As used in this article, the following words and terms shall have the definitions as set forth herein:
ANNUAL REPORT
A written, notarized statement identifying how and in what manner garbage and trash removal will be performed for the calendar year of January 1 through December 31. Said report shall include name, address and telephone number of any contracted garbage and trash hauler, if applicable.
BUSINESS AND BUSINESS ENTERPRISE
Any and all properties located within the Borough being used in a commercial manner or any other manner other than as a purely residential use, and every business, commercial or other activity therein (except residential).
OCCUPIER
Any entity in actual possession of a commercial property who is not the legal owner.
OWNER
Any entity having legal or equitable title to the real estate of any commercial property or enterprise.
TENANT
A nonowner of a commercial property which shall be an occupant of a commercial property pursuant to some lease or other agreement.
Effective immediately, and hereafter, the Borough hereby establishes a requirement for all occupiers, owners and tenants of a business or business enterprise located and/or operated within the Borough to dispose of its garbage in a lawful manner, and to file an annual report in regard thereto at the office of the Borough Secretary. Said report shall be a written, notarized document detailing the manner and method of garbage and trash removal for the year, including the name, address and telephone number of any hauler, if applicable. Said annual report shall be signed by an authorized representative of the business entity operating or located within the Borough. Any and all occupiers, owners and/or tenants of commercial or business property shall file an annual report.
A. 
The annual report shall be filed at the beginning of each calendar year and must be filed no later than the last day of February for each calendar year. For the calendar year 1994 only, the filing deadline will be extended to June 30, 1994.[1]

A. 
Any occupier, owner or tenant who willfully fails to file an annual report under this article, or who does or attempts to dispose of garbage and/or trash at a site for residential pickup shall by such conduct violate the provisions of this article.
B. 
Any occupier, owner or tenant convicted of a violation of this article shall, upon conviction thereof before a competent authority, be sentenced to pay a fine of not more than $1,000 for each offense, plus costs, and, in default of payment of such fine and costs, be imprisoned for a period not exceeding 30 days.
