For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
APPLICANT
Any person who excavates or causes to be excavated trenches on and in the city streets.
TRENCHING
The excavation, pipelaying, backfilling and compaction of trenches dug in the city streets for the purpose of installing, maintaining, repairing and replacing underground pipelines, electric power lines and telephone lines, for water, both domestic and irrigation, sewer, electric, natural gas, telephone and other underground utility or service facilities which are installed in the streets.

No person shall do or cause to be done any trenching in the city streets without first obtaining a permit therefor from the director of public works, save and except for the following exceptions:
(a) 
Public utilities and public agencies which engage in trenching as a usual and ordinary part of their business or service shall not be required to obtain trenching permits, but shall inform the director of public works before the commencement of any trenching prior to commencing the trenching.
(b) 
Emergency repairs maybe made by trenching without first obtaining a permit therefor in the event such repairs become necessary in other than business hours; and further provided, that in such event the applicant shall apply for such permit during the next business day and pay the resurfacing fee, as provided in this article, at that time.

At the time of issuance of the trenching permit, the director of public works shall estimate the cost to the city of resurfacing the trenching, including paving as necessary, and the applicant shall pay such estimated cost to the city at the time of and as a prerequisite to the issuance of the permit.
The city shall resurface all trenching after compaction by the applicant, and the applicant shall be refunded that portion of the estimated cost in excess of the actual costs, if the actual cost is less than the estimated cost, and the applicant shall pay to the city any excess of the actual cost over the estimated cost.
Public utilities and public agencies which are exempt under the terms of this article from obtaining permits shall be billed monthly for the cost of resurfacing done by the city in the preceding month.

All trenching in the city shall be done under the following conditions and requirements:
(a) 
The applicant shall provide such lights, signs and barricades as to adequately protect the public from any danger as a result of the trenching.
(b) 
The applicant shall backfill trenches and compact backfill in accordance with specifications provided by the director of public works. Compaction shall comply with the city specifications for compaction within ten calendar days after completion of the installation, repair, replacement or maintenance of the pipelines, power lines, telephone or communication lines for which the trenching was made.
