed collector that provides collection services to commercial or institutional properties on a private contract basis.
PROCESSING
Any technology used for the purpose of reducing the volume or bulk of solid waste or any technology used to convert part or all of such materials for off-site reuse. Processing facilities include, but are not limited to, transfer facilities, recycling facilities, composting facilities, and resource-recovery facilities.
RECYCLABLE MATERIALS
Those materials specified by the municipality for separate collection in accordance with recycling regulations. Such materials may include, but shall not be limited to, glass containers, aluminum, steel, bimetallic cans, high-grade office paper, newsprint, corrugated paper, and plastics.
RECYCLING
The separation, collection, processing, recovery, and sale or reuse of metals, glass, paper, plastics, and other materials which would otherwise be disposed of as solid waste.
REFUSE
All solid wastes, except body wastes, and shall include, but shall not be limited to, garbage, ashes, bulk waste, and rubbish; except that refuse shall specifically exclude hazardous waste and recyclables as defined by this chapter.
RESIDENTIAL PROPERTY
Properties used as dwellings, including buildings having up to four dwelling units in one building. Multiple-dwelling residential buildings containing more than four dwelling units, for purposes of this chapter, shall be treated as commercial properties.
RESIDUE
Solid materials remaining after burning, including, but not limited to, ashes, metals, glass, ceramics and unburned organic substances.
RUBBISH
Solid waste exclusive of garbage (e.g., nonrecyclable glass, metal, paper or plastic) and noncompostable plant material, wood or nonputrescible solid waste.
SALVAGE OPERATION
Any business, trade, or industry engaged, in whole or in part, in salvaging or reclaiming any product or material, including, but not limited to, automobiles, metals, chemicals, shipping containers or drums.
SALVAGING
The controlled removal of reusable materials at a salvage operation.
SANITARY LANDFILL
A PA DEP-approved method of disposing of solid waste on land without creating nuisances or hazards to the public health or safety. This is done by confining solid waste to the smallest practical volume and covering it with a layer of earth at the conclusion of each day's operation, or at such more-frequent intervals as may be necessary.
SCAVENGING
Uncontrolled or unauthorized removal of solid waste materials or recyclables.
SOLID WASTE
Garbage, rubbish, and refuse and other discarded solid materials, including, but not limited to, solid waste materials resulting from industrial, commercial and agricultural operation and from community activities. Liquids, semisolids, and contained gaseous materials are hereby defined as solid waste. It shall not include solid or dissolved material in domestic sewage or other significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial wastewater effluents, dissolved materials in irrigation return flows, or other common water pollutants. In addition, it shall not include hazardous waste.
SOLID WASTE MANAGEMENT
The purposeful, systematic control of the storage, collection, transportation, processing and disposal of solid waste and recyclables.
STEEL
Steel scrap or empty ferrous or tin food or beverage containers.
TOWNSHIP MANAGER
The duly appointed Township Manager of the Township of Middletown, Bucks County, Pennsylvania.
TRANSFER STATION
A fixed facility used for receiving solid waste from collection trucks and placing in large-volume, long-haul vehicles.
YARD WASTE
Prunings, grass clippings, weeds, leaves, and general yard and garden wastes.
