It is the purpose of this section to comply with the mandatory
State-wide recycling program L.1987 Ch. 102, the Clean Communities
and Recycling Act, N.J.S. 13:1E-92 and the Bergen County Long-Term
Solid Waste Management Plan.

As used in this section:
ALUMINUM
Shall mean recyclable aluminum cans.
CONSTRUCTION AND DEMOLITION DEBRIS
Shall mean source separated non-putrescible recyclable material
generated from the construction, alteration, repair, maintenance and/or
demolition of structures within the Borough. This material shall include
concrete, bricks, block, ferrous and non-ferrous scrap, asphalt, asphalt
shingles, recyclable wood scrap, and any and all other material generated
from the construction, alteration, repair, maintenance and/or demolition
of a structure or structures within the Borough.
DESIGNATED RECYCLABLE MATERIALS
Shall mean those recyclable materials, including metal, glass,
paper or plastic containers, food and waste, corrugated and other
cardboard, newspaper, magazines or high-grade office paper designated
in this section to be source separated.
DWELLING UNIT
Shall mean and include a one family home and a two family
home.
FERROUS SCRAP
Shall mean all metal scrap containing steel and/or cast iron.
GLASS CONTAINERS
Shall mean all products made from silica or sand, soda ash
and limestone which are transparent or translucent and are used for
packaging or bottling of various matter and all other materials commonly
known as glass; excluding, however, blue glass and flat glass, commonly
known as window glass.
MAGAZINES
Shall mean and include all magazines or periodicals printed
on glossy stock or paper of heavier quality than that commonly recognized
as "newsprint."
MUNICIPAL SOLID WASTE STREAM
Shall mean all residential, commercial and institutional
solid waste generated within the boundaries of the Borough, as measured
in tons.
NEWSPAPER
Shall mean paper of the type commonly referred to as "newsprint"
and distributed at stated intervals, usually daily or weekly, having
printed thereon news and opinions and containing advertisements and
other matters of public interest, expressly included, however, are
all magazines or similar periodicals as well as all other paper periodicals
of any nature whatsoever.
PAPER
Shall mean and include all newspaper, high-grade office paper,
fine paper, bond paper, offset paper, xerographic paper, mimeo paper,
duplicator paper and related types of cellulosic material containing
not more than 10% by weight or volume of non-cellulosic materials
such as laminates, binders, coatings or saturants.
PAPER PRODUCT
Shall mean any paper items or commodities, included but not
limited to, paper napkins, towels, corrugated and other cardboard,
construction material, toilet tissue, paper and related types of cellulosic
materials containing not more than 10% by weight or volume of non-cellulosic
materials such as laminates, binders, coatings or saturants.
PLASTIC CONTAINER
Shall mean a container hermetically sealed or made air-tight
with a metal or plastic cap and with a minimum wall thickness of not
less than one-hundredth (0.01") inch, and composed of thermo-plastic
synthetic polymeric material coded with the recycling symbol numbers
one or two.
RECYCLABLE MATERIAL
Shall mean those materials which would otherwise become municipal
solid waste, which may be collected, separated or processed and returned
to the economic mainstream in the form of raw materials or products.
RECYCLABLE PAPERS
Shall mean paper having a total weight consisting of not
less than 50% secondary waste paper material.
RECYCLING
Shall mean any process by which materials which would otherwise
become solid waste or collected, are separated or processed and returned
to the economic mainstream in the form of raw materials or products.
RECYCLING SERVICES
Shall mean the services provided by persons engaged in the
business of recycling, including the collection, processing, storage,
purchase, sale or disposition, or any combination thereof of recyclable
material.
REGULATIONS
Shall mean and includes such rules, implementation dates,
schedules of time and such other requirements promulgated by the Director
of the Department of Solid Waste and approved by the Borough Council
as may be necessary to carry out the purposes and objectives of this
section.
SOURCE SEPARATED RECYCLABLE MATERIALS
Shall mean recyclable materials including but not limited
to, paper, metal, glass, food waste, office paper and plastic which
are kept separate and apart from residential, commercial and institutional
solid waste by the generator thereof for the purposes of collection,
disposition and recycling.
TIN
Shall mean steel, tin, bi-metal beverage and food cans.
WHITE GOODS
Shall mean refrigerators, freezers, and air conditioners
which must have the freon removed and be so tagged, stoves, washing
machines, dryers, water heaters, and such other items as shall be
listed in the rules and regulations propounded by the Borough.

There is hereby created the position of Haworth Recycling Coordinator.

The Recycling Coordinator shall promulgate reasonable regulations
establishing the manner, dates and times of the collection of same
in accordance with the terms of this section. Any such regulations
promulgated by the Director of the Department of Solid Waste Management
shall be approved by the Borough Council and may be changed, modified,
repealed or amended in whole or in part by the majority vote of the
Borough Council. A copy of such regulations promulgated by the Director
of the Department of Solid Waste Management, as provided, modified
or amended, shall be available for public inspection at the office
of the Borough Clerk during regular business hours.

The Recycling Coordinator may be authorized, from time to time
by bid or by contract approved by the Mayor and Council, to sell and
deliver recyclable material so collected in order to obtain the best
possible price.

Nothing in this section shall be deemed to prohibit any owner,
lessee or occupant of disposing of recyclable material privately through
a sale or gift provided that, in no event, shall such recyclable materials
be left intentionally and willfully for any private pickup and further
provided that, in no event, shall any such recyclable materials be
disposed of as part of the solid waste pickup by the Borough in accordance
with the normal pickup by the Borough.

From the time recyclable materials are placed at curbside by
the owner, lessee or occupant for collection by the Borough, such
recyclable materials shall become the property of the Borough. It
shall be a violation of this section for any person unauthorized to
collect or pickup or cause to be collected or picked up any such recyclable
materials for any purpose whatsoever once the same has been placed
at curbside or at the recycling center.

A Borough Official or Councilmember shall annually submit a
recycling tonnage report to the New Jersey Office of Recycling.

This section shall be referred to the Planning Board for a revision
of the Master Plan in accordance with N.J.S.A. 13:1E-99.16(c). Specifically,
with regard to the collection, disposition and recycling of designated
recyclable materials within any development proposal for the construction
of 50 or more units of single family residential housing or 25 or
more units of multi-family residential housing and any commercial
or industrial development proposal for the utilization of 1,000 square
feet of land. The Planning Board shall also make recommendations to
the Mayor and Council for the amendments to the Borough zoning ordinance
and subdivision and site plan ordinances in accordance with this section.

The Department of Public Works Superintendent or his designated
assistant or the Recycling Coordinator are hereby authorized and directed
to enforce this section.

Any person, firm or corporation violating the provisions of this section shall be liable to a maximum penalty at the discretion of the Judge of the Municipal Court of the Borough of Haworth of not more than $25 for the first offense, and not more than $100 for each subsequent offense, provided there shall be no jail term imposed, excepting that a person violating subsection
17-1.8 shall be liable to a maximum fine of $250 or imprisonment in the County Jail for a period not to exceed 30 days or both.

In addition to any and all other violations and penalties imposed
by this section or other statute, ordinance or regulation, the Borough
and/or its employees, agents, or contractors may refuse to collect
any solid waste placed at curbside in violation of the provisions
of this section.

The Borough of Haworth currently maintains a leaf compost site.
The Borough is interested in selling the composted materials for mulch,
fertilizer and the like to interested persons.

Any individual, firm or organization desiring to purchase leaf
composting material from the Borough Compost Site shall pay to the
Borough Clerk an amount equal to $6 per cubic yard of composted material.
Any individual, firm or organization shall take the receipt from the
Borough Clerk to the Superintendent of the Department of Public Works
who shall supervise or cause a designee to supervise the removal of
the appropriate amount of composted material.
