This chapter may be amended from time to time by the Township
Committee after the appropriate referrals, notices, hearings and other
requirements of law.

A protest against any proposed amendment or revision of a Zoning
Ordinance may be filed with the Township Clerk, signed by the owners
of 20% or more of the area either (1) of the lots or land included
in such proposed change, or (2) of the lots or land extending two
hundred (200') feet in all directions therefrom inclusive of street
space, whether within or without the Township. Such amendment or revision
shall not become effective following the filing of such protest except
by the favorable vote of 2/3 of all the members of the Township Committee.

In addition to any notice of a hearing on an amendment to the
Township Land Management Zoning Ordinance required by N.J.S.A. 40:55D-62.1,
and regardless of any recommendations in a periodic general reexamination
of the master plan by the Land Use Board, the Township Committee may
instruct the Township Clerk of Bedminster Township to provide notice
by posting same on the Township's website and e-mailing those persons
who have subscribed to receive electronic notices from the Township
Clerk at least seven days prior to the public hearing on any proposed
material amendment(s) to the bulk regulations of any zone district
within the Township of Bedminster. "Bulk regulations" means changes
to the density, bulk and height standards applicable to designated
uses such as residential, village neighborhood or office research,
as well as sub-categories within such broader uses. A "proposed material
amendment" to the zoning ordinance is one that will have a substantive
effect and effects a fundamental alteration to the character of the
zoning district at issue. See Pacilli v. Tp. Of Woolwich, 394 N.J.
Super 319, 332 (App. Div. 2007). Notice pursuant to this section shall
contain the following: (1) a statement that the Township Committee
is considering an amendment to the Zoning Ordinance; (2) an identification
of the impacted zone district(s) impacted by the zoning ordinance;
(3) the date, time and place of the public hearing at which the Township
Committee will take a vote on the proposed zoning ordinance(s); and
(4) a statement of the citizen's right to appear to voice their support
of or objection to the proposed zoning ordinance(s). The failure to
provide notice to one or more persons entitled to notice hereunder
shall not impact the validity or enforceability of any ordinance to
which this section applies; provided, however, a good faith effort
is made by the Township Clerk to comply with this requirement. Nothing
in this section shall be construed or intended to substitute for any
notice requirements pursuant to N.J.S.A. 40:55D-62.1, N.J.S.A. 40:49-2,
and/or N.J.S.A. 40:49-2i.
