There is hereby established the Local Assistance Board, which
shall administer the public assistance program of the Township pursuant
to State Statute and regulation. The Local Assistance Board shall
be composed of five persons, appointed by the Mayor, with the approval
of the Township Committee, and one of which shall be a member of the
Township Committee.

The terms of the members and appointees for the Local Assistance
Board shall be as follows:
a. The term of the member of the Township Committee shall be for one
year.
b. The terms of the other four members shall be for a four-year term.
The term of each member and appointee shall commence on the
first day of January and expire December 31 in the concluding year
of the appointment; or once the appointee's successor shall be appointed
and qualified. Vacancies shall be filled for the unexpired term only.
Members of the Local Assistance Board shall serve without compensation
but shall be allowed their necessary and actual expenses.

The Local Assistance Board shall annually organize and select
a Chairman and Secretary.
The Board shall appoint a Director of Welfare who shall be the
first executive and administrative officer of the Board, and who shall
serve for a term of five years from the date of appointment, and shall
be paid a salary as fixed by the Board, subject to the approval of
the Township Committee.
In case of a vacancy in the office of the Director of Welfare,
one temporary or acting Director may be appointed to serve for 90
days. Other employees, including assistants, clerks, investigators
and nurses, who may be necessary to properly administer public assistance,
shall be appointed in the same manner as the Director of Welfare.
No employee whose compensation is paid from funds received or appropriated
for public assistance or the administration thereof in any manner
shall hold any office in any political party.
The Director of Welfare shall perform such duties as provided
for in Statute or as directed by the Local Assistance Board, provided
the direction is not inconsistent with any requirements of State Statute.

Pursuant to N.J.S.A. 40:12-1 et seq. there is hereby created
a Board of Parks and Recreation Commissioners of the Township of Millstone.

The Board shall consist of seven members who shall be appointed
by the Mayor, who shall be designated Commissioners and who shall
be residents of the Township. All appointments shall be for a term
of five years staggered so that the term of at least one Commissioner
and not more than two Commissioners shall expire in each year. All
vacancies shall be filled for the unexpired term only. Commissioners
shall serve until their successors are appointed and qualify, and
they shall receive no compensation for their services.
In addition to any statutory provision controlling the creation
of a vacancy, any member who attends less than 2/3 of the meetings
for any calendar year may be discharged from the Board by resolution
of the Township Committee and in this event a successor shall be appointed
to serve for his/her unexpired term.

There shall be two alternate members, designated Alternate No.
1 and Alternate No. 2, appointed by the Mayor to the Board and who
shall be residents of the Township. The alternate members shall be
appointed for five year terms, except that upon the first appointment
of alternate members, Alternate No. 1 shall receive a five year appointment
and Alternate No. 2 shall receive an initial appointment of four years.
Thereafter, all alternate appointments shall be for a five-year term,
except that vacancies shall be filled for the unexpired term only.
Alternate members shall be subject to the same attendance requirement as set forth in subsection
2-27.2 for regular members.
No alternate member shall be permitted to act on any matter
in which the alternate has either directly or indirectly any personal
or financial interest. An alternate member may, after public hearing,
if he requests one, be removed by the governing body for cause.
Alternate members may participate in discussions of the proceedings
but may not vote except in the absence or disqualification of a regular
member of the Board of Recreation Commissioners. A vote shall not
be delayed in order that a regular member may vote instead of an alternate
member. In the event that a choice must be made as to which alternate
member is to vote, Alternate No. 1 shall vote.

a. The members of the Board shall annually elect from the regular members
of the Board a Chairman and a Vice Chairman. They may appoint a Recreation
Director, secretary and employ such other assistants, custodians and
supervisors as they may deem necessary within the limits of budget
appropriations.
b. The Board of Parks and Recreation Commissioners shall meet regularly
at least once each month in connection with the performance of its
duties and for the consideration of matters affecting public parks
in the Township. It shall adopt rules and regulations for the purpose
of facilitating the work of the Commission and for the purposes of
regulating the conduct of the meetings of the Board.

a. Commissioners shall formulate plans for the development and improvement
of the public park and playground lands now or hereafter owned by
the Township; propose methods or arrange merits for the proper maintenance
and care of such lands and the improvement thereof; formulate rules
and regulations for the public use of park and playground lands and
improvement thereof; determine annually what sums may' be necessary
for the improvement, care and maintenance of the public park and playground
lands and recommend to the Township Committee in writing the amounts
necessary to be raised for that purpose. The Township Committee shall
not appropriate money for park and playground purposes, either by
the issuance of bonds or by taxation, except upon and after a recommendation
by the Board of Parks and Recreation Commissioners. All recommendations
of the Commissioners involving the expenditure of monies shall be
submitted to the Township Committee prior to the introduction and
formal consideration of the annual budget. The sum actually appropriated
by the Township Committee in any year shall not, in any case, exceed
the sum recommended by the Commissioners, but the Township Committee
may appropriate any lesser amount.
b. The Board of Parks and Recreation Commissioners shall have the powers
conferred upon it by N.J.S.A. 40:12-1 to 8 inclusive. The Board shall
also have the full and complete authority and power, exclusive of
the Township Committee, to expend the monies raised for park and playground
purposes, other than for the acquisition of land, and all monies so
raised for such purposes shall be paid out by the Township Treasurer
upon the warrant of the Board of Parks and Recreation Commissioners,
signed by its Chairman and attested by its secretary, and not otherwise;
provided, that the Commissioners shall not have the power and authority
to incur any obligation in the name of or for the account of the Township
except as authorized by the Township Committee and the provision of
this section.
c. The custodians, supervisors and assistants shall, while on duty and
for the purpose of preserving order and the observance of the rules,
regulations and bylaws of the Board, have all the power and authority
of police officers.
d. Notwithstanding the recreation registration fees in §
5-2c, the Commissioners may change or modify a fee to be charged based upon the modification of program schedules caused by circumstances such as unavailability of facilities or a declared health emergency.

There is hereby created an Environmental Commission for the
protection, development, and/or use of the natural resources located
within the territorial limits of the Township pursuant to the provisions
of N.J.S.A. 40:56A.

The Mayor, in his discretion, shall appoint the members of the
Environmental Commission, which shall consist of seven persons, citizens
and residents of the Township, one of whom shall also be a member
of the Township Planning Board. All appointments shall be for the
term of three years and vacancies shall be filled for the unexpired
term only, in the same manner as an original appointment. The members
shall receive no compensation for their services.

The Commission shall have the following powers:
a. Promoting the conservation and development of the natural resources
of the Township.
b. Planning, implementing and informing the public about local conservation
programs.
c. Conducting research into the possible use of the open areas of the
Township.
d. Recommending to the Planning Board plans and programs for inclusion
in a Municipal Master Plan and the development and use of such open
areas.
e. Advertising, preparing, printing and distributing books, maps, charts,
plans and pamphlets which, in its judgment, it deems necessary for
its purposes.
f. Managing donated or purchased lands for conservation purposes and
operating conservation programs.
g. Acting as the coordinating agency of the community on conservation
matters and a liaison between conservation needs and regional, County,
State and Federal agencies ministering to those needs.

The Commission shall compile and keep an index of all open areas,
publicly or privately owned, including open marshlands, swamps, and
other wetlands in order to obtain information on the proper use of
such areas.

a. The Commission, with the approval of the Township Committee, may
acquire property, both real and personal, in the name of the Township,
by gift, purchase, grant, bequest, devise or lease for any of its
purposes, including but not limited to use as living museums, sites
for scientific study, areas for teaching natural history and conservation,
places of historic or prehistoric interest and scenic beauty and habitat
for rare and endangered plants and animals, and shall administer the
same for such purposes subject to the terms of the conveyance or gift.
b. Such an acquisition may be to acquire the fee or any lesser interest,
development right, easement, covenant or other contractual right as
may be necessary to acquire, maintain, improve, protect, limit the
future use of or otherwise conserve and properly utilize open spaces
and other land and water areas in the Township of Millstone.

The Environmental Commission shall, subject to approval of the
Township Committee, have exclusive control of lands acquired for the
purposes herein stated and may adopt suitable rules and regulations
for the use thereof and the conduct of all persons while on or using
the same.

The Commission shall keep records of its meetings and activities
and shall make an annual report on or before the first day of December
of each year and submit the same to the Township Committee, which
report shall be comprehensive and detailed covering operations, receipts,
disbursements and expenditures for the full year.

The Mayor shall designate one of the members to serve as Chairman
and Presiding Officer of the Commission. The Commission is authorized
to adopt by-laws governing its procedural operation.

The Mayor or the Township Committee may remove any member of
the Commission for cause, on written charges served upon the member
and after a hearing thereon at which the member shall be entitled
to be heard in person or by counsel.

The Township Committee shall annually fix, determine and appropriate
a sum sufficient for the care, custody, policing and maintenance of
such lands acquired for the uses and purposes herein stated, and for
the expenses of the Commission, which shall be raised by taxation
in the same manner as other taxes.

The Commission may appoint a Secretary or Clerk and such number
of custodians, supervisors and assistants for the lands acquired for
the uses and purposes herein mentioned as it shall think necessary,
but the salaries of all such clerks, custodians, supervisors and assistants
shall be fixed and determined by the Township Committee; and, in addition
thereto, the total salaries of all such persons shall be within the
limits of funds appropriated to the Commission.

The Township of Millstone Green Team be and is hereby established
as an advisory committee to the Township Committee of the Township
of Millstone.

The general purpose and duties of the Green Team shall include
the following:
a. Managing the Township's participation in the Sustainable Jersey program;
b. Encouraging the Township staff to pursue sustainable practices where
possible and implement the Township Committee's environmental goals;
c. At the recommendation of the Township Committee, work with the existing
groups within the Township whose actions affect environmental issues
so as to eliminate duplication and assure that important tasks are
covered;
d. Coordinate input and provide management for the Green Team section
of the Township website;
e. Provide suggestions for further research and action to the Township
Committee;
f. At the direction of the Township Committee, provide advice and suggestions
to the Township Zoning Board of Adjustment and Planning Board to ensure
that environmental issues are considered in their deliberations and
actions;
g. Solicit and evaluate environmental ideas and suggestions from the
community; and
h. Promote the causes of sustainability within the Township.

a. The Environmental Commission of the Township of Millstone shall serve as the Green Team to lead in the sustainable activities of the community and in coordinating the implementation of local initiatives and actions to participate in the Sustainable Jersey program. The terms of office for members of the Green Team shall coincide with the terms of office for members of the Environmental Commission, as set forth in §
2-28 of the Municipal Code of the Township of Millstone.
b. The Green Team shall select Township volunteers to work on Green
Team projects. The names of the Green Team volunteers shall periodically
be submitted to the Township and the Green Team reports, minutes,
and other similar documents shall also be submitted to the Township
Committee.

The Green Team shall meet monthly. Additional meetings of the
Green Team may be scheduled by the Chairman of the Environmental Commission
at his/her discretion. Minutes shall be recorded at these meetings.

There is hereby created and established an advisory council
to be known as the "Agricultural Advisory Council."

The Council shall consist of a minimum of three members and
a maximum of five members appointed by the Mayor with consent of the
Township Committee. All members shall be residents of the Township.
A majority of the Council shall be comprised of persons actively engaged
in farming and owning a portion of the land they farm. All members
of the Council shall serve without compensation. Nothing shall prohibit
a member of the Council from simultaneously serving on the Open Space
Preservation Council.
Initially two members (if a three member Council) or three members
(if a five member Council) shall be appointed to a one-year term and
one member (if a three member Council) and two members (if a five
member Council) shall be appointed to a two-year term. All terms thereafter
shall be for two years. A term shall expire on December 31 and shall
begin on January 1 of the appropriate year.
All vacancies shall be filled for the unexpired term only. Members
shall serve until their successors are appointed and qualified.

The Township Committee shall have the discretion, upon recommendation
from the Council, to remove any member who is not fulfilling his or
her duties and responsibilities.

a. The members of the Council shall annually elect from their own members
of Chairperson and Vice Chairperson. The duties of the Chairperson
shall be to conduct the meetings of the Council, appoint subcommittees,
determine the activities and functions of the Council and report on
such to the Township Committee. The duties of the Vice Chairperson
shall be to assist the Chairperson in the completion of his or her
duties and to act in his or her stead during an absence. The duties
of the Secretary shall be to record the minutes of all meetings of
the Council and to receive and transmit all correspondence of the
Council.

b. The Council shall meet regularly, at least once each month, except
that meetings shall not be mandatory during the months of July and
August, in connection with the performance of its duties. It may adopt
rules and regulations in order to facilitate the carrying out of its
duties and the conduct of its meetings.

The Council shall submit a budget request to the Township Committee,
which shall appropriate in each annual budget of the Township, a sum
as may be determined by the Township Committee to be necessary for
the Council to accomplish the purposes set forth herein and to implement
those recommendations of the Council which the Township Committee,
in its discretion, deems feasible and appropriate.

The powers and duties of the Council shall be as follows:
a. To foster and promote the preservation of farmland within the Township.
b. To assist Millstone in promoting the viability of the agricultural
industry as well as promoting the economic and other benefits which
result from preserving farm operations.
c. To become fully aware of all lands within the Township currently
used for farming and/or agricultural related purposes by compiling
and maintaining an inventory of farming and agricultural lands within
the Township.
d. To analyze how the Township can best protect the continuance and
preservation of farmland within the Township.
e. To determine existing and future problems facing farmers and the
farming community and to recommend reasonable and desirable solutions
to the Township Committee.
f. To encourage and promote appropriate farming and agricultural related
activities.
g. To encourage existing farmers to continue their farms in active operation.
h. To encourage and assist farmers and the farming community in making
applications for farmland preservation programs, including applications
to the County of Monmouth Planning Incentive Grant Program, applications
to the State of New Jersey Direct Program, applications for the Non
Profit Preservation Program as well as the Township of Millstone Planning
Incentive Grant Program.
i. To assist in minimizing conflicts between farming/agricultural uses
and adjacent or nearby residential and commercial uses.
j. To promote the Right to Farm Act (N.J.S.A. 4:1C-1 et seq.), including
educating the community about the Act and assisting in mediating right
to farm issues.
k. To make an annual report to the Township Committee setting forth
the activities and operations of the Council during the preceding
year.
l. To keep the Township Committee informed of current preservation applications
and developments in the farming community.
m. To respond to any ordinances introduced by the Township Committee
that may have an impact on the farming community.
n. To advise the Township Committee with respect to pending legislation
at the county or state level which may impact on the farming community.
o. To keep the farming community informed of any municipal, county or
state legislation which may impact on the farming community.
p. Report to and advise the Planning Board of its findings and recommendations
on land use, land management and farmland preservation.
q. To perform such other tasks referred to it and as may be assigned
to it by the Township Committee having to do with farming and agricultural
related activities.
r. Subject to the preexisting approval of the Township Committee, the
Council is empowered to complete, review and, if appropriate, approve
farm applications pursuant to State Agriculture Development Committee
(SADC) regulations and policies, including N.J.A.C. 2:76-17A.3 "Grant
eligibility" and N.J.A.C. 2:76-17A.9, "Committee review of an application
for the sale of a development easement" and the Council Chairperson
may execute the "Affidavit of Municipal Advisory Committee Verification."

It is the intent of this section that the Agricultural Advisory
Council shall be solely an advisory council consisting of volunteers
appointed by the Township Committee. The Council shall have no authority
to expend any public funds. The Council shall assist and make recommendations
to the Township Committee in addressing issues and problems facing
the farming community. The Council shall encourage and promote farmland
preservation within the Township.

A member of the council or a member of his or her immediate
family, is prohibited from selling or applying to sell a development
easement on his or her property or from selling or applying to sell
his or her property in fee simple title pursuant to the Agriculture
Retention and Development Act, (N.J.S.A. 4:1C-11, et seq.) and the
Garden State Preservation Trust Act.

a. Both the Township Code of Ethics and the Local Government Ethics
law, (N.J.S.A. 40A:9-22.1 et seq.) shall apply to all members of the
Council.
b. No Councilmember shall use any information he/she shall acquire as
a member of the Council for his/her benefit, monetary or otherwise,
or for the benefit of any person or entity. No Councilmember shall
divulge to any other person any information revealed or discussed
during executive session, unless and until the Council and Township
Committee shall take action to allow the minutes of the executive
session(s) at which such information was revealed or discussed to
be released to the public.
c. Upon a determination of the Township Committee that any member has
violated any of the ethical restrictions, said member shall be deemed
to have forfeited his/her membership on the Council and his/her seat
shall be deemed vacant.

The Township Committee finds and declares as follows: N.J.S.A.
26:2BB-9 authorizes the establishment of a Municipal Alliance Committee
as a means for implementing policies to reduce alcoholism and drug
abuse. Such a committee, in consultation with the local advisory committee
on alcoholism and drug abuse, shall identify alcoholism and drug prevention,
education and community needs. Furthermore, the Municipal Alliance
Committee also shall implement related programs and, upon compliance
with various guidelines, become eligible to receive State funds to
assist the programs developed by the Municipal Alliance Committee.

There is hereby created and established a committee to be known
as the Municipal Alliance Committee to Prevent Alcoholism and Drug
Abuse in the Township of Millstone.

a. Organization. The Committee shall consist of a minimum of seven members
appointed by the Mayor and Township Committee, all of whom shall be
residents of the Township of Millstone. Annually the Municipal Alliance
Committee will appoint one of its members to serve as Chairperson
until December 31 of that year or until a successor is chosen by the
Committee, whichever is later.
b. Membership Categories. The membership may consist of the following
categories:
3. Civic and/or Business Association.
5. Parent Teacher's Association.
7. Superintendent of Schools or Designee.
8. Substance Awareness (Student Assistance) Coordinator.
9. Teachers Bargaining Unit.
16. Youth (older than 18 years of age).
17. Senior (over 65 years of age).
19. Recovering Alcoholic (minimum of two years sobriety).
20. Recovering Drug Abuser (minimum of two years sobriety).
21. Licensed Alcohol and Drug Abuse Facility and/or Licensed Certified
Alcohol and Drug Abuse Counselor.
22. Certified Prevention Specialist. If a vacancy in any category shall
occur otherwise than by expiration of the designated terms, it shall
be filled by appointment, by the Mayor and Township Committee, for
the unexpired term. No member of the Committee shall be permitted
to act on any manner in which he or she has, either directly or indirectly,
any personal or financial interest. Any member, after a public hearing
if he or she requests one, may be removed by the Township Committee
for cause.

The functions of the Municipal Alliance Committee shall include,
but not be limited to:
a. Creating a network of community leaders, private citizens and representatives
from public and private human service agencies who are dedicated to
a comprehensive and coordinated effort to promote and support alcohol
and drug prevention and education programs and related activities
with an emphasis on youth.
b. Conducting an assessment of their community to determine the needs
of the community in relation to alcoholism and drug abuse issues.
c. Identifying existing efforts and services acting to reduce alcoholism
and drug abuse.
d. Coordinating projects within the municipality to avoid fragmentation
and duplication.
e. Developing programs to be implemented at the municipal level and/or
participating in regionally developed programs that accomplish the
purpose of alliance effort and the purposes of the Municipal Alliance
Committee.
f. Assisting the municipality in acquiring funds for alliance programs.
g. Developing a subcommittee on fund-raising.
h. Cooperating with the Governor's Council on Alcoholism and Drug Abuse
and the County Local Advisory Committee on Alcoholism and Drug Abuse/Alliance
Steering Subcommittee to provide municipal data, reports or other
information which may be required for the County annual alliance plan
needed to assist the alliance effort.

There is hereby created a Shade Tree Commission which will be
known as "The Shade Tree Commission of Millstone Township." The Commission
shall consist of not less than five nor more than seven members, to
be appointed by the Mayor. The members shall be residents of this
Township and shall serve without compensation except as hereinafter
provided.

The regulation, planting, care and control of shade and ornamental
trees and shrubbery upon and in the municipal streets and roads, highways,
public places, parks and parkways (if any) of Millstone Township (except
State highways unless the State Highway Department shall assent thereto,
and except County highways, parks and parkways unless the County Shade
Tree Commission shall assent thereto) shall be exercised by and be
under the authority of the said Commission.

All appointments, except to fill vacancies, shall be for the
full term of five years, to take effect on January 1.

The Commission shall organize annually, by the election of one
of its members as Chairman and the appointment of a Secretary, who
need not be a member. The salary of the Secretary, who may be compensated
even if a member of the Commission, shall be fixed by the Township
Committee; the salary of all other employees shall be fixed by the
Commission. All salaries shall be fixed as nearly as practicable in
accordance with the salary schedule, if any, of the Township for corresponding
positions.

The Shade Tree Commission organized under this section shall
have power to:
a. Exercise full and exclusive control over the regulation, planting
and care of shade and ornamental trees and shrubbery now located or
which may hereafter be planted in any public highway, park or parkway,
except such as are excluded, pursuant to N.J.S.A. 40:64-1 in the Township,
including the planting, trimming, spraying, care and protection thereof.
b. Regulate and control the use of the ground surrounding the same,
so far as may be necessary for the proper growth, care and protection.
c. Move or require the removal of any tree or part thereof dangerous
to public safety.
d. Care for and control such parks and parkways, encouraging arboriculture,
and recommend the alteration, amendment or repeal of shade tree ordinances
by the Township Committee.
e. Administer treatment to or remove any tree situate upon private property
which is believed to harbor a disease or insects readily communicable
to neighboring healthy trees in the care of the Township, and enter
upon private property for that purpose with the consent of the owner
thereof, provided the suspected condition is first confirmed by certificate
issued by or on behalf of the Department of Agriculture.
f. To excavate land, remove trees and shrubbery on an undeveloped land
belonging to the Township of Millstone and other public lands within
the jurisdiction of the Shade Tree Commission.

a. Except as hereinafter provided, the cost of the removal of any tree or part thereof dangerous to public safety shall, if the Commission shall so determine, in accordance with uniform rules and regulations promulgated for this purpose, be a charge upon the real estate in front of which such tree or trees shall be removed. Such cost, if it is so determined that it is to be paid by the owner, shall, unless paid directly to the Commission, be certified by it to the Collector of Taxes of the Township, including the applicable administrative fee established in Chapter
5, shall thereupon become and be a lien upon said real estate, shall be included in the next tax bill rendered to the owner or owners thereof, and be collected in the same manner as other taxes against that property.
b. The provisions of this section shall not apply to:
1. A planting to replace a tree or trees theretofore planted by the
Commission.
2. A planting in connection with Arbor Day exercises or other educational
demonstration.

a. No statute giving any person or State, County, or municipal board,
body or official, power or authority to lay any sidewalk along, or
to open, construct, curb or pave, any street, or to do any similar
act, shall be construed to permit or authorize any interference with
or injury to a highway shade tree without the consent of the Shade
Tree Commission within whose jurisdiction such tree shall be located.
In all cases such Commission shall reasonably cooperate with such
person, board, body or official for the general public good.
b. Nothing in this section contained shall be held to take away or diminish
any of the powers or authority of any County Park Commission over
the trees or shrubbery in any County park or parkway within its jurisdiction,
or to give any other commission or board any power or authority with
respect to such trees or shrubbery.

a. During the month of December in each year, the Shade Tree Commission
shall certify to the Township Committee the estimated sum necessary
for the proper conduct of its work during the ensuing fiscal year,
which shall include the sums estimated to be expended for such of
the following items as it is anticipated expenditure will be made,
namely:
1. Payment of wages and salaries of employees approved by the Township
Committee.
2. Expenses of Commission members in discharging official duties, including
expenses incident to attendance at professional meetings approved
by the Township Committee.
3. Purchase of trees and shrubbery, within the approved budget.
4. Purchase of necessary equipment and materials and the cost of services
for the prudent promotion of the work within the approved budget.
b. The Township Committee shall annually appropriate such sum as it
may deem necessary for said purposes.

All monies collected by the Township either as costs for the
removal of trees or as a charge against real estate, under any provision
of this section, shall be forthwith paid over to the municipal officer
empowered to be custodian of the funds of the Township.

Nothing in this section shall be construed to make the Shade
Tree Commission or any member thereof responsible for the death or
injury of any person or for an injury to any property or highway tree
or shrub.

Pursuant to N.J.S.A. 40A:63-7d, there is hereby established
the Community Relations Council of the Township. This Council shall
also act as a human rights council as it shall have the duty to foster
through community efforts or otherwise goodwill, cooperation and conciliation
among the groups and elements of the inhabitants of the community.

The Council shall consist of nine members who shall be appointed
by the Township Committee and who shall be residents of the Township.
All appointments shall be for a term of three years, initial terms
to be staggered so that the term of three Council members shall expire
each year. All vacancies shall be filled for the unexpired term only.
Members shall serve until their successors are appointed and qualify,
and they receive no compensation for their services. Members shall
be appointed on the basis of their qualifications, fitness and desire
to fulfill and advance the objectives and purposes of this Council
as set forth herein. It shall be deemed desirable, although not mandatory,
that the following be represented: Clergy, First Aid Squad Member,
Police Officer, Accountant, Parent, Educator, Fire Department Member,
Psychologist, Attorney, Farmer and minority groups in the community.

from the Council, to remove any member who is not fulfilling his or
her duties and responsibilities.

shall be to set the meeting dates, conduct the meetings of the Council,

the Vice Chairperson shall be to assist the Chairperson in the completion
of his or her duties and to act in his or her stead during an absence.
The duties of the Secretary shall be to record minutes of all meetings
of the Council and to receive and transmit all correspondence of the
Council.
b. The Council shall meet regularly, at least once each month, except
that meetings shall not be mandatory during the months of July or
August, in connection with the performance of its duties. It may adopt
rules and regulations in order to facilitate the carrying out of its
duties and the conduct of its meetings.

The Township Committee shall annually appoint a Township official
or Township representative, who shall not be a member of the Council,
but who shall serve as a liaison between the Township Committee and
the Council and shall advise the Council and oversee the expenditure
of Federal, State and/or County grant monies.

The Council shall submit a budget request to the Township Committee,
which shall appropriate in each annual budget of the Township, a sum
as may be determined by the Township Committee to be necessary for
the Council to accomplish the purposes set forth herein and to implement
those recommendations of the Council which the Township Committee,
in its discretion, deems feasible and appropriate.

The Council shall receive from all Township officials, offices
and departments such assistance as may be proper and reasonably necessary
to aid the Council in the performance of its duties.

The powers and duties of the Council shall be as follows:
a. To perform such duties as the Council deems reasonable and essential
in overseeing the Millstone Drug Alliance Program.
b. To facilitate communication, understanding and tranquillity within
the Township.
c. To serve as a resource and advisory panel through which members of
the community may discuss community problems and concerns.
d. To recommend to the Township Committee programs, improvements and
activities which will benefit the Township government's relationship
with the community as a whole as well as to alleviate areas of community
problems and concerns.
e. To act as a liaison between the Township and the New Jersey State
Police.
f. To organize, monitor and oversee opportunities for the Township's
receipt of funds through grants from various levels of government.
g. To foster and promote good will, cooperation and conciliation among
all inhabitants of Millstone Township, including mediation of cultural
problems and incidents of bias.
h. To conduct forums that will allow groups or individuals to share
cultural problems; to review stereotyping or bias incidents that may
occur.
i. To cooperate with other units of government or agencies concerned
with purposes similar to that of the Council.
j. To make recommendations to the Mayor and Township Committee for the
development of policies, procedures and programs that will aid in
the prevention and elimination of all types of discrimination based
upon race, creed, color, national origin, ancestry, age, marital status
or sex.
k. To make an annual report to the Mayor and Township Committee of its
activities.

There is hereby created and established an advisory council
to be known as the "Historic Heritage Council".

The Council shall consist of seven members appointed by the Township Committee. All members shall be residents of the Township. Two members shall be members of the Historic Preservation Commission and their term on the Council shall be coextensive with the current term each is serving on the Historic Preservation Commission. The Local Historian appointed pursuant to subsection
2-35 shall be a member and his/her term on the Council shall be coextensive with his/her appointment as Local Historian. The remaining four members of the Council shall be appointed for three year terms, with the initial terms to be staggered so that two Council members' terms shall expire at the end of the third full calendar year after appointment; one Council member's term shall expire at the end of the second full calendar year after appointment; and one Council member's term shall expire at the end of the first full calendar year after appointment. All vacancies shall be filled for the unexpired term only. Members shall serve until their successors are appointed and qualified and they shall receive no compensation for their services.

Preservation Commission.

There is hereby created and established an advisory body to
be known as the "Economic Development Council of the Township of Millstone."

The Council shall consist of nine members who shall be appointed
by the Township Committee. One member shall be a member of the Township
Committee; one member shall be a member of the Planning Board and
seven members shall be other residents of the Township. The Planning
Board member appointed by the Township Committee shall be recommended
by the Planning Board for membership to the Council. The governing
body and Planning Board member's term on the Council shall be coextensive
with their respective current elected or appointed terms. All other
appointments shall be for a three-year term. All vacancies shall be
filled for the unexpired term only. Members shall serve until their
successors are appointed and qualified and they shall receive no compensation
for their services.

Two alternate members shall be appointed by the Mayor. The alternates
shall be residents of the Township and shall serve without compensation.
The terms of the alternate members shall be for two years, except
that the terms of the alternate members first appointed shall be for
two years for Alternate No. 1 and one year for Alternate No. 2, so
that the term of not more than one alternate member shall expire in
any one year. A vacancy occurring otherwise than by expiration of
term shall be filled by the appointing authority for the unexpired
term only.
An alternate member shall not be permitted to act on any matter
in which he/she has either directly or indirectly any personal or
financial interest. An alternate member may, after public hearing
if he/she requests one, be removed by the Township Committee for cause.
An alternate member may participate in discussion of the proceedings
but may not vote except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event that a choice
must be made as to which alternate member is to vote, Alternate No.
1 shall vote first.

The powers and duties of the Council shall be as follows:
a. To perform a feasibility study to determine the opportunities for
the Township to attract ratables.
b. To promote the advantages of the Township to the business community.
c. To review and analyze current business trends and determine the type
of businesses best suited for the Township, i.e. those businesses
which will be of long term benefit to the Township's financial well-being
and those which are compatible from both an operational and aesthetic
standpoint to the rural character of the Township.
d. To develop a marketing plan which shall include literature, brochures
and use of professional services in order to promote the advantages
of the Township.
e. To make recommendations to the Planning Board in regard to the zoning
of areas of the Township that are best suited to attract businesses.
f. To initiate and manage positive long term tax consequences for the
Township.
g. To assure that actions taken do not jeopardize the current four classifications
of the Township in the State Development and Redevelopment Guide Plan.
h. To initiate studies to evaluate future impact from possible infrastructure
alterations as a result of attracting businesses.

be known as the "Open Space Preservation Council of the Township of
Millstone."

by the Township Committee. One member shall be a member of the Township
Committee; one member shall be a class IV member of the Planning Board

by the Planning Board for membership to the Council. The governing
body and Planning Board members' term on the Council shall be coextensive
with their respective current elected or appointed terms. All other

A member of the Council or a member of his or her immediate
family, is prohibited from selling or applying to sell a development
easement on his or her property or from selling or applying to sell
his or her property in fee simple title pursuant to the Agriculture
Retention and Development Act, (N.J.S.A. 4:1C-11, et seq.) and the
Garden State Preservation Trust Act.

b. The Council shall meet regularly, at least once each month, except

c. Even though the Council is an advisory body, it shall conduct its
business in full compliance with the Open Public Meetings Act, N.J.S.A.
10:4-6 et seq.
d. Minutes and electronic recordings shall be kept of all regular meetings.
e. All minutes of all meetings of the Council, both regular and executive
session, shall be forwarded to the Township Committee within 35 days
of the date of the meeting. All approved minutes shall be forwarded
to the Township Committee within 90 days of the date of the meeting.
No executive session minutes shall be released to the public until
approved by the Township Committee.

the Council to accomplish the purposes set forth herein and to implement

The powers and duties of the Council shall be as follows:
a. To foster and promote the preservation of open space and farmland
within the Township.
b. The Council shall identify open space properties of potential preservation
interest to the Township, taking into consideration the need for land
for passive and active recreation, the protection of sensitive environmental
plant and wildlife habitat, and the need to protect the headwaters
of the five watersheds in Millstone Township to promote clean water
and groundwater recharge.
c. The Open Space Council shall assist interested landowners to fill
out a municipal application. After assessment of an application, the
Council will forward viable applications to the Committee for their
approval.
d. To work cooperatively with the county and state offices of Green
Acres and Monmouth County Park System and any nonprofit organizations.
e. To assist interested parties with processing applications for open
space preservation with applicable county and state offices.
f. To help create and disseminate information promoting preservation.
g. To assist in obtaining grants for open space preservation for the
Township.
h. To stewardship the municipally owned open space properties.

a. Both the Township Code of Ethics and the Local Government Ethics
Law, N.J.S.A. 40A:9-22.1 et seq., shall apply to all members of the
Council.
b. No Councilmember shall use any information he/she shall acquire as
a member of the Council for his/her benefit, monetary or otherwise,
or for the benefit of any other person or entity. No Councilmember
shall divulge to any other person any information revealed or discussed
during executive session, unless and until the Council and Township
Committee shall take action to allow the minutes of the executive
session(s) at which such information was revealed or discussed to
be released to the public.
c. Upon a determination of the Township Committee that any member has
violated any of the ethical restrictions, said member shall be deemed
to have forfeited his/her membership on the Council and his/her seat
shall be deemed vacated.

There is hereby established the position of Local Historian
within the Township of Millstone.

The Local Historian shall be appointed by the Township Committee
from among the residents of the Township. The Local Historian shall
serve without compensation and at the pleasure of the Township Committee.
The Local Historian shall serve until such time as his/her successor
has been appointed.

The Local Historian shall have the following duties and responsibilities:
a. To carry out an historical program, including but not restricted
to collecting, preserving and making available materials relating
to the history of the Township. The Historian shall store such materials
in such manner as to insure their preservation, and shall notify the
State Archivist, New Jersey Historical Commission, County Local Historian
and Township Committee of any materials which should be acquired for
preservation. Upon leaving the position, the Local Historian shall
turn over all materials and records and reports into the possession
of the successor, if then appointed, or to the Township Committee
until a successor shall be appointed;
b. To make an annual report to the Township Committee stating all the
work performed and accomplished during that year. The Local Historian
shall transmit a copy of such report to the New Jersey Historical
Commission;
c. To research and recommend updating the Township history, and may
recommend appropriate additional historical materials for publication;
d. To assist the Historic Preservation Commission, as well as advise
the Township Committee, concerning the acquisition, administration
use and disposition of any landmark, or historic site, including such
places in his/her jurisdiction included on the New Jersey Register
of Historic Places. Such advice may be furnished to the Historic Sites
Section, Department of Environmental Protection.
e. To assist in projects of commemoration, including the erection of
monuments, historic markers and guide signs.
f. To enlist the voluntary aid of other individuals to carry out the
duties and responsibilities set forth above.

There is hereby established a "Veterans' Memorial Council of
the Township of Millstone".

Beginning with the year 2003, the Council shall consist of seven
permanent members and two permanent alternates appointed by the Township
Committee. All members shall be residents of the Township of Millstone.
Any vacancies shall be filled by a majority vote of the Veterans'
Memorial Council.

The officers of the Council shall consist of a Chairperson,
Vice Chairperson and Secretary-Treasurer. The Chairperson and Vice
Chairperson shall have served honorably in the United States Military,
as certified by an honorable discharge certificate DD-214, or other
acceptable United States Military documents. Beginning with the year
2003, the officers and terms of office shall be voted on by a quorum
of the membership of the Council. The Secretary-Treasurer shall keep
the Township Committee informed of the names and addresses of all
officers and members. In the event that an officer position becomes
vacant, the remaining officers may fill that position from within
the membership.

The Veterans' Memorial Council shall have the following powers
and duties:
a. Coordinate the maintenance of the Millstone Township Veterans' Memorial
in accordance with adopted maintenance specifications.
b. Ensure the proper display of flags at the Memorial on days required
by State and/or Federal law.
c. Oversee ceremonies appropriately recognizing military veterans.
d. Advise the Township Committee, through the Secretary-Treasurer, of
important information related to the Veterans' Memorial and the activities
of the Council.

There is hereby established a local Board of Health pursuant
to N.J.S.A. 26:3-9.

The local Board of Health shall consist of seven regular members
as follows: members of the Township Committee, the Township Tax Assessor
and a licensed physician of the State of New Jersey. The term of the
membership of the members of the Township Committee and the Township
Tax Assessor shall be coextensive with their service in those positions.
The physician member shall be appointed by resolution of the Township
Committee for a three-year term and until a successor shall be appointed.

A vacancy of a regular member who serves as a member of the
Township Committee shall be filled in the same manner as used for
filling the governing body vacancy. A vacancy in the Assessor member
of the Board shall be filled by the Township Clerk until the Tax Assessor
position within the Township shall have been filled, in which event
the successor Tax Assessor shall fill the Assessor member's vacancy.
A vacancy in the physician member of the Board shall be filled within
10 days by resolution of the Township Committee. In the absence of
the Township Committee filling such vacancy, the State Department
of Health may appoint a physician member of the Board, who shall hold
such office for the term of three years from the time of such appointment
and until his successor shall be appointed. In the absence of the
filling of a vacancy in the physician member by either the Township
Committee or the State Department of Health, the Board shall then
be deemed to consist of the members of the Township Committee and
the Township Tax Assessor until the physician vacancy shall be filled.

discussions of the proceedings, but may not vote except in the absence
or disqualification of a regular member. A vote shall not be delayed
so that a regular member may vote instead of an alternate member.
In the event that a choice must be made as to which alternate member
is to vote, Alternate No. 1 shall vote.

The local Board of Health shall have all the powers and duties
vested in it by virtue of State statutory law, including the power
to adopt ordinances in matters of health.

The Board shall hold at least one regular meeting each year.
Special meetings may be called at any time by the President of the
Board, who shall be deemed to be the Township Committee member serving
as Mayor, or such other member of the governing body designated by
the Mayor or as Board President or by the State Health Department.

In the event any provision of this section shall conflict with
State statute, as now exists or as may hereafter be amended, the provisions
of this section shall be deemed to be amended to be consistent with
State statute and all proceedings of and powers of the Board shall
be consistent with State statute.

There is hereby created and established an advisory body to
the Environmental Commission to be known as the "Watershed Management
and Preservation Council" of the Township of Millstone.

The Council shall consist of five members who shall be appointed
by the Township Committee. Membership on the Council shall consist
of the following:
a. Two members which may be members, either regular or alternate, of
the Environmental Commission.
b. One member which may be a member of the Open Space and Farmland Preservation
Council.
c. One member who is a resident of the Township and may have farming
as his/her primary vocation within the Township.
d. One member who is a Township resident and resides within a major
watershed area of the Township.
e. The Township Committee shall appoint one of its members to serve
as liaison to the Council.
The members' terms on the Council in category a set forth above,
commencing with the next appointment in this category subsequent to
the adoption of this amendment, shall be for one year. The member's
term on the Council in category b set forth above shall be coextensive
with his/her current appointed term on the Open Space and Farmland
Preservation Council. The other two appointments shall be for a two-year
term; however, initial terms shall be staggered so that one Councilmember's
term shall expire in one year and one Councilmember's term shall expire
in two years. All vacancies shall be filled for the unexpired term
only. Members shall serve until their successors are appointed and
qualified and they shall receive no compensation for their services.

Two alternate members shall be appointed by the Township Committee.
The alternates shall be residents of the Township and shall serve
without compensation. The terms of the alternate members shall be
for two years, except that the terms of the alternate members first
appointed shall be for two years for Alternate No. 1 and one year
for Alternate No. 2, so that the term of not more than one alternate
member shall expire in any one year. A vacancy occurring otherwise
than by expiration of term shall be filled by the appointing authority
for the unexpired term only.
An alternate member may participate in discussion of the proceedings
but may not vote except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event that a choice
must be made as to which alternate member is to vote, Alternate No.

The Township Committee shall have the discretion, upon recommendation
from the Environmental Commission, to remove any member who is not
fulfilling his or her duties and responsibilities.

a. The members of the Council shall annually elect from their own number
a Chairperson, Vice Chairperson and Secretary. The duties of the Chairperson
shall be to set the meeting dates, conduct the meetings of the Council,
appoint subcommittees, determine the activities and functions of the
Council and report on such to the Environmental Commission. The duties
of the Vice Chairperson shall be to assist the Chairperson in the
completion of his or her duties and to act in his or her stead during
an absence. The duties of the Secretary shall be to record the minutes
of all meetings of the council and to receive and transmit all correspondence
of the Council to the Environmental Commission.
b. The Council shall meet regularly, at least once each month, except
that meetings shall not be mandatory during the months of July and
August, in connection with the performance of its duties. It may adopt
rules and regulations in order to facilitate the carrying out of its
duties and the conduct of its meetings.

The Council shall submit a budget request to the Environmental
Commission, which shall appropriate in each annual budget of the Environmental
Commission, a sum as may be determined by the Township Committee to
be necessary for the Council to accomplish the purposes set forth
herein and to implement those recommendations of the Council which
are deemed feasible and appropriate.

The powers and duties of the Council shall be as follows:
a. To serve as a permanent subcommittee of the Environmental Commission.
b. To foster and promote the management, restoration and preservation
of watershed areas within the Township.
c. To work cooperatively with the nonprofit and governmental organizations
whose objectives include the appropriate management, restoration and
preservation of watershed areas.
d. To assist interested parties with processing applications for watershed
management, restoration and preservation with applicable County and
State offices.
e. To help create and disseminate information promoting watershed management,
restoration and preservation.
f. To create and promote educational programs concerning the importance
of watershed areas for assuring quality of life.
g. As requested, to assist other Township agencies, regarding watershed
management, restoration and preservation issues.
h. Within the budgetary appropriation provided for in subsection
2-38.5, to retain such professional consultants relating to watershed management, restoration and preservation as deemed reasonable and necessary to the Council.
i. To recommend to the Environmental Commission adoption of ordinances
designed to protect, restore and preserve watershed areas and stream/river
corridors.
j. To explore any and all possible funding opportunities available to
the Township for the development and implementation of programs to
protect, restore and preserve watershed areas.
k. To recommend to the Environmental Commission the preservation of
public lands and purchase of private lands or easements to protect
and preserve watershed areas and to increase the public's opportunity
to experience the benefits of proper watershed management.
