In addition to the zoning districts established in Article III and delineated on the Zoning Map, the area along State Route 30 containing outdoor advertising is established as an overlay in accordance with the Municipalities Planning Code, as amended.[1]

The location of each overlay is delineated the Zoning Map.
Overlays may not include all land or sites subject to the special features of the overlay, and not all land within the overlay district may actually contain the special or limiting feature.
It is the intent of this chapter that the limitations on development which are imposed by the overlays shall apply to all parcels which include the regulated feature, whether or not the land is shown in the overlay district. It shall be the responsibility of the applicant to establish the presence or absence on the proposed site of all features subject to regulation in this article.
If the Zoning Map or list is questioned, the burden of proof shall be upon the developer, who shall submit information from a qualified professional or other expert acceptable to the Borough to demonstrate that the site in question can be used in the manner proposed without violation of this chapter.
A. 
Purpose. This overlay is intended to provide adequate space for larger outdoor advertising in the Borough, such as billboards and electronic changeable copy billboards, along roadways that carry a volume of traffic that exceeds 15,000 vehicles per day, including U.S. Route 30.
B. 
Concept. The Outdoor Advertising Overlay shall be deemed to be an overlay on any existing or future zoning districts enacted to regulate the use of land in the Borough. The Outdoor Advertising Overlay is intended to supplement any existing regulations that relate to zoning or construction within the Borough. In those areas of the Borough located within the Outdoor Advertising Overlay, the requirements of this section shall supersede the requirements of the underlying zoning districts.
C. 
Location of overlay. The Outdoor Advertising Overlay is located and bounded as shown on the Zoning Map and is on file in the office of the Borough.
D. 
Use regulations. Land uses in the Outdoor Advertising Overlay are authorized per the underlying zoning districts according to the Table of Authorized Uses (§ 375-29). In addition to those uses in § 375-29, the following uses shall be authorized by conditional use in the Outdoor Advertising Overlay:
(1) 
Billboards; and
(2) 
Electronic changeable copy billboards.
E. 
Billboards and electronic changeable copy billboards shall adhere to the standards included in § 375-61G.
F. 
Area and bulk standards. Uses in the Outdoor Advertising Overlay shall observe the standards in the Table of Dimensional Requirements (§ 375-30).
G. 
Supplementary regulations. Uses in the Outdoor Advertising Overlay shall also adhere to the regulations of:
(1) 
Off-street parking and loading requirements per § 375-26.
(2) 
Sign requirements per Article VII.
