A. Words and phrases. Whenever any word and phrases are used in this
chapter, the meaning respectively ascribed to them in Subtitle 1 of
Title 39 of the Revised Statutes of the State of New Jersey shall
be deemed to apply to such words and phrases used herein.
B. Official time standard. Whenever certain hours are named in this
chapter, they shall mean either Eastern Standard Time or Eastern Daylight
Savings Time, as may be in current use.
The Chief of Police of the Borough of Mount Arlington is hereby
authorized to provide by regulation for the closing of any street
or portion thereof to motor vehicle traffic on any day or days whenever
he finds that such closing is necessary for the preservation of the
public safety, health or welfare.
Any regulations promulgated by the Chief of Police and in accordance
with the paragraph above, shall provide for the posting of proper
warning signs of such closing on any street or portion thereof during
the time the same is closed in pursuance thereof.
Any violation of this regulation promulgated thereunder shall
be punished by a fine not to exceed $50.
Any regulation adopted that mandates the closing of any street
for a period greater than 48 consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

A. Definitions. The following term shall have the meanings indicated:
BLOCK
A designated area within which the public streets shall be
closed for a neighborhood party, celebration or event, but shall not
include a garage sale, yard sale, bazaar, rummage sale or other similar
activity having the principal purpose as fundraising for an individual
or organization, nor shall it include a political meeting or rally,
carnival or theatrical or musical performance such as rock concerts
or similar events.
STREET
A borough street, highway or road.
B. Authorization to issue permit.
(1)
The Chief of Police shall be authorized to issue a permit for
the temporary blocking of a street for the purpose of holding a party
or festival. At least 21 to 30 days before the commencement of such
party, an application for such permit shall be filed by a bona fide
resident of the street to be blocked, who is over the age of 18 and
such application shall contact at least the following information:
(a)
Letter to all residents at each address affected by the closure
of that portion of the street providing notification of the planned
event.
(b)
Information submission to Chief of Police: Letter to the Chief
of Police requesting permit to conduct the block party shall include:
[1] Signature of adult residing at each address affected
by the closure of that portion of the street. Included should be their
street address as well as their printed name.
[2] Assure complete accessibility to area (roadways,
etc.) for emergency vehicles.
[3] Determination will be made by Mount Arlington Police
Department.
[4] Date and hours of operation and rain date (if applicable).
[5] Copy of Tax Map showing street location and surrounding
cross street(s) to be temporarily barricaded.
[6] In the case of a county road or state road, the
county and state must approve of same.
[7] Hold Harmless Agreement in a form acceptable to
the Borough Attorney to be signed by all organizers.
[8] Contact information of person in charge of the
block party; name and phone number.
(c)
Notification to Public Works at least 72 hours prior to event
to drop off movable barricades based upon availability (a $50 refundable
deposit will be required).
(d)
Notification to Public Works on next business day to request
pickup of movable barricades.
(2)
The application may require such additional information as the
Borough Council prescribed by resolution.
C. Fee and determination of approval or disapproval of application.
The application shall be accompanied by a fee in the amount of $25.
Such fee shall be refundable in the event that the permit is denied.
The permit shall be granted by the Chief of Police upon determining
that the block party is authorized and responsible. The permit shall
be denied if the Chief of Police finds that blocking the street or
portion thereof on the date requested in the application will unduly
interfere with the flow of vehicular traffic or upon determining that
the block party is not authorized. The Chief of Police shall advise
the applicant, in writing, of the reason for the denial of the application.
In the event of denial, the applicant may appeal the denial
to the governing body. Such Appeal shall be submitted along with the
reasons therefor within three days of receipt of the denial. Such
appeal shall occur at the next regularly scheduled meeting of the
governing body, unless there shall be a special meeting prior to that
time.
D. Validity of permit. A permit issued pursuant to this section shall
be valid only for the date and the hours specified thereon, which
shall not be before 8:00 a.m. or after 11:00 p.m.
E. Regulated activities.
(1)
During the conduct of a block party the following activities
are hereby prohibited:
(a)
Sale or consumption of alcoholic beverages on the public street
or sidewalks.
(b)
Sale of food without first obtaining the authorization and inspection
of the Board of Health.
(2)
The block party participants should be mindful of Chapter
118, the Noise Ordinance of the borough.
(3)
The block party must be peaceful and n good order and otherwise compliant with chapter
127 of the Code regarding Peace and Good Order.
F. Clean-up after block parties. The applicant shall be responsible
for removal of litter, debris and other materials from the street
or portion thereof used for the block party, which is attributable
to or caused by the block party.
G. Obstacles blocking streets to be movable. A street or portion thereof
blocked off for a block party shall not be obstructed by obstacles
which cannot be readily moved to allow emergency and hazard vehicles
to enter it in response to an emergency.
H. Limit on number of permits. No more than two permits shall be granted
by the Chief of Police in any calendar year for the same block or
blocks.
I. Liability. The persons, organization or association to whom the permit
is issued shall be liable for all losses, damages or injuries sustained
by any person, whether a participant or spectator at the block party
or recreational event, whether or not said losses, damages or injuries
arise by reason of the negligence of the person, persons or organization
to whom such permit shall have been issued. The Chief of Police shall
require the applicant to enter into a Hold Harmless Agreement, which
agreement shall provide that the applicant shall agree to save and
hold the Borough of Mount Arlington harmless of and from any and all
obligations and liabilities which may arise from the temporary street
closing which represents the subject matter of the application. The
applicant shall further agree as part of these provisions to hold
harmless the Borough of Mount Arlington and to defend at this own
cost and expenses any claims or lawsuits instituted by third parties,
which obligations or liabilities might otherwise exist or be asserted
against the Borough of Mount Arlington. The Chief of Police shall
further have the option to require that, prior to the issuance of
a permit or commencement of the temporary street closing, the applicant
submit evidence of liability insurance covering damages to property
and injuries to members of the general public arising out of the temporary
street closing in such amounts as may be determined by the Chief of
Police.
J. Penalties for offenses. Any person, firm or corporation who shall
violate any provision of this chapter shall, upon conviction, be subject
to a penalty of not more than $1,000 or imprisonment for a term not
to exceed 10 days, or both. Each day of violation shall constitute
a separate offense.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage,
which may result from such removal before regaining possession of
the vehicle.
Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereof shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days or both.
If any parts of this chapter are, for any reason, held to be
invalid, such decision shall not affect the validity of the remaining
portions of this chapter.
All former Traffic Ordinances of the Borough of Mount Arlington
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
A. Traffic controls for street and highway construction and maintenance
operations.
B. Adoption of the Manual on Uniform Traffic Control Devices for Streets
and Highways.
The Borough of Mount Arlington Borough Council finds and declares
that problems of traffic control occur when traffic must be moved
through or around street construction, maintenance operations and
utility work, above or below the ground which requires blocking the
street and obstructing the normal flow of traffic, and that such obstructions
are or can become dangerous when not properly controlled. In order
to better promote the public health, safety, peace and welfare, it
is necessary to establish controls and regulations directed to the
safe and expeditious movement of traffic through and around construction
and maintenance zones and to provide safety for the work forces performing
these operations.
The Borough of Mount Arlington in the County of Morris, State
of New Jersey does hereby adopt the current Manual on Uniform Control
Devices for street and highways hereafter known as the M.U.T.C.D.,
except as hereby supplemented and amended, as it controls and regulates
whenever construction, maintenance operations or utility work obstructs
the normal flow of traffic. Any person, contractor or utilities that
fail to comply with the provisions of the M.U.T.C.D. while performing
such work is in violation of this section.
C. Preconstruction meetings. It shall be the responsibility of the person,
contractor, or in the case of a public utility as required under the
public utility agreement, section 16:25-9.2, wishing to conduct work
on, under or above the street to contact the Police Department of
the Borough of Mount Arlington in order to arrange a preconstruction
meeting in order to submit plans for the safe movement of traffic
during such period of construction or work. Any person, contractor
or utility who fails to comply with this section prior to the start
of work, or whose plans are not approved by the Police Department
of the Borough of Mount Arlington is in violation of this section.
D. Hazardous conditions. The person, contractor or utility shall provide
at least two emergency contact telephone numbers to be called in case
of emergency problems at the construction or maintenance site prior
to the start of any work. If, for any reason, emergency contact cannot
be made or if the emergency contact person does not respond to a call
from the Police Department to correct the hazardous condition(s),
the Borough of Mount Arlington may respond to correct the hazardous
condition(s). The reasonable fees for such emergency services by the
Borough of Mount Arlington shall be charged to the person, contractor,
or utility responsible for the condition.
E. Hours. There shall be no construction, maintenance operations, or
utility work on any roadway in the borough before the hour of 9:00
a.m. or after 4:00 p.m., or on any Sunday. These restrictions may
only be adjusted by the Chief of Police. If it is determined by the
Chief of Police that the construction or maintenance operations prior
to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic
or cause a safety or health hazard, the work shall then be permitted
only between 9:00 a.m. and 4:00 p.m.
F. Road closing. Road closing and/or traffic detours shall not be permitted
unless approved by the Chief of Police.
G. Traffic directors. Traffic directors shall be posted at all construction
or maintenance sites when determined by the Chief of Police that same
is necessary to provide for the safe and expeditious movement of traffic.
H. Stop work. The Chief of Police shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, back filling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.
I. Site preparation. It is to be expressly understood that no materials,
vehicles or equipment are to be placed in the roadway or sidewalk
or right-of-way until all construction, signs, light devices and pavement
markings are installed.
J. Violations and penalties. Any person, contractor or utility who commits
a violation of this section shall, upon conviction thereof for the
first offense pay a fine of not less than $100 nor more than $500
and/or be imprisoned in the county jail for a term not exceeding 90
days.
For a second offense, upon conviction thereof, pay a fine of
not less than $250 and/or be imprisoned in the county jail for a term
not exceeding 90 days.
A separate offense shall be deemed committed on each day during
or on which violation occurs or continues.
K. Regulations not exclusive. The provisions of this chapter imposing
a time limit on parking shall not relieve any person of the duty to
observe other, more restrictive provisions, prohibiting or limiting
the stopping, standing or parking of vehicles as set forth in N.J.S.A.
39:4-138, any other New Jersey Statute or as hereinafter provided.
Upon the declaration of an emergency there shall be no parking
upon streets or sections of streets where temporary "EMERGENCY NO
PARKING" signs are displayed. The Chief of Police or, in his absence,
the ranking police officer is authorized to declare an emergency and
to direct the posting of "EMERGENCY NO PARKING" signs when weather
conditions, accidents, fires, public celebrations, etc. dictate or
require avoidance of hazards or other conditions which interfere with
the free flow of traffic. Notification that "EMERGENCY NO PARKING"
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
The effectiveness of this section is contingent upon signs being
erected as required by law.
A. Removal. Whenever snow has fallen and the accumulation is such that
it covers the streets and highways, an emergency shall exist and no
vehicle shall be parked on the streets or highways or portions thereof
indicated.
The above parking prohibitions shall remain in effect after
the snow has ceased and until the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
Any unoccupied vehicle parked or standing in violation shall
be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage, which may result from such removal before gaining possession
of the vehicle.

G. Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Sections
169-36C,

169-36E shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The owners of the premises referred to in this section
shall provide and install signs and pavement markings as required,
which signage and markings shall be in accordance with the current
Manual on Uniform Traffic Control Devices (MUTCD). The cost of signs
and installations shall be the responsibility of the owner of said

The penalty for a violation and conviction of this section shall

Restricted parking. No person shall stop or stand a vehicle
any time upon any of the streets or parts of streets designated.

Signs, posts and other materials. All signs, posts, or other
necessary materials shall be installed and paid for by the property
manager, or its successor in interest and they shall meet state and
federal specifications and the current Manual on Traffic Control Devices.
(h)
Fines and penalties. Unless another penalty is expressly provided
by New Jersey State Statute, every person convicted of a violation
of this section or any supplement thereto shall be liable to a penalty
of not more than $200 or imprisonment for a term not exceeding 15
days, or both.
D. Regulation for the movement and parking of traffic in municipal parks.
In accordance with the provisions of N.J.S.A. 39:5A-4, the regulations
of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable
to the properties listed below.

E. Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Sections
169-37B and C shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost for the procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Mount Arlington. The owner shall be responsible for the repair, restoration, or replacement of same.

A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
ENGINE BRAKING
The use or operation of any mechanical exhaust device designed
to aid in the braking, decompression or deceleration of any motor
vehicle which results in the excessive, loud, unusual, or explosive
noise from such vehicle.
B. Prohibition. It shall be unlawful for the driver of any motor vehicle
to use or operate or cause to be used or operated, at any time and
on any road within the Borough of Mount Arlington, any mechanical
exhaust or decompression device which results in the practice known
as "engine braking."
C. Exceptions. The provisions of this section shall not apply where
engine braking is necessary for the protection of persons and/or property
which cannot be avoided by application of an alternative braking system.
Noise caused by the application of engine compression brakes, otherwise
known as "engine braking," which is effectively muffled, or if the
application is necessary for the health, safety, and welfare of the
community, is exempt from the provisions of this section. Sounds created
by emergency equipment for emergency purposes are also exempt. The
provisions of this section shall also not apply to the operation of
any motor vehicle upon those portions of Interstate Highway Route
80 located within the Borough of Mount Arlington.
D. Posting of signs. The Borough is hereby authorized to post, at reasonable
locations within the Borough, signs indicting the prohibition of engine
braking.
E. Violations and penalties. Unless another penalty is expressly provided
by New Jersey statute, any person or entity convicted of a violation
of this section shall be punished, for a first conviction thereof,
by a fine of not more than $100 or by imprisonment for a period not
to exceed 10 days, or by both such fine and imprisonment. For a second
such conviction, such person or entity shall be punished by a fine
of not more than $200 or by imprisonment for a period not to exceed
20 days, or by both such fine and imprisonment. Upon the third or
any subsequent conviction, such person or entity shall be punished
by a fine of not more than $500 or by imprisonment for a period not
to exceed six months, or by both such fine and imprisonment.
