A certain document, one (1) digital copy of which is on file in the office of the Clerk of the City of Marshall, being marked and designated as the International Mechanical Code, 2015 edition, including Appendix Chapter A, as published by the International Code Council, be and is hereby adopted as the Mechanical Code of the City of Marshall, Missouri, regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Mechanical Code on file in the office of the Clerk of the City of Marshall, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any prescribed in Section 500.570.

The following sections are hereby revised as follows:

Section 106.5.2. Insert: The mechanical permit fees established by this Section shall be as follows:
a. 
Air Condition Units < two (2) ton: ten dollars ($10.00).
b. 
Air condition units > two (2) ton: fifteen dollars ($15.00).
c. 
Boilers - HP, each: twenty dollars ($20.00).
d. 
Furnaces/heat pumps < 100M Btu: ten dollars ($10.00).
e. 
Furnaces/heat pumps > 100M Btu: fifteen dollars ($15.00).
f. 
Floor furnaces - BTU: ten dollars ($10.00).
g. 
Unit heaters - BTU: ten dollars ($10.00).
h. 
Range hood: five dollars ($5.00).

Section 109.1: Revised to read:
109.2 General. Appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of this Code shall be heard by the City of Marshall Board of Appeals, as established, adopted and amended from time to time by the City of Marshall, Missouri. The Board of Appeals shall follow the practices and procedures followed by the Board of Code Enforcement.

Section 109.2 — 109.7, inclusive: Revised to read:
109.2 Qualifications. The Board of Appeals shall consist of not less than four (4) members who are qualified by experience and training to pass on matters pertaining to building construction, fire protection or other areas of construction, property maintenance or building trades. Officers and/or employees of the City of Marshall, Missouri, may serve as members of the Board of Appeals. The Board of Appeals shall follow the practices and procedures followed by the Board of Code Enforcement.
A. 
For any violation of the Code adopted hereby, the violator, upon conviction, shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the City or County Jail not exceeding three (3) months, or by both such fine and imprisonment. Every day any violation shall continue shall constitute a separate offense.
B. 
Whenever any act is prohibited by the Code adopted hereby, by an amendment thereof, or by any rule or regulation adopted thereunder, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act. Whenever any act is prohibited by the Code adopted hereby, an attempt to do the act is likewise prohibited.
C. 
Equitable Relief. In addition to any other remedies or penalties established for violations the Code adopted hereby, or any rule, regulation, notice, condition, term or order promulgated by any officer or agency of the City under duly vested authority, the City Official responsible for the enforcement of the Code adopted hereby, rule, regulation, notice, condition, term or order may, on behalf of the City and after approval by the City Council, apply to a court of competent jurisdiction for such legal or equitable relief as may be necessary to enforce compliance with the Code or rule, regulation, notice, condition, term or order. In such action the court may grant such legal or equitable relief, including, but not limited to, mandatory or prohibitory injunctive relief, as the facts may warrant. Upon the successful prosecution of any such action the City may be awarded by the court reasonable attorney fees as allowed by law.
